AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

1. The affiant, James P. Deveny, is a member of the University of Connecticut Police Department, having been so employed since April of 2009, presently holding the rank of Patrol Officer. That prior, this Affiant was employed with the Norwich Police Department, Norwich, Connecticut,

having been so employed since June 1985, with 25 years experience. During the course of my law enforcement employment, I have received formal training and gained experience in the investigation of criminal matters to include the investigation of homicides. That the Affiant has received specialized training in the investigation of such violent crimes. That the Affiant has investigated violent crimes in the past and has personal knowledge of the facts and circumstances herein related as a result of my own investigative efforts and those of other police officers who reported their findings directly to me.

2. That during the late evening and early morning hours of Saturday 10/17/09 and Sunday 10/18/09, this affiant, Lieutenant Shortell and Captain LaChance were working inside the Student Union Building located at 2110 Hillside Road, assigned to monitor a West Indian Cultural Dance event. The Jo-Ryu Security Company was also hired for the event which was being held in room number 331. Members of the security detail conducted comprehensive searches of both the female and male subjects entering the third floor ballroom. All participants who entered the event were required to wear a valid wrist band. The guest policy of the event was open to the public with picture identification. The dance had allegedly sold out with a maximum ticket sale of 350.The remainder of the Student Union building was open to the public including the first floor where numerous restaurants are located.

3. At approximately 0026 hours on 10/18/09 the buildings' fire alarm sounded and it was later determined the alarm box that was pulled was located on the north end of the Student Union building in area open to the public. The West Indian Organization and the security staff determined the dance would be ended due to the procedure of evacuating the building. The approximately 350 dance patrons proceeded to evacuate the building. As patron's exited room 331 this affiant and Captain LaChance observed a group of black males in the lobby outside of room 331 trying to separate two other black males from what appeared to be some type of verbal disagreement. Another black male (identified as Brian Parker) was standing by the doors and attempting to approach the males having the disagreement. Jo-Ryu Security personnel intercepted Parker and continued the evacuation of the building. A few moments later this affiant, Captain LaChance and Lt. Shortell were notified there was a fight outside the building.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

4. As this affiant, Captain LaChance and Lt. Shortell approached the altercation Brian Parker was observed being led away by other males, crossing the street towards Gampel Pavilion. Thinking order had been restored, this affiant, Captain LaChance and Lt. Shortell returned to the area of the Student Union.

5. That Officer Arrieta also responded to this incident and had parked his patrol vehicle southbound in a bus stop area which is located on Hillside Road directly across from where the crowd of people were exiting the building. Officer Arrieta left his cruise lights on and stood outside of his vehicle on the side walk. Officer Arrieta stated that he observed the crowd moving and getting louder as if a fight was either happening or getting ready to occur so he notified headquarters and walked toward the crowd.

6. Officer Arrieta approached the altercation which was located in the grassy area just south of the exit and observed several black males getting ready to fight. One of the males was identified as Brian Parker. Officer Arrieta broke up the group as Captain LaChance, Lieutenant Shortell and this affiant arrived from within the building to assist. The group of males then left the area and Officer Arrieta lost sight of them as they moved into the crowd. Because Parker had appeared to be the aggressor, Officer Arrieta watched Parker as he left the area, Parker crossed the street and walked southbound along Hillside Road towards the area of the Husky Dog statue near Gampel Pavilion.

7. Seeing that Parker was continuing southbound Officer Arrieta stopped following him and returned to monitor the crowd. Shortly after returning to the crowd, Officer Arrieta noticed that Parker was returning; walking northbound on Hillside Road, back toward the Student Union. Officer Arrieta advised UCONN dispatch of this and Captain LaChance, Lt. Shortell and this affiant began to respond back to this area.

8. This affiant and Lt. Shortell left the area in front of the Student Union and began to walk in a southwest direction across the grass area in front of the Student Union. As this affiant was walking, a black male, later identified as Moshood Olatokunbo, grabbed this affiant's arm and related someone had been stabbed. Olatokunbo pulling this affiant towards the front sidewalk of the Student Union.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

9. Officer Arrieta approached Parker, intercepting him at the intersection of Hillside Road and Fairfield Way. Officer Arrieta and Captain LaChance, who had arrived to assist, observed a red stain on the back of Parker's shirt. Parker's shirt was lifted and they saw Parker's upper mid back drenched in blood running down to his lower back. At this same time, they heard over the radio that someone had been stabbed outside the Student Union. Captain LaChance then radioed Headquarters there was a second stabbing victim. Parker was sitting on the brick wall just outside of the Student Union when his shirt was removed, the shirt was left on the brick wall where he had been sitting and was later·seized as evidence. While waiting for medical treatment, Parker turned to the crowd and pointed to a black male wearing a grey long sleeved thermal shirt, stating that he had been involved in the incident that had just taken place. (This black male was subsequently identified as Johnny F. Hood)

10.This affiant observed a crowd of people standing around a black male subject who was on his back on the main sidewalk of the Student Union, This black male subject was subsequently identified as Jasper Howard. Howard's head was being held by a female in her knees and a female was attempting to put pressure on Howard's stomach area. The female holding Howard's stomach was subsequently identified as Abigail Morales. This affiant knelt down at Howards right side and asked the people standing around him what his name was. This affiant was advised "Jasper". Jasper (Jazz) Howard is a Junior at the University of Connecticut and is a member of the UCONN football. team.

11. This affiant asked Howard who had stabbed him and received no response. This affiant had Morales remove her hands so this affiant could observe the severity of the wound. Howard's shirt was lifted and this officer observed he had sustained a laceration type "stab" wound to the middle of his abdomen. This officer could observe blood exiting the wound.

12.lt was determined by Officers at the scene there were two subjects who had sustained laceration type "stab" wounds. One victim, Brian Parker, was located at the intersection of Hillside Road and the Fairfield Walkway. The second victim, Jasper Howard, was located on the main sidewalk to the Student Union on Hillside Road.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

13. That, two witnesses at the scene pointed to a black male, stating he had been involved in the fight with Parker.

14. When approached by police, this black male initially provided an alias of Brian Wilson DOB: 01/23/1988. He was looking down on the ground in the grassy area just outside the doors to the Student Union .. He said he was trying to find his gold teeth he had taken out of his mouth and dropped on the ground amongst the crowd. He was patted down and no weapons were found. He denied being involved in any verbal altercation or physical fight. He later admitted that his name was actually Johnny Fitzgerald Hood DOB: 01/23/1988 of 160 Wooster Street Hartford, CT. Also with Hood at this time was another black male identified as De'Quan Muhammed DOB: 08/21/1989 of 25A Judson Street Hartford, CT. Hood was subsequently arrested for Breach of Peace and Interfering and was in the presence of the UCONN Police from that point on.

15. That on 10/18/09 at approximately 0200 hours, the Eastern District Major Crime Unit responded to assist the UCONN Police Department with the double stabbing incident at the Student Union building located at 2110 Hillside Road on the University of Connecticut Storrs campus. The victims were identified as UCONN football players Jasper T. Howard DOB: 01/28/1989 aka "Jazz" and Brian D. Parker DOB: 12/05/1989 aka "B.P".

16. Initial investigation indicated Parker had been stabbed once in his upper back near the spine.

Parker was transported to Windham Hospital, treated for his injuries and released from the Hospital with non-life threatening injuries. Howard had been stabbed once in the center of the front of his body just below the sternum. Howard was flown via Life Star to St. Francis Hospital where he succumbed to his injuries and was pronounced dead by Dr. William Marshall at 0300 hours on October 18, 2009. On October 18, 2009 an autopsy was performed at the Office of the Chief Medical Examiner by Dr. H. Wayne Carver III. Dr. Carver determined the cause of death was a" stab wound to the abdomen and the manner of death was ruled to be homicide.

17. That on Sunday, October 18, 2009 at 1030 hours Johnny F. Hood was interviewed and provided a sworn written statement regarding this incident. During the interview Hood was wearing the same grey, long sleeved thermal shirt and dark jeans that hewas wearing at the dance. These items were seized as evidence.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

18. He stated, among other things, that he went to the dance with his friends John Lomax who is also known by the street name of "Puda", De'Quan Muhammad and Hakim Muhammad who is also known by the street name "Keem". That they drove to the dance in Lomax's vehicle, a tan Nissan Maxima and when they got to UCONN they met up with Johnny Hood's cousin, Leroy Moton, a UCONN student. According to Hood, Lomax was wearing a dark colored hoodie and jeans. De'Quan was wearing a black coat and a baseball hat that was black and red. Hakim was wearing a dark colored hoodie and lighter blue jeans.

19. Hood stated they parked in the parking lot across the street from the Student Union and before going inside to the dance, he put his wallet in the back seat of "Puda's" car so he wouldn't lose it at the dance.

20. This parking area is known as the Field House Parking Lot because it is located next to the Field House which is directly across from the Student Union on Hillside Road.

21. Johnny Hood stated while at the dance, the fire alarm went off and everyone began to exit the building. As they were leaving the ballroom he got into an argument with a black guy because this guy was disrespecting a girl. This guy had a friend nearby who was also" talking at him". Hood stated he doesn't remember exactly what this guy was saying, but he looked like he was trying to "get at" Hood. Hood looked through the UCONN football handbook and picked out A.J. Portee as the guy he had this initial argument with. He stated he didn't see the other guy among these photos. That there is no photograph of Brian D. Parker in this year's team book as he is currently ineligible to play.

22. Hood stated that upon exiting the building he met up with A.J. Portee in the grassy area just south of the doors. He explained he was trying to tell Portee why he had been arguing with his friend (Brian Parker) but Portee wouldn't let him explain. Hood couldn't recall what Portee was saying to him but he interpreted what Portee was saying as "fighting words". Hood stated he took his gold teeth (grill) out of his mouth and held it in his hand because he didn't want to be wearing it if he got hit in the mouth. Hood stated he didn't know where his friends were at this time but Portee had three or four boys with him. Hood explained he looked behind him to make sure that none of Portee's friends were coming up behind him and when he turned back, Portee was taking a swing at him. Hood ducked down and put his hands up to deflect the blow. After swinging at him,

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

Portee and his friends backed away and Hood looked down on the ground to find his grill that he dropped. Hood recalled as he did this his cousin Leroy asked him "are you straight?" (which means) "Are you alright?" and Leroy began to help him look for his teeth. Hood stated he and Leroy looked for his teeth for about 5 to 10 minutes before a cop (Captain LaChance) came by with a flashlight and also helped them look. This cop asked Hood if he had been involved in a fight that had gone on and Hood responded just that he had dropped his teeth. Hood explained he didn't tell the cop what had happened because it was nothing; that Portee hadn't really even connected with him. A few minutes later, another cop came by and grabbed his arm. Hood stated this cop ( Master Sergeant Andruskiewicz) said he wanted to talk to him because he had been involved in some incident that had happened out there on campus. Hood stated De'Quan saw the cops talking to him and came over to see what was happening. Hood stated the cop put

handcuffs on him (Hood) and arrested him. "

23". That on Sunday, October 18, 2009 detectives interviewed and obtained a sworn written statement from Leroy Moton DOB: 07/04/1988. Moton stated, among other things, that he met his cousins Johnny Hood and De'Quan Muhammad, and two other individuals who are friends of his cousin for a dance at the Student Union. He stated he only knows the nicknames of the two subjects as "Puda" and "Keem" and they are from Hartford, CT. Moton stated "Puda" was driving a brown/gold colored car. Moton stated while at the dance the fire alarm went off and all the people were told to leave the building.

24. Moton explained that as they were leaving the Student Union his cousin (Johnny Hood) got into an argument with a UCONN football player who was wearing a yellow shirt. That this argument happened in the grass area to the left of the Student Union. Moton stated the football player walked away and about 5-10 minutes later Moton heard that somebody was stabbed, but he didn't know the person who got stabbed or who had done the stabbing. Moton stated he didn't know what happened to "Puda" and "Keem".

25. On October 21, 2009 Detectives interviewed Leroy Moton again, this time in the presence of his attorney. During this interview Leroy Moton gave additional information in a sworn written statement to police regarding his knowledge of the incident. Moton stated, among other things that he personally knows "Puda" (John Lomax) and "Keem" (Hakim Muhammad) from when they attended middle school in Bloomfield, Connecticut where he grew up.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

26. Moton stated he didn't know exactly where Puda (Lomax), Keem (Hakim Muhammad) or De'Quan were but they were in the crowd. Someone then attempted to hit Johnny (Hood) and Johnny ducked down to avoid being hit in the face. The police then came over and told everyone to leave.

27. Moton stated that his friends appeared and that either De'Quan or "Puda" (Lomax) handed him a black or brown baseball hat and told him to hold it. This hat was later found by UCONN police in the front lobby and seized as found property. Moton stated that "Puda" (Lomax), "Keem" (Hakim) and Oe'Quan then left the area but he stayed with Johnny (Hood) because he had lost his gold caps in the grass and they stayed and searched for the caps. Moton stated him and Johnny then walked toward where "Puda's" (Lomax's) car was parked (field house parking lot). As Johnny was supposed to ride home with "Puda" and Moton had parked his car next to "Puda's".

28. Moton explained that Johnny was walking a couple of feet ahead of him when he saw someone down on the sidewalk in front of the Student Union. Moton stated he crossed the street and asked someone what was going on and was told that someone had been stabbed. Johnny had kept walking towards the parking lot. Johnny then came back and told him that "Puda's" car was gone and he didn't know where "Puda" and "Keem" were. A few minutes later De'Quan walked up and said "they're gone". One of the officers then told Johnny that someone had been stabbed and that he (Johnny) was a suspect. The officer told Johnny he had been seen in an altercation and he began to search Johnny and then subsequently arrested him and transported him to the UCONN police department for processing.

29. That Moton and De'Quan also went to the UCONN police station and provided written statements.

While at the police station, De'Quan told Moton there had been a stabbing and Moton told him that he knew. De'Quan also told Moton the hat he was holding was "Puda's" hat. That he and De'Quan both gave written statements to the police and were told Johnny was not going to be released because he had no identification.

30. That after leaving the UCONN PD at about 6:00am on Sunday 10/18/09 Moton started driving De'Quan home to Hartford. Moton stated he started talking to De'Quan in the car and told him that the whole thing was crazy. Moton told De'Quan; "We can't get Johnny out and we can't find "Puda" and "Keem". It would be crazy if one of them did it!" De'Quan then stated "Keem did it!"

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

Moton replied; 'What? That's news to me!" De'Quan said "Yeah, they followed them when they crossed the street." Moton explained that when De'Quan said "they" he meant "Puda" was with "Keem" and when he said "them" he meant the football players.

31. De'Quan continued, telling Moton that he saw "Keem" poke somebody with "beady dreads".

Moton explained that he knows "poke" means that he stabbed him. Moton stated that he told De'Quan that if he didn't know this, then Johnny didn't know what happened either because Johnny was looking for his teeth.

32. Moton and De'Quan continued talking, saying that they didn't know how to handle this. They still couldn't get Johnny out of jail because they didn't have his I.D. and they didn't have phone numbers for "Puda" or "Keem". Moton drove to De'Quans' house in Hartford and dropped him off and then he went home to his mothers' house in Hartford. When he got home he went on Facebook and learned that Jasper Howard had been-killed and "assumed" that Jasper Howard was the guy that De'Quan told him he had seen "Keem" stab and kill. Moton stated he was then called by his other cousin, Remecia Hood. She wanted to know what happened and Moton told her that he didn't know. Remecia then drove to his house and picked him up, they then drove together to De'Quan's house and picked him up in her car. They then drove to "Puda's" house in Bloomfield to try to get Johnny's I.D. so they could get him out of jail. That while they were driving, De'Quan said again that "Keem" poked him. He said that he saw him poke him a couple of times. When they got to "Puda's", the police were towing Puda's car so they couldn't get Johnny's I.D.

33. That on 10/18/09 at approximately 0436 hours, Officer Matthew Zadrowski interviewed and obtained a sworn written statement from De'Quan Muhammad. De'Quan Muhammad explained that he, Johnny and two other males known to him only as "Puda" and "Keem" met in Hartford before coming to UCONN for the dance at the Student Union.

34. That he (De'Quan Muhammad) was at Johnny's apartment when Puda and Keem picked them up and drove to UCONN. When they arrived at UCONN, they met with Johnny's cousin Leroy J. Moton.

35. That De'Quan stated the vehicle they came in was parked across the street from the Student Union. That everyone put their jackets, wallets and stuff in the cars. That they were inside the

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

dance until the fire alarm went off. That when the alarm went off, everyone walked outside of the Student Union. De'Quan went to the car to meet everyone and that no one was at the car, so he returned to the Student Union. De'Quan stated he returned to the Student Union and met Johnny. That while he was with Johnny, Johnny was yelling at some guys De'Quan was told were football players by Leory Moton.

36. De'Quan stated the police were telling people to leave the area so he went back to the car again.

When De'Quan got to the car, Puda and Keem were at the car. De'Quan stated he left the car and went to look for Johnny. De'Quan stated that Puda and Keem went with him to look for Johnny. De'Quan met with Moton who was with Johnny trying to find his gold teeth. The police then took Hood inside the Student Union and he (De'quan) and Leroy continued to look for Hood's gold teeth. De'Quan stated that he did not see what happened to Puda and Keem and after looking a while, "we" went back to the car and Puda and Keem, along with the vehicle were gone.

37. On October 18, 2009 De'Quan Muhammad was re-interviewed by Detectives. De'Quan provided additional information consisting of the following facts. That he observed Johnny Hood and a black male who he identifies as wearing a turquoise colored shirt as being involved in the altercation in the grassy area in front of the Student Union. (This black male wearing the turquoise shirt has been consistently identified throughout the investigation as Brian Parker). De'Quan further adds that Puda, Keem and Leroy were standing around Johnny so that no one jumped them. After the initial altercation De'Quan stated that he observed a black male lying on the sidewalk in front of the Student Union hunched over and an ambulance was at the Student Union helping him. That after Johnny got arrested De'Quan asked Leroy what happened and Leroy told him that he saw Puda get punched and that he (Leroy) never saw Johnny get punched. De'Quan admits again that he went to the UCONN police and was interviewed by police and gave his original statement. That he waited in the lobby of the UCONN police lobby until Leroy was done and Leroy gave him a ride home. De'Quan stated he got home at about 6:00am and could not sleep, so he called Leroy on his cell phone and asked him what was going on with Johnny. Leroy told De'Quan that the guy who was being helped by the ambulance had been stabbed and died.

38. That on Sunday, October 18, 2009 Detectives interviewed Michael D. Smith DOB: 08/22/1990, who stated in a sworn written statement that among other things, he was at the dance at the Student Union and also at the dance were some of his teammates; Brian Parker-'IB.P", Artesza

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

Portee-"AJ", Jasper Howard-"Jazz", Kalmetrius Wiley-"Me Me", and Kacheff Moore. He explained he was wearing a red, blue and white plaid long sleeved, button down shirt, blue jeans and red All Star sneakers. Jazz was wearing a black jacket, black, grey and white plaid long sleeved button down shirt and black pants. AJ. was wearing a burgundy shirt and matching jacket with blue jeans. Brian was wearing a baby blue short sleeved collared shirt and light blue jeans with some color on the back pockets.

39. During the party the fire alarm went off and everyone had to exit the building. Smith stated as he got outside, his teammate "Me Me" started yelling at him to "take Brian!" Smith stated Brian was agitated about something, saying "I can't believe he tried me!" He kept saying "He tried me!" meaning, someone had tried to push him to fight. Smith stated he walked with Brian away from the entrance but still in front of the building. When he turned around, he saw AJ. getting charged by two black guys. One was a dark skinned male with dreads, almost shoulder length and about 6'1" tall. He COUldn't remember what the other guy looked like. AJ. was in front of the Student Union on the grassy area and was backing away from the guys charging him. Brian was trying to get to A.J., but Smith stated he was holding Brian back because the cops were rushing in. AJ. moved back into the crowd and the guys stopped rushing him. Brian, Jazz and Smith kept walking south and crossed Hillside Road to the area of Gampel Pavilion.

40. Smith stated he then saw two black males alone on the sidewalk in front of the recreation center by the rope gate. After a few minutes, Brian calmed down and he began making his way back toward the Student Union. Smith stated he was behind Brian and Jazz was behind him when he turned and followed Brian to make sure he was alright. Smith stated he was across the street when he turned back to see where Jazz was.

41. Smith stated when he turned; he saw the two guys who had been standing on the sidewalk by the rope gate were now over by Jazz. Jazz was facing north, so Smith could only see his side. One guy was standing in front of Jazz, was a dark skinned black male, wearing a dark pull over hooded sweat shirt and a Cincinnati Reds baseball hat that was red on the top, black on the rim and had a white "C". The other dark skinned male was standing behind Jazz, he was wearing a gray long sleeve thermal shirt. The guy wearing the Cincinnati Red'S hat had his left hand in his pants.

Smith stated he yelled "Jazz!" Jazz turned around and faced the guy with the gray thermal shirt and took a swing at him with his right arm. Jazz moved back with his body and jumped into the

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

street. Smith stated he didn't think Jazz made contact with the guy in the thermal shirt. The guy in the Cincinnati Reds hat was about (5) five or (6) six feet away from Jazz when Jazz turned around and did not touch Jazz. Jazz ran across the street toward Smith saying "They got me!" Smith stated he thought Jazz was talking about his shoulder but Jazz told Smith "They stabbed me!" When Smith checked Jazz, he saw blood on the lower part of his stomach. Smith stated he walked with Jazz back towards the Student Union until Jazz fell on the sidewalk. Smith stated he lifted Jazz's shirt and saw the cut and blood.

42. That in a sworn written statement, Artesza Portee "A.J." stated among other things, that he went to the dance at the Student Union with Jasper Howard and Brian Parker and during the dance the fire alarm was pulled. He recalled that as they were exiting the building, Brian Parker was arguing with one of five (5) black males that were in a group. One of the guys Parker was arguing with was about 6'4" tall, 2001bs, short dread locks and a gold grill on his bottom teeth. Portee explained that he attempted to stop the fight between Brian Parker and the guy with the gold teeth by telling everyone' to "chili". One of the other black males was about 6'2" to 6'3", skinny wearing a black hoodie. Portee stated he did notice a set of gold grill teeth on the ground by the sidewalk on the grass by the front main entrance.to the Student Union. Portee stated the police broke up the fight and he saw "Jazz" standing by the Husky Dog on Hillside Road. Shortly after Jazz ran by him saying "they got me".

43. That on Sunday, October 18, 2009 detectives interviewed Brain Parker who provided a sworn written statement regarding this incident. He stated, among other things that as he was exiting the ballroom he became involved in a verbal altercation with a black male who was wearing a grey long sleeved thermal shirt, braided hair and had a small space between his front teeth (later identified as Johnny Hood). Also with Hood was another black male who was wearing a long sleeved red and black plaid shirt and short hair. Parker identified this male as De'Quan Muhammad. Parker stated his friends Kelmetrius Wylie aka "Me Me", Jasper Howard "Jazz" and Mike Smith were with him at the time and told him to "let it go" that they couldn't get into trouble.

44. Parker stated that as he and his three friends left the building, the males identified as Hood and De'Quan followed them outside and the groups eventually met in the grassy area just south of the exit. Parker stated he and his friends were standing face to face with Oe'Quan, Hood and another black male with a big head wearing a short sleeved shirt. When shown a photo array containing

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

Lomax, Parker identified this male as being John Lomax aka "Puda". Parker stated he was standing next to "Me Me" and "Me Me" was standing next to "AJ." (Artesza Portee). He explained that De'Quan was standing across from him, Hood was standing across from "Me Me" and Lomax was standing across from AJ. De'Quan was saying "I'm gonna fuck all of you up!" and he kept putting his hands in his pants as if he had something in his pants or was reaching for something. De'Quan then rushed at him and he thought De'Quan had a gun. Parker stated he backed up, and ran away. When he stopped, De'Quan was about 15 feet away from him,looking toward the grassy area. Parker stated that he saw AJ. still on the grass and the male identified as John Lomax was standing next to him along with the other black males.

45. Parker stated that he, Jazz and Mike walked away, in the direction of Gampel Pavilion. As they were walking away the guy in the red shirt, the big head dude and some other black dudes followed them, going in the same direction they were walking. That the guy in the red shirt stood across from Jazz and the big head dude was across from Mike Smith. That Parker observed the police walking towards them so he walked back towards the Student Union.

46. Parker stated that at this point, Mike Smith was in front of him and he met up with two females who told him that he is bleeding. Parker was shown pictures obtained in this investigation and he identified the guy in the red plaid as De'Quan Muhammad, the same guy that had his hands in his pants and rushed him. He was shown a picture of Johnny Hood and identified him as the black male that he was arguing with when walking out of the Student Union. Parker identified John Lomax (Puda) as the same person arguing with Portee. Parker indicated that this is the same black male standing near the Husky Dog when Jazz (Howard) was stabbed.

47. That on October 18,2009 detectives interviewed John Lomax DOB: 09/07/1988 who stated in a sworn written statement, among other things, that he drove the following people to the Student Union at UCONN for a dance in his silver 1998 Nissan Maxima; Hakim Muhammad, John Hood and De'Quan Muhammad. He explained that he and Hakim had been to a dance at the Student Union at UCONN on Friday the week before. That during the dance, the fire alarm went off and everyone had to leave the building. Lomax stated when he got outside he didn't see any of his friends; he immediately went to his car to get his coat. When he returned to the Student Union area he continued to look for his friends so they could leave.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

48. Lomax stated he noticed the crowd was moving to the right (if you're looking at the Student Union) and people were looking in that direction like something was going on over there. Lomax saw his friends over there, and it looked like there were 3 or 4 guys who looked like football players facing them. Lomax stated he thought that these guys were football players because he used to play football and "they looked like the type". There was a guy wearing a blue shirt (identified by other witnesses as Brian Parker) who was facing off with Johnny (Hood). Lomax ran over to his friends and as he approached the group he heard someone say something like "these hands work", as if to say "come on, let's fight" and other people were yelling "let's go!" Lomax stated when the guy in the blue shirt swung at Johnny, he grabbed Johnny and tried to pull him away but as he did this, he (Lomax) got hit from behind in the back of the head. He explained the punch just grazed the side of his head over his ear. At this time the cops were coming and were threatening to spray everyone with mace so he turned and ran back to the car and assumed Johnny and the others were behind him. When he got to the car however, Hakim was the only one with him. He stated he- and Hakim waited for 15 to 20 minutes but Johnny and De'Quan- never returned to the car..

49.John Lomax further stated that while they waited, Hakim called Johnny or De'Quan on a cell phone twice to ask what was going on. Lomax stated he heard Hakim say "why is he looking for his grill?" "The cops want everyone out!" When Hakim made a third call to Johnny's cell phone it went unanswered so they decided to leave. Lomax stated that when he was involved in the fight he lost his brown Yankees Hat. Hakim then told Lomax that he had picked up the hat and handed to Leroy Moton.

50. That on October 18, 2009 detectives interviewed and obtained a sworn written statement from Hakim Muhammad DOB: 11/18/1988. Hakim Muhammad stated, among other things that he went to the dance at the Student Union with Johnny Hood, "Day Day" (De'Quan Muhammad) and John (John Lomaxlaka:Puda). That they drove to UCONN from Bloomfield in Lomax's grey Nissan Maxima. That John (Lomax) was driving, Hakim was in the front passengers seat, "Day Day (De'Quan) was in the back seat behind the driver and Johnny was in the back passengers' seat. Hakim stated that John (Lomax) was the only one with keys to the car as far as he knew. He described what they were all wearing as follows: Hakim was wearing a black hooded sweatshirt, a white V-neck T-shirt, blue jeans and brown Timberland boots, Johnny Hood was wearing a black leather jacket and he had dreads just past his ears, De'Quan was wearing a black coat and a

black baseball hat, John Lomax was wearing a brown fleece jacket and a brown New York Yankees baseball hat.

51. That during the dance, the fire alarm went off and everyone had to exit the building. As Hakim was leaving the dance hall, Johnny Hood was behind him when some guy was being disrespectful to a girl that was walking next to him (Hakim). Hakim described this guy as being a black male 6'1" tall wearing a short sleeved blue collared shirt.(ldentified throughout this investigation by other witnesses as Brian D. Parker). Johnny was telling the guy "that's a girl, be respectful to her." The guy then started directing his disrespect to Johnny and the two of them got into it a little bit.

52. That when they got outside of the building, he (Hakim) and Johnny were in the grass area in front of the building when the male identified as Parker started saying something. A couple of this male's (Parker's) friends tried to hold him back but he ended up walking up to Johnny. Hakim stated that he was focused on the other guys that were talking to Johnny; they were acting like they wanted to fight and he saw one of the guys throw a punch at Johnny. "Day Day" (De'Quan) was also there trying to get Johnny away. John Lomax suddenly showed up and one of the guys from the group threw a punch at John Lomax. The cops rushed in with the mace and "Day Day" grabbed Johnny and Hakim grabbed John Lomax and they pulled them away.

53. They walked to the end of the grass area in front of the Student Union and Johnny said that he had to go back to get his grill (teeth) and his jacket from inside. Hakim stated the police were all over and he wasn't going to tell Johnny he couldn't get his grill and his jacket. Hakim stated Johnny walked back and he and John Lomax walked to the car. As they walked back to the car they saw ambulances going to the Student Union. I asked someone I recognized from school what the ambulances were doing and they told me that someone had gotten stabbed. Hakim stated this was the first time that he knew someone had been stabbed. Hakim stated he did not know the person who told him this. Hakim stated he didn't know where "Day Day" (De'Quan) had gone but he assumed he stayed with Johnny. Hakim stated when he and John Lomax got back to the car Hakim called Johnny on his cell phone. Johnny told him he was being questioned by the police and they wouldn't let him go. Hakim explained "Day Day" didn't have a cell phone so he didn't know what happened to him. He stated that he thought that Johnny was staying with Leroy so Hakim and John Lomax drove home to Bloomfield. Hakim stated that he sat in the front passengers' seat and John Lomax drove.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

54.0n October 19, 2009 at 2145 hours this affiant and Detective David Lamoureux located and interviewed Chaise Pressey. Pressey had been contacted and agreed to be interviewed at his mother's hair salon in Windsor, CT.

55. Pressey related he was at the Student Union dance on October 17, 2009. That while he was there the fire alarm went off and everyone went outside. He related that he saw four black males having an argument outside the Student Union. The police broke up this fight and he saw another fight north of the Student Union. Pressey observed a black male he knows as Hakim Muhammad running from the area of the second fight. Pressey described Hakim as crouching over as he ran and putting something in his right pocket. That Hakim kept his hand in his pocket and "looked suspicious" as he ran away. Pressey explained that he knew a guy was stabbed and when he saw Hakim Muhammad running from the area crouched over he "put two and two together". Pressey said he believes that Hakim stabbed someone. Pressey Was shown a photograph' lineup consisting of eight similar photographs, one of which was Hakim Muhammad. Pressey identified the black male in photograph #3 as that of Hakim Muhammad. This affiant makes note that photograph #3 is Hakim Muhammad. This affiant and Detective Lamoureux began to take asigned, sworn statement from Chaise Pressey when Presseys' mother ended the interview and said that she wanted Chaise to talk to his attorney prior to continuing the statement.

56.·0n October 19,2009 at 1843 hours detectives interviewed and obtained a signed, sworn statement from Taylor Carter 008: 07/26/1990. Carter stated, among other things, that she went to the Student Union for a party on Saturday night, 10/17/09. She was standing just outside the door of the Student Union after the fire alarm went off with her friend Erin Franklin. Carter stated while she was standing with Franklin she saw a boy she knows as Hakim Muhammad, walking from the front of the Student Union and heading towards the parking garage near the field house. Det. Hoyt showed Carter a picture of Hakim Muhammad and she recognized the person in this photograph as Hakim Muhammad. Carter stated she knows Hakim from when she (Carter) used to work with his sister at the Dunkin Donuts in Windsor, CT. Hakim used to come in the store.

57. Carter stated that Hakim was pounding his fists and saying something like "people want to mess with me" and "I'll show them." When Carter heard Hakim saying these things and saw how mad he was, she was scared for her safety. She was about 5 feet away from Hakim when she saw

him and heard him saying these things. Carter explained that Hakim's sister had told her in the past that when Hakim gets angry he likes to fight and that he was crazy. Carter watched Hakim walk across the street, away from the front of the Student Union toward the Field House Parking Lot.

58. That a few minutes later Carter saw Hakim walking back towards the crowd which was still in front of the Student Union. Hakim was holding something under his shirt but she couldn't see what it was. Hakeem didn't say anything, but he looked really mad and determined. She couldn't recall what he was wearing; only that he was wearing a fitted hat.

59. Carter stated once she saw Hakim coming back from the parking lot with something under his shirt, she told her friend Erin they had to get out of there. Carter stated she was afraid something bad was going to happen, or someone was going to get shot and she just wanted to get out of there. Carter stated she actually started to run' away from the front of the building but Erin just stood there. Carter turned around, grabbed her friend and they walked away. She then started hearing people saying things like "they're going to fight" or "they're fighting". She then saw people standing on the wall by the front of the entrance to the Student Union.

60.0n October 18, 2009 detectives obtained a signed, sworn statementfrom Aaron C. Brown, DOB: 6/17/88. Brown stated among other things, that he and his girlfriend were walking on Hillside Road near the Field house parking lot on their way to his dorm room and to the Student Union to get some food at about 12:30-1 :OOam on 10/18/09. Brown saw two dark skin black males crossing the street from the area of the Student Union. The two black males were walking together, one in front of the other. The male in front seemed agitated; he was saying something like "They can't do me like that!" Brown saw lights on a car blink, like it was unlocked by a remote. The two males walked over to this car. It was a smaller shiny silver colored car parked with its' front facing the Student Union. The car was parked in the Field house parking lot. One male got into the drivers' seat and closed the door, the other male, the agitated one, bent down and opened the passengers' side door and stood up quickly: He then closed the passengers' side door and began walking back toward the Student Union. The other male also -got out of the car and followed. As Brown and his girlfriend continued toward the Student Union, he began to hear people say that someone had been stabbed. Brown estimates this was 5 to 10 minutes after he saw the two black males, leaving the car, heading toward the Student Union.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

61. Brown explained he lost sight of the two black males once they crossed the street. He described the driver as being taller than himself and the passenger was about his height. At this time Brown saw a fire truck and a small SUV were pulling away from the area without their emergency lights on and he thought someone had pulled the fire alarm.

62.0n 10-18-09 a 1998 Nissan Maxima was seized as evidence in this investigation. The vehicle was registered to John Lomax of 28 Barry Circle, Bloomfield, Connecticut. Also seized was an electronic key FOB for remotely unlocking the vehicle.

63. That during this investigation, Devra Brown DOB: 09/25/1990 was interviewed by detectives.

Brown stated in a sworn written statement, among other things that she had been at the dance at the Student Union on October 17/18, 2009. While at the dance, she talked with a guy that she knew as "John", that she recognized him from coming into the McDonalds where she works in Windsor. She described "John" as a light skinned black male about 5'6" to 5'7" tall with nice white teeth, one or two diamond earrings in his left ear, minimal facial hair and a low faded haircut. He was wearing a cream colored hoodie sweatshirt with designs all over it. When showed a photo array, Brown identified "John" as John Lomax DOB: 09/07/1988 from 28 Barry Circle in Bloomfield, CT as the boy that had been wearing the cream colored hoodie who she talked to at the dance.

64. That Brown described seeing a fight in the area of the Husky Dog after the building was evacuated for the fire alarm. This was not the only fight that Brown was aware of that night, but the only fight that she saw. Brown stated there was another fight about two minutes before the one she saw. That first fight occurred over in the grassy area outside of the Student Union. Brown stated she could not see this fight because there were too many people around it.

65. That Brown saw about 7 to 8 people right in front of the Husky Dog statue and they were fighting.

She recognized one of these people as "Jazz" (Jasper Howard). "Jazz" was swinging his fists at a boy wearing a cream or grey colored hoodie with the hood pulled up over his head. She explained that the hoodie at this time looked more grey than cream and that the light was different outside than it was when she talked to Lomax inside at the dance. Brown stated she was really sure this boy was John Lomax who she had seen inside the dance earlier in the night because although the

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

hoodie looked more grey than cream, it had the same designs on it. The boy fighting Jasper also had the same height and build as Lomax. Brown stated she couldn't see the boy's face because he had the hood pulled up.

66. Brown stated she saw John Lomax swing his left hand at Jazz. That it looked like he slashed or stabbed Jazz on his left side of his stomach. She didn't see a weapon but she could tell Jazz got slashed. Jazz then started running fast in her direction, holding the left side of his stomach. As Jazz ran past her she heard Jazz saying "They got me! They got me!" Brown stated she was standing directly across the street and was with Artesza Portee.(A.J.)

67. Brown stated she lost sight of Jazz and Lomax, that it was very chaotic with people fighting all over. Brown then left the area with her friend A.J. Portee and walked him back to his dorm.

68. That in a written sworn statement Shaunese Wilson, DOB: 08/11/1989, stated, among other things, that she is a student at UCONN and knows some of the UCONN football players. She attended the aforementioned dance at the Student Union with her friends Devra Brown and Chaz Copes. While at that dance she talked with John Lomax who she has known for approximately 14 years. She explained that this past August she and John began seeing each other more and talking on the phone, the last time she spoke to him was at the beginning of October 2009.

Wilson stated John (Lomax) lives on Barry Circle in Bloomfield, CT and owns and drives a gold colored Nissan Maxima with black tinted windows.

69. When the fire alarm was pulled, Wilson exited the student Union and saw the argument between Brian Parker and a group of boys she didn't recognize. As she exited the building she saw a fight about to happen on the grass but she couldn't see who was involved because of the crowd. After the police broke up this fight she, Devra and Chaz walked to the left (South) of the Student Union, when they got to the edge of the building they saw AJ. Portee and they (Shaunese and Chaz) told Devra to get AJ to calm Parker down because he was upset and mad. She saw one group of boys that included some football players who she identified as Brian (Parker), Jazz (Howard) and AJ,(Portee) walk toward the street towards them. The other group of boys went in the other direction. She stated she didn't pay attention to the other group of boys because she and her friends walked toward the group of football players, who were across the street from the Student Union. As her group crossed the street, she heard someone say something like "They're coming"

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

meaning "Get ready." She turned around and saw several people coming towards the group with the football players. She, Devra and Chaz then walked away from the football players, back into the street as the other group of boys approached the football players. That there were maybe 6 people in this other group and they were approaching Brian, Jazz and A.J, among others.

70. Wilson stated she was about 15 feet away (directly across the street) when she saw John Lomax among the group that was approaching Brian, Jazz and A.J. That it looked like Lomax was wearing a brown colored zip up jacket with a hood. Wilson explained that when she had talked to Lomax inside the Student Union, he was wearing a white long sleeved pull-over shirt with navy blue writing on it and a navy blue emblem on the front and dark navy blue jeans. When she saw Lomax approaching Brian, Jazz and A.J at this time, he was wearing this other jacket but the jacket was barely zipped and she could still see Johns' white T-shirt underneath. She said the hood was not covering his head and has no doubt it was John Lomax. Lomax was walking fast, almost running with the rest of the group with their hands in the front of their pants, definitely not in their pockets. She also saw a person that had been with Lomax at the dance, a black male 6'3" tall muscular build, mini dread locks wearing a red hoodie zip up sweat shirt with a black or navy blue shirt underneath. This male was closest to Lomax and he also had his hand in his pants. By this time, Brian, Jazz and A.J. had turned around and were facing Lomax. Lomax was squared off directly in front of Jazz. At some point Brian's' back was turned to the guy in red. A.J had

grabbed Brian and that is how Brian turned his back.

71. Wilson stated she then saw Lomax remove his hands from his pants very quickly and made one quick motion towards Jazz's stomach area, as if Lomax had stabbed Jazz in the stomach. When Lomax pulled his hand away from Jazz, she saw an object in Lomax's hand which was about the size of a pen. When Lomax did this to Jazz, Jazz let out a scream and immediately put his hands over his stomach area and appeared to be holding his hands on the left side of his stomach. Wilson stated that Jazz appeared to be injured. Jazz then ran across the street past her and her group saying "They got me cus!"

72. Lomax then turned around, put his hood up over his head and ran off with the boys he was with.

They ran off in the direction of the dorms. Jazz had run off towards the Student Union and Brian was sitting down on the grass where the police met him.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

73. Wilson stated, she also saw the boy with the red hoodie with an object in his hand when Brian had his back turned towards him. She didn't see this guy make any motion towards Brian and she believes this object was a knife. This object was about the same size as the object that Lomax had in his hand.

74. That on October 22,2009 detectives interviewed Chaz Copes DOB: 08/16/91 and obtained a signed, sworn statement. That in a written statement Chaz Copes stated among other things, that she was at the Student Union on October 17, 2009 with her friends Devra Brown and Shaunese Wilson. That while at the dance, the fire alarm sounded and everyone exited the building. That she was with Devra and Shaunese as they walked across Hillside Road and she saw some black males arguing. It seemed like they were about to get into a fight. The police arrived and broke the argument up. Some boys she was introduced to at the dance named "BP" and "AJ" were in this argument. Throughout the investigation it was determined through witness identification that "BP" is Brian Parker and "AJ" is Artesza Portee. Copes stated they (Brown, Shaunese and now AJ) walked south on Hillside Road. AJ was mad about arguing with the boys she saw him arguing with. Copes recalled seeing a black male named "John" that Shaunese knew and called "John".

75. Copes stated she observed Parker and "Jazz" (Japser Howard) across the street. There was a lot of commotion were Parker and "Jazz" where and she watching this. "Jazz" and Parker were walking south on Hillside in the same direction as Copes, Brown and Portee. Copes saw two - three black males walking 1 running up behind "Jazz" and Parker. As these males got closer behind "Jazz", he ("Jazz") turned around and was looking directly at them. These other boys were in a group and one of the black males "stepped out towards "Jazz" and this black male and "Jazz" were square off with each other. Copes stated that this black male thrust his right hand with a fast motion towards "Jazz". She knew this guy wasn't punching "Jazz" by the way he thrust his hand out towards "Jazz". Copes stated it looked to her like this boy was stabbing "Jazz" in his stomach area. Copes stated she saw the black male pull his hand back and "Jazz" placed his hand over his stomach area and held it. That just as "Jazz" was going to be struck, he jumped back in an attempt to avoid being struck.

76. Copes stated "Jazz" came over across the street towards were she was; saying "They got me".

Copes turned her attention back across the street and saw Parker on her side of the street and Parker said something like "They stabbed me". Copes stated she saw blood stains on the back of

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

Parkers' shirt. The black male who stabbed "Jazz" was wearing a hoodie sweatshirt, medium - dark in color. Copes was shown a photograph lineup consisting of eight similar looking males. Copes identified picture #5 as the male that she believes could have stabbed "Jazz". This affiant notes that picture #5 in this photograph lineup is that of John W. Lomax, aka: "Puda".

77. That on October 22,2009 detectives interviewed Whitney Dukes DOB: 12/25/91and obtained a signed, sworn written statement. That in a written statement Whitney Dukes stated among other things, that she was also at the Student Union for a dance on October 17, 2009. That she got to the dance at 10:40pm. She stated that at about 12:10am on October 18, 2009, someone pulled the fire alarm and everyone went outside. She didn't see anyone fighting. But she saw someone walking briskly away from ,the crowd. She identified this person as a person she knows as "Puda" Dukes identified "Puda" through a photo array as John W. Lomax "I, and as the person she saw walking briskly away from the crowd. Dukes was shown a map of the area by detectives and Dukes indicated that "Puda" was walking in a northerly direction. Dukes knew it was "Puda" because she used to live next to him on Barry Circle in Bloomfield. Dukesfurther stated "Puda" was walking with two or three other guys. Dukes stated that no more then 2-3 minutes later she saw "Puda" walking back and it looked like he had something in his left hand that he was trying to conceal. Someone in the crowd with "Puda" said something like "Somebody is going to get shot". Dukes stated "Puda" and the 2-3 boys were walking back towards the crowd.

78. Dukes stated about 15-20 seconds after "Puda" and the boys he was with walked by her, she heard people saying that someone got stabbed. That several seconds later the crowd dispersed and she saw a black male lying on the sidewalk and she knew right away that this was the person that got stabbed because she saw blood on his lower left side. Dukes stated that at this time she saw "Puda" on the other side of the street with the same boys, but this time they were walking briskly in a northerly direction (away from the student union towards the Field house parking lot)

79. Detective Burns showed Dukes a photograph line up consisting of eight similar looking black males. Dukes identified photograph #6 as "Puda". This affiant makes note that photograph #6 in this lineup is that of John W. Lomax "I.

80. That you affiant believes there is probabJe cause to arrest John W. Lomax "I, for crimes committed against the Connecticut General Statutes.
