Bail was set at P200,000 for the accused, whose case was resolved after he failed to submit his counteraffidavit. Lascivious conduct under the implementing rules and regulation of RA 7610 is defined as the intentional touching, either directly or through clothing, of the private parts of a person or the introduction of any object to the genitalia, anus or mouth of any person, whether of the same or opposite sex, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person. In her sworn statement, Meme (not her real name) said that last Sept. 8 at 2:30 p.m., she was inside the comfort room of the Lipata Elementary School. Traya allegedly went inside, closed the door and pointed a barbecue stick at her. He then punched Meme in the stomach. When the victim fell down, the accused kissed her. Meme bit his lips and shouted, causing Traya to run outside the comfort room. She then told her math teacher about the incident
