Plaintiff Galope has filed a motion to recuse the bankruptcy judge in the New Century Mortgage (now New Century Liquidating Trust) in the Delaware Bankruptcy Court. Alan Jacobs is the appointed bankruptcy trustee and the law firm reprsenting him is Hahn & Hessen of NYC.
Homeowner/borrowers were never notified of the filing of the New Century and Home123 Corp bankruptcy even though those two companies maintained all the contact information for homeowner/borrowers of the predatory lender.
Many homeowner/borrowers have had to file legal pleadings in Delaware in the bankruptcy case in order to obtain discovery of what happened to their mortgage/loan after they closed. New Century Mortgage and Home123 Corp are notorious subprime predatory lenders.
It has also now become questionable on whether or not the bankruptcy estate still holds mortgages/loans due to defective and invalid assignments/sales/transfers. It has been discovered that the two companies had their own notary/employees (California notaries) who did not comply with California laws on notarizations.
Homeowner/borrowers are seeking to find the true creditor who they should be paying (see new TILA and two federal reserve opionions now rule to the law--these specify who the creditor is not--and it is not the servicer!--see also retroactivity of this).
