Faizabad riots - A pre-planned act of violence

24th October 2012

The timeline of events:

1. An illegal construction of temple near a mosque in Mirzapur village, on the outskirts of Faiazbad, produced an initial spark on 23/7/2012. The police administration instead of stopping the illegal construction locked the gates of mosque, reminding everyone the fate of Babri Mosque. This partisan action of the SO Cantonment produced intense negative reaction. The administration of the time did not let the matter go out of hand. The incident, however, vitiated the peaceful atmosphere. 2. Sensing the possibility of future trouble, Muslim Ulama, Hindu saints and Senior Citizens of Faizabad (Hindu and Muslim both) had requested the administration to resolve the matter on date 14/9/2012 (memorandum attached). However, the matter is still pending before the administration and illegality of the construction has not been verified through the land records as yet. 3. Three idols were stolen from Deokali Temple on the night of September 21-22. These idols were ancient and expensive. The priest and his family were responsible for its protection and were sleeping nearby. 4. The police instead of putting pressure on the priest let the discontent in the Hindu youths simmer. Hindu organizations came together on the issue of the theft. The DM and SSP, allowed the month long protests. 5. During these month-long protests, inflammatory songs, taped threats and communally inciting recordings were distributed freely by the local BJP units. 6. The administration also permitted the visit of Yogi Aditya Nath a MP of Gorakhpur, and a rabid communalist, who blamed the Muslims directly for stealing idols, without any evidence, and provoked Hindus to take revenge, by forcefully removing Muslims from Faizabad and Ayodhya. 7. Surprisingly, the administration did not take any action against the Yogi or others. 8. The background for communal violence was thus prepared by the political leaders in collusion with the administration. 9. On Wednesday (24 Oct, 2012), the Durga Puja procession began its journey peacefully for immersion of Durga Idols into Saryu river. 10. At about 5:30 pm, when the procession was near Popular Medical Hall, Rekabganj , Faizabad , a rumor was spread that someone has thrown a stone at one of the Durga Idol. This rumour was later found by the police to be incorrect. 11. Mysteriously, however, the petrol and kerosene appeared in the hands of rioters and the Hindu youths started burning of Muslim shops on the Rekabganj road. 12. The riots appeared organized as simultaneous incidents in Faizabad, a mosque and some shops in the Bhelsar and Rudauli area were also torched. The scale of arson was not large, and sufficient force along with police and administrative officials were present .However, senior level of administration SSP and DM both proceeded to Rudauli, leaving the procession in Faizabad under the care of subordinate officials. 13. In Faizabad, S.P. City and ADM City (administration) both were on duty, but they did not pass any order to stop arson of Muslim shops or disperse the mob. 14. Inspector of Special Branch of U.P. State , and an official of I.B. were contacted to reach the spot and to inform senior level district administration. 15. D.M. and S.S.P. reached the spot, and in their presence about 99 shops belonging to Muslims were put on fire by the Hindu Youths. 16. Masjid Hassan Raza Khan situated centrally in the Chowk area, was also put on fire. All the shops, including the office of Aap ki Taqat, a Hindi Urdu magazine, was looted first and then burnt. 17. To burn the mosque and the shops, the cans of kerosene were brought in a convoy of vans and parked in front of the mosque from the evening. 18. The guard of the mosque, who is an eye witness to the presence of vans, had told the drivers not to park the vans, but an official of the administration told him not to interfere. Ironically, while there was no dearth of petrol and kerosene with the Hindu youths, the Fire brigade arrived at the Faizabad Chowk, without water, and allowed all shops to be gutted. 20. Seeing the failure of district administration, Div. Commissioner of Faizabad was contacted, who was on a tour of Barabanki. 21. The Div. Commissioner and D.I.G., reached Faizabad Chowk promptly at about 8 PM, and tried their best to control the prevailing situation . By about 9:00 pm. the situation improved. The I.G. (Zone)

and Special secretary (Home) also reached the Chowk. It was because of their presence that the violence did not escalate and spread in the adjacent areas that day. 22. The arrival of CRPF and the Commandos, and their deployment in the affected areas, helped disperse the Hindu mob.

Salient points
1. Faizabad riots during the idol procession were an organized attack on Muslims business establishments by the Hindus with the help of district administration. 2. District Magistrate, District Superintendent of Police, S.P. City, ADM city, City Magistrate, C.O. City, and City Kotwal of Faizabad, all played a dubious and partisan role, and it was due to them that violence escalated in Faizabad town. 3. Muslims neither initiated nor took part in the arson. The riot was a one sided affair. Onlyshops belonging to Muslims were burnt thoroughly and viciously. 4. The district officials, who were unable to control rioting, over a stretch of road extending about 70 footsteps along North-South, and about 570 footsteps in the East-West direction, are now trying to give it a colour of mutual clash between two communities that goes against all the evidences. 5. Moreover, the same officials, who were unable to give strict orders to quell the Hindu mob on 24th evening, imposed curfew and ordered lathi charge on hapless Muslims shopkeeper, who had come to salvage whatever had been left in their shops, on the morning of 25th October 2012.

The violence was not the spontaneous reaction of two antagonistic groups over any land dispute or eve teasing incident. The event was pre planned as the communal forces had:
Brought Kerosene and Petrol in sufficient quantity to burn more than 99 shops Warned women and children beforehand not to come to procession (Durga - Puja invitation attached) targeted mosques deliberately to provoke Muslims. spread violence in adjacent areas of Faizabad simultaneously, such as Bhadarsa, Rudauli, Shahganj and Bande Ali Chahwni etc.

The simultaneous timings are very important as it shows a synchronization between the wide spread effort of violence against Muslims. Muslims in Faizabad and Ayodhya are of the opinion that the violence during the Durga procession is similar to the violence of 6th December 1992, where 18 Muslims were burnt alive, 23 mosques were damaged besides the Babri mosque, and 458 shops and houses were destroyed. Tragically not a single criminal has been punished as yet for these heinous acts, and this laxity seem to have encouraged the rioters to break the law and order with impunity.

Violence in Bhadarsa
1. At exactly the same time i.e. 5.30 PM in Bhadarsa, on 24th October, about 14 shops belonging to Muslims were put on fire by a Hindu mob with the help of PAC. These shops were adjacent to Jama Masjid area. The allegation is that someone (identity unknown)threw a stone on PAC. (The same strategy was used in Faizabad, where the fictional stone was rumored to hit the Durga idol.) The angry PAC accompanied with rioters, mainly from adjoining areas like Sariyawan, Bharat Kund, and Kalyanpur etc., burnt the Muslim shops. It is to be noted here that the local Hindu did not take part in violence. 2. Rani Bazar near Shahganj also witnessed violence on the same date. Bakhtiyar Khan, Local SP Leader was surrounded by Hindu Mob. Later, the police managed to disperse the mob. 3. Bande Ali Chhawni ,a locality on the outskirt of Faizabad town, was surrounded by Hindu mob on the same day. Here, PAC dispersed the mob.

Violence in areas around Bhadarsa on 24th at the same time

(a) A Mosque was damaged in Devakail, which is 2-3 Km from Bhadarsa. (b) In Fattepur, several houses of Muslims were set on Fire. (c) In QaziSarai, under Thana Pura Qalandar, which is 25 Km from Faizabad, mob tried to burn Muslim houses. (d) Muslim houses in Islamabad area that has 99% Muslim population, was attacked by PAC and the Hindu communal forces. (e) In Bardaiya also that has Hindu population 80% and Muslims 20%, PAC and Hindu attacked Muslim houses. (f) In Murgia ganj, Gram Sabha Rajepur, where200 houses belong to Hindus and 25 houses to Muslims,Hindus attacked the Muslim houses. (g) The Mirzapur and Nimauli villages were surrounded by Hindu mob. (h) Phulwariya and Babu Shah localities also witnessed arson. (i) Muslims from Piprataland Hindus from the adjacent village Shivalaga thered and raised slogans against each other, but no arson took place.

The partisan role of police in Bhadarsa and the nearby area

(a) CO Ayodhya , In charge of Bhadarsa town area was himself involved in inciting Hindu mob. (b) The SO of Thana Pura Qalanda ralso provoked Hindus to attack Muslims. (c) Raj Kumar Dubey, an advocate and a rabid communalist, gathered Hindus and incited them to violence by his speeches.

25 October, 2012
At Bhadarsa, Durga Prasad was stabbed to death when he visited the site of Mosque , where 15 shops belonging to Muslim Community was set on fire by Hindus on 24th. Some Muslim, in retaliation stabbed him to death. His shop was for Ready made cloths. Flag march took place in Kurri Bazar - Thana Pura Kalandar, after Hindu miscreants tried to attack the Muslim locality.

Preventive Measures:
1. On the directive of the Chief Minister Akhilesh Yadav, Principal Secretary (Home) R.M. Srivastava and DGP A.C. Sharma visited Faizabad on Thursday October 25, 2012. He was also accompanied by IG intelligence O.P. Singh. 2. DGP alleged that violence erupted in Faizabad due to dereliction of duties by District Administration. 3. He said that his orders were neglected by them. He confirmed that in order to control the violence, he had authorized the use of water cannon, Rubber Bullets, and Tear Gas Shells ,for dispersing the mob. He had also instructed to close the wine shops; but the presence of drunk devotees in the vigilance videos suggested that wine shops were not closed. He affirmed that action will be taken against the erring officers.

2. Muslims offered the Juma Namaz peacefully, in their local mosques, in the curfew bound area. The trouble however started again, when news came at sun-set that Bhadarsa has been surrounded by the Hindu rioters, and they are setting Muslim houses on fire. To save the situation, district administration rushed to Bhadarsa 15 Km. from Faizabad and DIG too went to Bhadarsa with CRPF, because senior officers did not want to take chance in view of the past experience of failure of district administration. The Hindu rioters used the opportunity of the absence of officers in Faizabad . They started mobilizing Hindu Mobs to attack on Muslim localities simultaneously. The following areas dominated by Muslims came under threat Balla Hata, Kakrah i Bazar, Mughal Pura, Bhadarsa

interior areas, Ghosiana, Dilli Darwaza, Kashmiri mohalla, Navatipura, Chela Chhawni, Rath Haveli, Chowk Faizabad, Bande Ali Chhawni etc. 3. In view of the danger, Dr. Manzoor Alam Saheb , General Secretary, All India Milli Council , New Delhi , was informed about the prevailing situation in Faizabad. Once apprised of the situation, Dr. saheb contacted the authorities in Delhi and the results appeared immediately. Additional Director General of Police (Law & Order) along with senior officers and additional force came to Faizabad and controlled the situation within an hour. Mr. Jag Mohan Yadav, ADGP (Law & Order) with intelligence officers visited all sensitive areas and declared shoot at sight order, with imposition of strict curfew order. The Military was also called to standby, but was not utilized ultimately.

It is surprising that the miscreants and criminal elements came to know about the change in administrative setup and disappeared immediately. This information was confidential and someone in the administration seems to have conveyed it to the criminals. Muslims of Faizabad pay their gratitude to Dr. Manzoor Alam and Janab ZafarYab Zilani Saheb, Janab Kamal Farooqui and Dr. S.Q.R. Illyas, who remained in touch with Faizabad and supported the cause of Muslims. We also want to thank Janab Waseem Saheband , Dr. Syed Abdul Bari of AIMC , Mohammad Suleman , President National League, Khalid Kamal of Kanpur, and Mohammad Anis of Faizabad , all have extended their full support.

27 October, 2012
Faizabad Town:
The curfew bound Faizabad remained calm. Muslims were permitted to offer namaz in their own locality .The namaz was offered in 40 mosques of different localities. However, as a mark of protest against the local administration sin efficiency in letting the violence and arson continue for hours, Muslims did not go to EiIdgah. They instead offered namaz in Jama Masjid Tatshah . The Qurbani also could not be performed today. ADGP (Law & Order) and his team were active on the roads, building confidence among Muslims for the rule of law and order.

Some cases in Faizabad

(a) Janab Tufail (Mobile:9838326682) has reported that 4 Muslims youths were grievously wounded but did not report the matter due to fear of criminals . They have been lying in bed without any medical aid since the evening of 25 October, 2012. These are: Mohammad Tasleem with a fractured leg ; Shamim Khan with a face injury (Mobile: 9452279445); Sarwar Khan and Feroz Khan with multiple injuries . All are resident of Naya Purwa (Retia) adjacent to Bande Ali Chhawni- near Akashvani (1/2 Km.), Faizabad. Matter has been conveyed to senior officers. (b) ADGP (Law & Order) addressing the press declared that 46 people have been arrested on charge of arson and 20 cases have been registered. More arrest in near future will follow on the basis of video clipping. He assured that stern action will be taken, culprits will be booked under NSA (National Security Act), and erring officers will be punished on the basis of video footage. He assured that some relaxation will be allowed in curfew.

Bhadarsa Town:
(a) The town Bhadarsa remained under curfew. (b) Muslims in Bhadarsa offered the Namaz peacefully but Qurbani could not be performed. Rudauli Town is also peaceful and Muslims offered Namaz peacefully.

Curfew bound Faizabad has remained peaceful. After Eid Ul-Azha , the district administration has started holding peace Committee meetings in different localities of the city.

29th October 2012 and after

Faizabad is now limping back to normalcy. Administration is lifting the curfew in the day time, for

progressively increasingly more hours. During these periods no untoward incident has taken place. From 31st onwards, after the application of Khaliq Ahmad Khan, addressed to the CM, UP, dated 29th October 2012, compensation was distributed as per the list attached. In view of above mentioned bare facts, discussions and prevailing situation , mistrust , lake of confidence in state government and district administration, it is pertinent to develop and restore faith in state Govt. and district administration among Muslim Community ,some preventive and reformative steps are required immediately for permanent peace and harmony in Faizabad and suburb towns Bhadarsa, Rudauli And Bikapur.

Muslims of Faizabad, Bhadarsa, Rudauli and Bikapur Pray

1. Immediate 100% compensation to the victims of violence 24-26 October 2012. The Shopkeepers be exempted from all taxes for 2 years in order to smooth distribution of compensation amounts to avoid complications of Trade Act (Uttar Pradesh Value Added Tax Act), section 14-Reverse input tax credit and section 21-Accounts and documents to be maintained by dealers. In case of arson ITC claim will be rejected and Tax Department will realize Tax under RITC. The distribution of compensation on basis of affidavit produced by shopkeepers will accelerate the process and delay tactics adopted by the officers will be avoided. 2. The part of compensation be realized from the officers found guilty of dereliction of duty and flouting the direct order of Director General of Police (DGP), U.P. on 24.10.2012 evening. for maintaining law and order . 3. The Central Durga Pooja and Ramlila Coordination Samitee Faizabad carrying the Durga Pooja procession should also be held responsible and compensation amount be realized from it. 4. The District Magistrate and Superintendent of Police (SSP) be suspended, who failed to maintain law and order in a very small areas East-West 570 footsteps distance and 70 foot steps North South direction where violence arson and loot took place on 24-10-2012, at 5.30 p.m. 5. Ayodhya-Faizabad have to witness Diwali, Moharram and parikarma. The 5 Kosi and 14 Kosi Parikarma will encircle the entire Ayodhya & Faizabad towns, the participations of criminals, miscreants and communal forces like BJP, VHP, Shiv Sena, Bajrang Dal, Durga Vahini etc can not be denied, who are responsible for violence in Faizabad. The total failure of DM and SSP in maintaining law and order in Durga Pooja, is indication that they cannot control future festivals and

Parikarma. The parikarma is not being performed under any committee or trust, about 12 Lakh people is expected to participate. 6. The organizer of Durga Procession The Central Durga Pooja and Ramlila coordination committee Faizabad and Government officers be booked under 120B of I.P.C. in all criminal cases. 7. To Command the Central Bureau of investigation to probe into the pre-planning of the incident that lead to communal violence and arson in Faizabad Bhadarsa, Rudauli and Bikapur on 24/10/2012 at 5.30 p.m. 8. The Deployment of CRPF and Rapid Action Force be ensured on occasions of Diwali, Moharram and Parikarma. 9. The Special Investigation Team should be constituted to probe Nexus between district administration, Political leaders of all Parties, The Central Durga Pooja and Ramlila coordination committee, Communal forces and criminals. 10. The Monitoring of Processions and festivals by Divisional Commissioner and DIG be ensured to prevent future violence.

Serious allegations have been leveled against Central Durga Pooja Committee for including criminals , rioters and drinkers in the procession, whom they did not control. Eye Witness accounts also affirm that several trolleys meant to carry Durga idols were stocked with wine and kerosene, for these rioters to burn the Muslim shops and establishments as per a preplanned strategy . All these actions have made the Durga procession Committee illegal . However, the district administration has not yet taken any action against the erring officials of the Committee

The accused are Deep chand , Radhey Shyam, Rishiram ,Gurjeet , Raju , Raj Kapoor , Somnath, Vijay Gupta , Dr. Ramesh Sahu and Ramesh kumar Soni . Vijay Gupta ,who is among the accused in the murder case of Mohammad Umar , is also the village Chief. SSI Prem Narayan Sonkar of Bhadarsa has lodged FIR against 160 accused, 60 people has been identified and 90 are unknown under rioting charges.

The Role of Political Leaders of Faizabad 1. Pawan Pandey Sitting MLA (SP). Noxious Relation:

Pawan Pandey has close relation with Suresh Pathak and his brothers. Pandey protected Pathak family from the Police, when name of Pathak family surfaced in idol theft case of Devokali Temple , Faizabad. He has also cordial relation with Manoj Jaiswal the president of Central Durga Pooja Samittee and Ramleela coordination committee. The participants of Durga Pooja procession took part in orson and looting. The violence of Faizabad was a part of conspiracy to divert the attention of Police and Public from Pathak family, Manoj Jaiswal, Surya Kant Pandey (SP), Dimpal Pandey aspirant of MP ticket from Samajwadi Party (S.P), joined hands with Pawan Pandey. They were at arsone site anddid nothing to extinguish the fire . It is to be noted the village chiefs (Gram Pradhan) of Samajwadi Party played negative role in establishing peace, due to them violence escalated in village sides.

Nirmal Khatri Sitting Member of Parliament (MP).

He has double faced personality he wears Saffron Kurta among Ayodhya sants and green Kurta among Muslims. He projects himself as secular but by heart he is hard core communal: Nirmal Khatri initiated new programme Ramayan Mela at Ayodhya , During Sripat Mishra as Chief Minister Uttar Pradesh Ramayan Mela was adopted by State Government. From this platfrom Khatri declared that Babri Mosque would be unlocked very soon. That was VHP popular demand. Mahant Nirtya Gopal Dass is president of Ramayan Mela and he is also president of Ram Janam Bhum which is controlled by Niyas a VHP (Vishwa Hindu Prishad) organization 1st Feb. 1986 : Babri Mosque was unlocked against honble High Court order to maintain 1988 status quo.

: During Dashehra Festival 12 shops of Muslim wore set on fire by a single Hindu Mangal Sunar (Gold Smith) during curfew. Maulana Kutbuddin Qudri Imam Jama Masjid Tatsah and Abdul Halim were arrested under NSA, without any reason by the Police. No hindu was arrested. At that time Nirmal Khatri was M.P . : Foundation stone (shilanyas) was laid down in front of Babri Mosque on disputed Nazal Plot No. 586, Khatri was behind the shilanayas, against Honble High Court order.

The Ramayan Mela which took place on 20-23 November 2009. He is assuring Hindu saints of Ayodhya for the Construction of Ram Temple at disputed site provided he wins again. The indication is clear, he will fight 2014 Parliament election on Ram Temple issue. He may seek support from Lallu Singh once again.

A muslim dominated locality was surrounded by Hindus and PAC was deploved inside locality who started firing without any provocation by the Muslims. Muslims were not allowed to peep through the windows but Hindus were allowed to attack on Muslims.

Thickly dominated Muslim locality was raided by three sides by Hindus, Sindhi (Refugee) and upper caste Hindus. PAC entered into the locality and without any provocation from Muslim sides starting firing at Muslim Houses. Under PAC cover Hindus, Sindhi (refugees) and Thakur of Janaura started marching in order to attack on Muslims. Divisional Commissioner, Faizabad was informed who deployed Para Military Force and PAC was withdrawn.

Attack on Mosqnes :
1. Hindus fundamentalist attacked Rudauli and Bhelsar/Ahelwana mosques with the helps of local police.Bijinia Bridge Mosque was also damaged by the Hindu mob. 2. In Bhadarsa outsiders of Bhadarsa attacked the shops of the Mosque, the police was with them. Two side walls Eidgah was also damaged.

3. Masjid Hassan Raja Khan, Chowk was set on fire by Hindus with the help of district administration on 24th October 2012. Attack on Noorani Masjid by the Police is another example of Police attitude towards Muslims and their religious places.

Local resident informed that police and P.A.C. entered into the mosque, broken the door , damaged almirah and other furniture. The police also deconsecrated The Holy Quran on the night of 5-6 November 2012 at 1.15 am. Late in the evening, under pressure of Muslims, Police has released Mohammad Ilyas, Mohammad Tariq, Mohammad Aiyub and Mohammad Sayeed. Wahid, Mohammad Jishan, Mohammad Tauhid, Bilal Ahmad, Mohammad Khalid, Abdul Latif and Mehndi Hassan were Sent to jail by Police.

Yadav, Revenue Inspector Mr. Ram Vibhuti Tiwari, Civil Police, PSC, CRPF, Q.A.R.T., Anti Riot Van ( Bazar), Fire Service are camping day Night at Bhadarsa. The Thana Incharge Poorakalander Mr. Chandrabhan Yadav told that 4 FIRs one received from Islamabad lodged by Abdul Qaiyum S/o Hamid case Registered under section 147, 148, 149, 394, 436, 153 K-IPC against Baburam and named 15 accused including hundred of unknown persons, Ahmadullah W/o Bismillah lodged written complaint against Sewak, 13 named and hundreds of unknown accused FIR lodged under 147, 148, 394, 436, 427 IPC, Aisha Khatoon W/o Kafil lodged FIR under Section 147, 145, 149, 394, 436, 153K IPC against Lochan Nishad and & Named and hundred of unknown Shahjahan W/o Naseer Ahmad has given written complaint against Ram Adhar 15 named and dozens of Unknown persons under section 147, 148, 145, 436, 394, 427 and 153K IPC. Ex-chairman Rambodh Soni was arrested on various charges by the Police.

FIR by City Kotwal: Debunked Allegation Of Eve-Teasing by Muslim Boy
(A) The Crime No. 3779/12 The Petitioner is city Kotwal Bullan Yadav who is now suspended.

The City Kotwal lodged FIR on 26/10/2012 at 3:20 P.M Against Wahid (Muslim boy) and 300-400 rioters under section 147/323/436/307. In the FIR it is stated that there was some minor dispute between Wahid and the rioters. There is no report against eve-teasing as propagated by the Sangh Parivar (RSS) and (BJP) workers. It is to be noted that communal forces have been justifying the violence on grounds of eve-teasing. Even Director General of police denied such case on 25/10/2012 in press conference.
