    Dear Ms. Rodora Mendoza,

    Greetings! You have recently approached us regarding an accident that one of your buses was involved in on September 26, 2013. Said accident resulted in the death of two pedestrians and numerous injuries suffered by the passengers. We are aware that the families of the victims have filed a case for damages against you and the company and that you have no intention of paying the families the damages that they are asking for.

    After conducting our own investigation, it is with regret that I inform you that the firm cannot represent you in this current case for the following reasons: 1. There was negligence on the part of the company as you let the bus driver, Mr. Adel Kastigo, go to work while he was under the influence of alcohol; 2. Under Republic Act No. 10586, otherwise known as the Anti-Drunk and Drugged Driving Act of 2013, it is unlawful for any person to drive a motor vehicle while under the influence of alcohol, dangerous drugs and/or other similar substances; 3. Also under RA 10586, the operator of the vehicle driven by the offender is directly liable and responsible together with the offender for the fine and award given to the offended parties.

    The best course of action for you would be to enter an out-of-court settlement with the victims families and pay what they are asking for. If what they are asking for is not amenable to you, you may enter into negotiations to arrive at a settlement that is agreeable to both parties. We urge you to consult with another firm if you wish for a second opinion. Thank you for the interest in our firm.
