JOANNA CABUYAO Plaintiff, -versusFIDEL CAMPO Defendant. x------------------------------------------------------x ANSWER COMES NOW, the defendant, through the undersigned counsel and unto this Honorable Court, most respectfully asserts: 1. That the defendant cannot be dispossessed of disputed property Lot. No. 5690 for he registered the same in his name and has been issued a land title under the Torrens system, herein attached and marked as ANNEX A. 2. That as a rule laid down in Spouses Pascual v. Spouses Colonel the person who has a Torrens Title over a land is entitled to possession thereof. 3. That as the registered owner, petitioner has a right to the possession of the property, which is one of the attributes of his ownership as pronounced in Corpuz v. Spouses Agustin. 4. That as pronounced in Corpuz v. Spouses Agustin, a Torrens Certificate of title is indefeasible and binding upon the whole world unless and until it has been nullified by a court of competent jurisdiction. WHEREFORE, the defendant prays that as the one who has better right to possession of disputed property under the Torrens system, the complaint be dismissed with costs against the plaintiff.
