When the writ petition filed as a PIL was considered on the last date learned counsel for the petitioner fairly agreed to try and find out whether subject or the problem of education to children of women prisoners undergoing incarceration in jail has been considered by the Court or not. Today he has informed us that the Apex Court by the judgment dated 13.04.2006 in the case of R.D. Upadhyay versus State of Andhra Pradesh & Ors issued extensive directions including direction with regard to the education and recreation for children of female prisoners. He has also informed this Court that the matter has again been taken by the Apex Court for monitoring implementation of that judgment and the date next fixed is some times in October, 2013. Learned counsel for the petitioner has obtained materials from Internet which have been annexed as Annexure-1 to show that in the State of U.P. 135 children of female prisoners are reported to be with their mothers in jail and hence early implementation of the directions with regard to the educational and recreational facilities should be ensured. It would not be proper for this Court to initiate parallel proceedings in the matter when the Apex Court has already issued extensive directions and appears to be monitoring the matter. Hence the writ petition is disposed of with liberty to the petitioner that if it is possible petitioner may approach Apex Court to assist it in the matter specially with regard to children of female prisoners in the State of U.P.
