Suit for Injunction

An injunction is an order of the court restraining or preventing a person from doing a particular act. E.g. Lumby v. Wagner A party that fails to comply with an injunction faces criminal or civil penalties and may have to pay damages or accept sanctions. In some cases, breaches of injunctions are considered as serious and resulted unpleasant situation.

4.Suit upon Quantum Meruit

The term "quantum meruit" means, 'as much as is merited' or 'as much as earned'. A suit of quantum meruit is a claim for the value of the material used or supplied under a contract that has become void on account of breach by the other party.

Quantum Meruit arises in following cases

When an agreement is discovered to be void. When there is an express / implied condition to render services but there is no agreement as to remuneration is payable . When a thing is lawfully done or goods are supplied by a person without any intention to do so gratuitously to other person & such other person enjoys benefit thereof, he is bound to make compensation to the former.

When the completion of the contract , the person who did the work can recover a Quantum Meruit for the work done under the contract.

5.Suit for damages

Damages means monetary compensation for the loss suffered. Whenever a breach of contract takes place, the right of damage is the consequence. The amount of damages would depend upon the type of loss sustained to the party by the breach. The court would identify the loss and then assess the monetary value.

Types of damages
Sec:73 says that the aggrieved party may entitled to one of the following damages. (a) General / Ordinary damages. (b) Special damages. (c) Exemplary / Vindictive damages. (d) Nominal damages. (e) Penalty & Liquidated damages.
