Dear Chief Kunkle: ¢ von 6
sake, none
‘This office is in the process of reviewing cases where Sgt. Randy Sundquist #6517 may be called to testify. As you are
aware, back in 1994 assistant district attorney Mike Gillett wrote a letter to Chief Ben Click informing him that the
District Attorney's office would not sponsor Officer Sundquist as a witness due to your department's finding of his lack of
veracity. Mr. Gillette's letter explained our responsibility under the law required such information to be provided to the
defendant's attomey. Additionally, Mr. Gillette's letter advised that cases would be dismissed if they could not be proven
without his testimony.
instated. To date, he has not been exonerated for
Although your department terminated Officer Sundquist, he was later
your department's determination of his untruthfulness.
‘A review of several cases filed by members of a Northeast Deployment squad of the Dallas Police Department revealed
that Sgt. Randy Sundquist has now been filing cases, supervising police activities, and asserting facts upon which he may
be called to testify in Dallas County criminal cases.
This is troublesome considering the District Attomney’s office informed your department that we would not vouch for
Officer Sundquist’s credibility. To make matters worse, in a hearing on March 16, 2009, Sgt. Sundquist gave swom
testimony which raises new concerns about his judgment and credibility. Please consider this letter as a renewal of our
insistence that the prosecution will not sponsor Sgt. Sundquist as a witness.
We are currently exploring his assertion that he has testified between 50 to 100 times since 1995 and ask for your
assistance in determining the number of times he has testified.. We look forward to working with D.P-D_1o develop an
effective tracking system to monitor restricted witnesses. By working together on this issue we can ensure ethical
prosecution.
Sincerely,

RE: Officers:
Randy Sunquist, Badge # 6517
Dear Chief Click:
Our office has been apprised by Sergeant Bernal of your Internal Affairs Division, that
allegations of misconduct by the above-referenced officers have been sustained. We were
advised that Officer Sunquist has been terminated, Officer Bryant has been suspended for twenty
(20), and Officer Givens has been suspended for ten (10) days.
We were further advised that both Officer Sunquist and Officer Bryant had an allegation
of making a false statement to Internal Affairs sustained. Officer Givens had an allegation of
giving false testimony in an examining trial sustained. Sergeant Bernal related that these
findings were based on intentional misrepresentations as opposed to mistakes.
It is the position of this office that under these circumstances, we cannot and will not
vouch for the credibility or sponsor the testimony of these officers in any pending or future case,
Your findings of their lack of veracity are required by law to be provided to the attorney
representing a defendant in any case in which they are involved as witnesses, A case by case
evaluation of pending indictments will be conducted to determine our ability to continue
prosecution without these officers" testimony. Ifa case cannot be proven independently of their
testimony, it will be dismissed.
T know the situation has been personally distressing to you, but we appreciate your efforts
to insure the continued integrity of the Dallas Police Department,
Sincerely,
Mle Seat
