I ____________________________ hereafter referred to as Tenant/Lessee, do hereby agree to the following conditions for occupancy in the residence identified above. The Lessee will lease from the lesser/owner the property listed above a full term of ___________ commencing on ____________ and ending on ____________. 1. FINANCIAL CONDITIONS: Rent for the above property is $1,00.00 per month, due on the 1st day of the month for the upcoming month. The damage, security, cleaning deposit of $1,00.00 shall be paid at the beginning of the lease agreement. The tenant will also be responsible for all other self-incurred bills; electricity, telephone, cable, etc. unless other arrangement has been written out. 2. RENT ARRANGEMENT: The tenant agrees to pay the rent in CASH on the 1st day of each month when the landlord (Colin Fitzgerald/Mandy Fitzgerald) will come to pick up the rent. Tenants agree to pay cash each month and understand only cash will be accepted. A late charge of $15.00 will be charged if (3) three days delinquent, $25.00 per day will be charged for each day thereafter. If rent is not paid by the fifth day and there has been no expression of intent to pay, the tenant will be served with a 3 day notice to vacate the property. After the three days, if tenant has not vacated the property the Landlord/owner will file a Forcible Entry and Detainer (FED) with the County Court to start the eviction process. At which time a court date will be set to file a judgment against the Tenant. 3. BACKGROUND/CREDIT CHECK: The tenant agrees to provide the Landlord three references, credit and employer information, and background information. The Landlord will run a credit check, and background check. Tenant agrees to pay $25 cash (per person) at the time of application to cover this cost. Tenant agrees that all information provided is true and accurate information. 4. CARE OF PROPERTY: The tenant shall maintain the interior of the residence in a reasonable manner keeping property and sidewalks free of debris. The Landlord has the right to inspect the property at any time after giving the tenant a 24 hour notice. If the property is not kept in an orderly and clean manner, (as determined by the Landlord), the Tenant will be asked to vacate the property. Landlord will inspect the property when he picks up the rent each month.

5. OCCUPANCY: Only the following tenants shall reside in the residence: ______________________________________________________________________. No other persons shall occupy the property without consent of the Landlord.

6. NO SMOKING is allowed on the property. This is in violation of the lease and the tenant will be asked to vacate the property immediately. 7. TENANT INSPECTION: Within 14 days after the Tenant rents the property, he/she will provide a list of damages that he has noted about the property. Any damage not specified in the list will be the Tenants responsibility. 8. LEAVING PROCEDURE: The Tenant shall sign a lease agreement to stay in the property for _______ year, or ________months. The Tenant understands that leaving before the time is up will forfeit the Deposit. If Tenant decides to stay longer, then he must sign another lease for an additional period of time. If Tenant decides to leave at the end of lease, tenant must still give the advance thirty day notice. Possession of premises after the first day of the month will require a full months rent. The Tenant understands that deposit will be forfeited if there is not 30 days notice given to Landlord after the lease expires. 9. DEPOSIT: Tenant agrees to furnish a cash damage and performance deposit in the amount of $1,00.00. Said cash deposit does not constitute advance payment of rent and is to be refunded without interest to lessee when tenancy is terminated providing premises, its furnishings, and appliances have been left in a good and undamaged condition and thoroughly cleaned. Part of the deposit will be used to have the carpets professionally shampooed upon leaving. The rest will be forwarded to your new mailing address within 60 days. 10. MAINTENANCE: For maintenance problems Tenant is to call Colin Fitzgerald at 720.979.1105 or Mandy Fitzgerald at 970.640.1429 11. EXTRA SERVICES: If additional improvements and/or services seem to be necessary or desired, the Landlord agrees to consider making them and let the Tenant know his decision. If the Tenant contracts on his own for service on the property, he agrees to be responsible for the charges incurred. The Tenant agrees to be responsible for minor repairs. 12. LEGAL CONSIDERATIONS: The Tenant agrees to abide by all applicable state and local laws regarding residential tenancies. If Tenant does not meet responsibilities, Landlord will have eviction notice (FED) served in accordance with the law. Tenant also agrees to abide by all Westwood Estates Home Owners Association rules and regulations. 13. WALL HANGINGS: Tenant agrees to not drive nails, tack, screws, or any objects into walls; nor to use any adhesive type substance without written consent of the Landlord. The use of small approved-type metal picture hangers obtainable at hardware stores is accepted.

14. ADDITIONS AND ALTERATIONS: Tenant agrees to make no additions or alterations in or about the premises, painting, or install any antennas, electrical wiring, or change interior premises without written consent of landlord. 15. DAMAGES: It shall be the tenants responsibility to pay out of their own money for any damages that may be caused by Tenants or guests. Tenants also agree that premises are in good order and any exceptions shall be noted on the agreement before signing it

16. NO EXCESSIVE NOISE: Tenant agrees not to cause disturbance to other neighbors by having excessive noise, stereos, loud boisterous parties etc. Tenant will be asked to vacate if such occurs. 17. TERMINATION: The Landlord may exercise the option to terminate this agreement and tenants will immediately surrender possession of the premises, tenants consent to give permission to Landlord to enter said premises whether tenant is present or absent and remove any and all personal property and effects of the tenant, and may retain possession until all charges i.e. rent, storage, breakage, loss, and any other charges are paid in full. If within a reasonable time the tenant fails to regain possession of any or all property, the owner is authorized to sell any or all personal property for the amount of the tenants obligation and tenant waives all damages to property sold as herein provided. 18. ATTORNEYS FEES: In the event a suit is necessary to enforce any of the provisions herein contained, or to recover possession of the premises leased, the tenant agrees to pay landlords reasonable attorneys fees plus all court costs or fees incurred. 19. AUTOMATIC FORFEITURE OF DEPOSIT: The tenant fully understands and agrees that partial or total failure to comply with any one provision or condition as expressed will result in automatic forfeiture of the deposit. 20. WAIVER: If any part of this agreement is invalid by reason of law or governmental regulations or if any provisions hereof are waived by Landlord, the remaining portions of this agreement shall remain in full force and effect. 21. KEYS: Tenants shall not change existing locks or make additional keys. If additional keys are required please ask the Landlord. All keys must be returned before deposit will be returned to Landlord. 22. INSURANCE FOR TENANTS PERSONAL PROPERTY: Furniture and personal belongings of the tenant are NOT covered by Landlords liability insurance policy. Tenants are required to obtain their own renters insurance policy to cover their personal belongings. 23. Tenant also agrees that pets will/will not reside on the property. If approved, $350.00 nonrefundable deposit and $25.00 a month added to rent. Pets will need to be approved prior to move in, and will require references on pets demeanor and tenants cleanliness. If the Landlord finds a violation to this agreement the tenants will be asked to vacate the property.

24. MAINTENANCE of the YARD: Westwood Estates Home Owners Association will cover all outside maintenance. Tenant will keep deck and balcony free and clear of excessive items. 25. Tenant agrees to take full responsibility for all individuals for any liability or injuries that may occur on the premises. The Landlord will assume NO responsibility or liability for Injuries to anyone which may occur on the property. 26. Tenant agrees that NO Daycare shall be done on the property.
