COMPLICATED; A TO Z OF WOMENS MODERN FIQH

INTRODUCTION:
a) He was praying and the area around and some of the ka3bah was on fire. The city of makkah
was surrounded and most of his followers had fled or joined the other side (the ummayads lead
by someone). This was Abdullah ibn zubayr. He was asma bint abi bark his mother and told her
most of his followers were killed, captured or went to the other side and I dont think we can
fight more today. She replied I remind you of Allah swts right upon you if you know you are
upon the truth the dont give up otherwise you accomplished nothing. Ppl were killed for
nothing. He said you know what will happen to me today? She said son what are you worried
about? The worse thing is the best thing. I would rather they strike you and you die with dignity
then you are stricken without it. he said he never led them for a worldly gain. Or abused them,
etc. he said just for you to know what kind of man your son was. She said im expected good
from Allah if you die you will be ahead of me in janna. She prayed for him due to his long nights
praying and crying and fasting to please Allah swt and was very good to his mother. Oh Allah swt
im please with you what you have decread. He said dont stop praying for me and she said she
never did and will. She was blind and she found he was wearing armor.he left and she received
his body. He was crucified for 3 days and they told her that dont worry about his body but his
soul is in the presence of Allah. IN THIS GREAT TIME of need he sought consultation from his
mother who was an important person in society.
b) Theres an aya in the quran that talks about Allah giving us examples and they are of 2 women.
c) Ummu sulaym said to SAW that she couldnt give anything to him cause she didnt have
anything so she gave her son Anas ibn maalik who because a great muhaddith
d) Muath ibn ibi sufyaan-his mom was told he looked smart and too watch out for him cause he
would rule the Arabs one day but she said no he will rule the world. she had vision for him to
rule the world and he became a great leader.
e) In the battle of uhud it was so tense the men ran and who was defending him? SAW said he
didnt look to a side without seeing her and her son protecting him with her own body-her open
chest and arm. She said to a horsemen who were attacking him and she got in the way and was
hit by a sword and bled for a yr. she stuck the horse of a horseman and killed the man.
f) Your value will be recognized in hard times. In the battle of hunayn few ppl left and one was a
woman who gave bay3ah/pledge. Ummu 3imarah gave such and was the protecting SAW. At the
time of abu bakr she made a pledge that she would kill musaylimahal kithaab cause he took her
son and was in the battle after SAWs death with hijab. She managed to bring victory and striked
him and lost her hand but didnt kill him.
g) A women named khansaa was a famous poet who lost her brother and grieved and cried and did
crazy stuff all the time. She later excepted Islam and in the battle of qadisiyyah sent all 4 of her
sons and told them Islam was their choice and you migrated by your choice and I didnt make
you fight here and the aakhirah is better then the dunya so be patient and have taqwa, and if
you see the armies boiling the you should push to the center and they all died and became
shuhadaa and she said Alhamdulillah that he honored me to be the mother of 4 shahids and im
hoping Allah will gather me with them in paradise.
h) The most famous imams have stories about their moms roles in their lives.
a. Imams ahmeds mom told him I was you to go study under imam malik and study his
manners before his knowledge
b. Sufyaan aththawrees mom said learn 10 things from a Shaykh and if you .sorry missed
the point
c. Wakee3 ibn.s mom would come in his house and she would touch areas in his house
where he would pray to see if they were harm or wet to see if he was praying qiyaam
and if it wasnt she advised him
d. Aisha r. was fasting and the morning she had 100,000 dirham and gave it all away and
didnt have enough for iftar
e. Hassan albasri: there was a young girls whose moms name was muneeba and he was
amazed by the girl who he was told she was dying and he went to her house and when
she saw him she cried and he said why ru crying and she said why am I crying? Oh abu
sa3eed im so young I did not yet enjoy my youth in the act of worship
f. SAW when adbullah ibn abe 3aas said you dont have finish the uqran everyday and fast
everyday and he told him let me enjoy my youth while I have so much energy.
CHAPTER ONE
RULINGS RELATED TO NEWBORNS AND CHILDREN
a) VIRTUES OF HAVING DAUGHTERS:
a. To Allah belgons the dominion of the heavens and the earth, he creates what ge wills.
He give to whom he will female (children), and he gives to whom he wills males---42;49
Allah swt started with females before males cause the virtues is higher. Societies look
down on women so they are mentioned first
b. Aisha reported SAW said whoever was given any female children and took good care of
them, they will be a shield for him from hellfire -BUKHARI AND Muslim. Its not only
about having girsl but you have to take good care of them.
c. Jabir had a more specific narration: SAW said whoever has 3 girls, takes good care of
them and is merciful with them he deserves nothing less than jannah. They asked asked
og messenger of Allah what if they are two? He replied even if they are two. Some
narrators assed that if the prophet has been asked about one, he wouls have affirmed
that-alhakims mustadrak.
d. In another narration (if one has) three or two daughters or sisters, then he is conscious
of Allah in his care for them and treats them well, but that he will endter jannah at-
tirmidhi
e. SAW was reported to have said whoever takes care of two young girls until they reach
maturity, will come on the day of resurrection with me, like this, and he joined his
fingers together.-Muslim
f. SAW was reported to have said whoever has a female child and he does not kill her,
disrespect her and does not favor his son over her, then Allah will enter him into
jannah abu dawud
g. Whenever imam ahmads son used to give him news of getting a baby girl he would say
the prophets were fathers of girls
h. Surah 16:58-59 And when one of them is informed of (the birth of) a female, his face
becomes dark, and he suppresses grief. He hides himself from the people b/c of the eill
of which he has been informed. Should he keep it in humiliation or burry it in the ground
unquestionably, evil is what they decide
i. The disbelievers werent happen when they heard they had a daughter. In the
quran it refers to a person face going dark from shame.
i. How can you tell if you are a good parent? Doesnt depend on their actions. What
defines a good parent is what you have control over. You will be successful if you did
your role and taught them, etc.
b) NAMING THE CHILD
a. There is narration indicating the superiority of any particular female name like there is
for male names such as Abdullah and Abdurrahman. But SAW named his daughters and
picked names for others.
b. SAW changed the names of some girls. He changed 3asiyah-disobedient to jamilah-
beautiful. He changed barrah-righteous to juwayriyyah and zaynab in another instance.
Barra- was a high status name of iman and he said dont praise yourself so he changed it
to juwayriyya-the petit one and the same name was also changed by him to zaineb.
c. The governing rule in the area of naming are:
i. All named are permissible unless theres evidence to change like barra.
ii. Also the meaning of the name must be acceptable religiously (cant say slave of
someone else but Allah swt), or linguistically (linguistically bad like siner.
Sometimes its Arabic and sounds bad in English like crazy-rosie cheeks in Arabic
but not good in english), or culturally (its not recommended if you chose a
name thats hard for ppl to say especially your family)
iii. Its disliked to give names of self-praising as mentioned above.
1. Its disliked to give a name that is praising like saleh, huda, ihsan or iman.
He said he would think twice cause they are close to barra. SAW clearly
changed those names with the reason of them being self praising.
d. When is it necessary to name your child? You can name her before shes born- SAW said
I was given today a boy and his name is Ibrahim, some scholars say you give the name in
the 7
th
day cause SAW said in the 7
th
day you should give the sacrifice, and shave the
head of the boy and name the day (super paraphrased). The correct understanding is it
must be given BY the 7
th
. Which is the opinion of the vast majority of scholars.
e. Can a convert keep their name? yes if it has a good meaning.
f. Changing your name is permissible and keeping it as well. Only the first name though.
g. You cannot change your last name
h. Can a name be changed later in life? Yes you can especially if it gives you problems.
i. Can I give a middle name? yes
j. Are Arabic names recommended? No. What about names taken from the quran? If you
open a page and randomly pick a word thats not cool its like bid3ah.
k. Some respectful shu3ookh say you cant name your kids after angels but he says there
no proof whatsoever for that claim.
c) THE 3AQEEQAH
a. SAW was reported to have said whoever wishes to perform a sacrifice on the occasion
of a newborn, then he should sacrifice two sheep for his son and one for his
daughter.al-nasai
i. Why is there a difference? Shaykh waleed said he has still not found a rationale
that hes comfortable with so Allah a3lam
ii. The Whoever wishes wording makes it not an obligation
iii.
b. Can you sacrifice a cow? Only sheep and goats cause thats the sunnah. Cant substitute
for money.
i. Do I have to share with the poor? The Hanabila said it is obligatory to give a
piece of it even a pound to the poor. If you dont you have to make it up.
c. The 3aqeeqah is a highly recommended sunnah. Recommended acts are of levels just
like sin are on different levels (shirk vs. lying). If you look at the levels the 3aqeeqah will
be one of the top levels just like witr which is closed to being wajib.
d. SAW was reported to have said a newborn is connected to his or her 3aqeeqah. What
does that mean?
i. Strongest opinion: His intersession for his parents depends on the 3aqeeqah. So
they wont interceded on their parents behalf if they didnt have onedouble
check this cause I feel like I missed something
ii. Theyll be nice to them if they did the 3aqeeqah
iii. Their righteousness depends on this form of shukr to Allah
iv. Some scholars said on the DOJ this will raise their level and make it easy for
them on the DOJ
v. Your gratitude will show through the 3aqeeqah-meaning the parent shows their
shukr. This is the opinion the Shaykh takes
e. Are there recommended days for performing it?
i. According to a hadith it should be on the 7
th
or the 14
th
or the 21
st
(day of the
childs life not date of the month) we dont count the day the baby was born the
first day will be the day after it was born. If the baby was born in the night start
the next morning. If you cant do it those days you can do another day. The
point is when you sacrifice the animal not when you eat or cook it so you can
slaughter in on one of the days above and have the gathering on a weekend
following.
f. My child is old can I still do it now? Yes you can.
g. Should I perform one on myself? Yes you can according to some but others say no cause
i. The hadith says it will be sacrificed on the babys behalf-tu3aqu 3anh.
ii. And cause its a form of gratitude from the parent so it wouldnt make sense to
do it yourself.
iii. He sees a combined approach-you can make one on behalf of your parents and
he believes it will be a middle position.
h. Whose recommended to do it? the dad cause he has the expenses but yes the mom can
too.
d) SHAVING THE HAIR OF THE FEMALE:
a. It is not permissible to shave the head of a female child because shaving is of the specific
characteristics for males. SAW said that the female who shaves her head is cursed---
albukhari
b. It is not permissible according to the opinion..sorry missed whose opinion this was.
Unless theres a medical reason
c. The hadith that says every boy will be connected to his 3aqeeqa, named on the 7
th
and
the head will be shaved
i. So why to do we say that the other conditions apply to girls but not shaving?
Cause it doesnt have any other ahadith to allow it and the other conditions do.
d. There is a weak hadith to support it. Shaykh albani says it is permissible.
e. Can I shave my girls hair to make it thiker? No cause SAW prohibited it and it will be
imitating the men. Will the baby be cursed? No the baby will not be cause she had no
part in it that will go back to the one doing it for her.
f.
e) THE URINE OF THE FEMALE INFANT
a. Umm karz narrated that a male infant was brought to the prophet SAW and he urinated
on him. He had water sprayed on It. a female infant was brought to him and urinated on
him. He had it washed---ahmad,
i. Did he wash it cause it was double urine by that time? No casue theres more
proof in the following hadith
b. SAW said the urine of the male child is to be sprayed, and urine of the female is to be
washed-abu dawud and tirmidhi
c. This ruling is related to infant who are still nursing and have not begun to eat solid food.
By consensus if they both begin solid food it is the same and should be washed.
d. All believe urine is najas but there are different levels. Theres a difference of opinion on
this:
i. Shafi3i: both should be sprayed. Why did they not take into account the other
hadith? Maybe they didnt hear of the other hadith. They looked at it as a low
level of impurity so just sprayed
ii. Hanafi and some malikis and a lot from ahlul bayt: both must be washed. Maybe
they didnt hear of the other hadith? They dont have levels of impurity so they
say its impure and it should be washed period.
iii. Hanabila: say why is there a difference in the genders? Cause the female would
spray a larger area of your cloths then a boy but Allahu a3lam
e. Questions:
i. My daughters urine dried on the bed do I still have to wash it?
1. Some say if its dry w/o a stain or smell it is okay and others say wash it
ii. Yes you can use chemicals to get it out
iii. Yes you can wash it in the machine to purify it
iv. Can you wash cloth diapers with cleaner clothesnajasa with clean. Yes you
can.
v. Does touching daughters urine or feces break my wudu? No it doesnt but you
must clean your hand before you pray.
vi. Does touching babies private part (vagina and anus specifically) break wudu?
Islam ibn taymiya has strongest opinion which says no based on
1. Hanafi and ibn taymiyya: only breaks out of lust. SAW was asked about
someone taking a shower and touching his private parts loosing wudu
and SAW said no its like touching your nose, chest, hair. Some say its a
weak hadith but the shaykh said its not weak but it isnt the strongest.
If it were true, this would make things really hard on the mother having
to make wudu all the time. The shari3a wants things to be easy.
2. Some say it does right away maliki, shafi3i, hambali say cause of the
hadith about touching private parts.didnt hear the hadith
vii. Is vomit or spit up impure? Spit up by consensus is pure.
1. The 4 schools say yes vomit is impure is people---unsure what I was
trying to get at here.
2. But malik said if it came back up the same way its not but if it came up
a different color then it is impure. Wash it off your clothes
viii. Can I perform salah in clothing stained by breast milk? Yes casue its pure.
f) CIRCUMCISION
a. Abu hurayrah says I heard the messenger of Allah SAW say al-fitrah is in five:
circumcision, shaving the pubic hair, trimming the moustache, trimming the nails, and
plucking the underarm hair Muslim.
b. Weak hadith narrated about SAW approving of female circumcision. He said nothing
authentic to show they should or its recommended.
c. There are authentic ahadith that say it can be done but its not clearly stated for
specifically females
d. Accoding to the majority of the fuqaha female circumcision is permissible with the
condition that it is not harmful.
e. Is It permissible if needed? Yes.
f. But it can be haram if it harms the girl. Theres a way to do it so they dont have feeling
later which isnt allowed and is haram. Its a common practice is Muslim lands and thats
why you have scholars saying its not allowed.
g) PHOTOGRAPHY, PAITINGS, AND SCULPTURES (I CAME LATE AND WAS LOST SO MIGHT BE
CONFUSING)
a. It is not permissible to hang images of the daughter or venerate them. The prophet SAW
said that the angels do not enter the home which has a dog or image---al bukhari and
Muslim
b. Painting pictures, drawing pictures or making sculptures of a human or animal is not
permissible unless oit is for education or play.
c. SAW said that amongst the severest of people in punishment on the day f resurrection
are those who make these imagesal bukhari
d. Potoghrapy and videotaping are exempt from this rule. Its a frozen reflections. Video
taping is the same.
e. Hanging has a different ruling then taking picture.
i. Vast majority forbade drawing pictures of y.
ii. You can have pictures in albums but not on desk or on the wall
iii. Mickey mouse picture is allowed cause that doesnt exist. If its imaginary it
okay.
f. Painting and photos?
i. SAW sais the angels will not enter the house with a picture-image of a human of
animal. And some make it more specific to be the details of the face.
ii. Because of honor and the person means a lot to you the 3ulama say the angel
will not enter such a house. Some say in the old day it was like they would
worship them but thats not the case. The sahaba and SAW used to order them
to be taken down. There was a picture on his curtain and SAW ordered aisha to
take in down and she cut it in half and used it for a pillow and it could have been
to fill the inside or as a cover. It isnt clear which of the two.
1. From this some say if it is part of furniture its okay.
g. When it come it drawing a picture or a sculpture
i. Its not allowed unless its for education or play like play dough. For education
to teach kids the alphabet with animals next to it. that is permissible. The
3ulamaa said its okay for newspapers and magazines cause that falls under
education
h. Its okay to color images. There is a hadith that clearly says theres an exception for play
and they made a qiyaas for education cause its better than entertainment so it is
allowed. Aisha said she used to have dolls images or dolls and she played with her friend
and when SAW comes they would leave and when he left they would come (unsure
what that means?). A lot of ppl attack Islam from this hadith cause they said she was
just a child playing with dolls but we say it could have been when she was still in her
dads house. In another hadith said SAW came back from the battle of tabook and this
shelve was uncovered with her dolls by the wind and SAW said what is this and she said
these are my daughter and what's that in the middle and she said that was a horse with
two wings and he repeated it and she said didnt you know a prophet had a horse with 2
wings and he laughed and she did too
h) CHILDRENS TOYS
a. The two ahadith about aisha and toys above apply down here too
b. Al rabi bint mumawwadh said relating the fastin of the day of 3ashura: and we used to
take our children to the Masjid-fasting-, if they cried for food, we used to give them the
toys we made out of cotton to play with until iftar time comesalbukhari and Muslim
c. The default ruling regarding toys for kids is that they are permissible unless there is a
specific reason forbidding the particular toy, such as an image of a idol, a representation
of shaytan, a cross, etc
d. Some ppl are strick and say those toys referred to in the ahadith arent like the ones we
have now and the Shaykh says so what? Just cause theirs were made of cotton doesnt
mean ours needs to be as well. Islam looks at concepts not specifics unless indicated.
e. QUESTIONS?
i. Can I buy barbies?
1. You need to be very careful for the message that they carry. He would
highly not recommend this. Its allowed to have character dolls but
barbies have a bad message so be careful. Left to the parents to see
what's in the best interest of the child.
ii. Can I buy kids toys with music?
1. It is permissible to buy such toys (even though the shaykh doesnt
believe music is halal) cause you can mute it and if you cant theres still
a difference between hearing music and listening to it. deeds are based
on intensions so if you are watching news and not paying attention to
the background music your good.
2. Plus the music is not meant to be by itself. General rule in shari3a where
if its part of something it is permissible but alone its not (blood is
haram but rare steak is across the board is halal and worms are haram
but in an apple its allowed)
3. If the only use for the toy is music then its not allowed (guitar hero, and
DDR, etc).
4. Also when you put music for babies to listen to that isnt smart cause
you are teaching them to get hooked. Train them to listen to the quran.
i) SLEEPING ARRANGEMENTS
a. Children should be separated while sleeping at the age of ten. The prophet SAW said
separate between them in their places of sleep at ten ahmad.
b. All must be separated regardless of gender. To keep their minds pure, etc
i. A lot of scholars say it has to be separate bed---best opinion and if you cant
then
ii. No. you separate with a separation-meaning each one has their own cover.
1. Some say this only applies in the case of it if they dont have full pijamas
and their naked bodies would touch
j) CLOTHING
a. Hijab is not obligatory upon pre-pubescent girls unless her body has matured. In that
case, she should dress modestly.
b. Hijab isnt until puberty but we should train to dress modest from earlier. There is a
hadith good deeds are a habit according to SAW so you should make dress and salah,
gender interactions, etc a habit.
k) SIGNS OF PEUBERTY
a. Having a wet dream. Many evidence for that
b. Menstruation-period. You become fully responsible in the sight of Allah swt
c. Pregnancy-haha it becomes obvious at that point
d. The growth of the course pubic hairsome mention it must be thick and a big amount
cause some have thin and small amount at an early age and thats not it.
i. Imam ahmad and malik: its a sign of maturity/
ii. Imam someone I think hanafi said not a sign at all
iii. Shafi3i said it is a sign that she must start wearing hijab and praying and not that
she is a full adult like if she commits a crime or can sell or buy things.
iv. Another opinion says when you reach 18 you become an adult and well talk
about proof laterhadith said if anyone has pubic hair and reaches 18 treat
them as an adult
e. Reaching the age of 15 w/o any other signs showing first (shafi3is, hanbalis, abu yusuf
and Muhammad ibn-hasan) or 18 (abu hanifah and malikis)
i. if none of the above happens then at 15 you are an adult. What's the proof?
There are ahadith were 14 kids (not sure if that was the exact number but
several kids came a different times) as 14 yrs old and SAW turned them away
from war but at 15 they were accepted. Some say they might have reached one
of the other criterion so thats not good proof but wallahu a3lam
ii. Abu hanifa said 18 for the boys and 17 for the girls based on the aya of the
orphan money handling it till the child reaches maturity and ibn abbass said
maturity is 18yrs old.
iii. Remember the age is according to lunar calendar.
l) FREQUENTLY ASKED QUESTIONS
a. What's the ruling about cartoons and kid movies?
i. Theres a fatwa saying it is not permissible cause it calls to shirk and magic and
bad values.
1. The Shaykh says its case by case cause some dont contain those kind of
things. He will not say its haram but we need to be very careful cause
they send bad messages like charms, and false gods, violence, so be
selective. Tv kills family time and reading.
b. Until what age can I shower with my daughter
i. Kids are supposed to ask permission to enter the parents room so they wont
see the 3awrah. Who are they? Those who reach puberty and another aya talks
about those kids who dont understand the 3awra. If she sees it as a regular part
of the body then its okay so like 2 and 3 but after that they should be used to
not seeing you naked.
c. Who should you cover from?
i. Kids who have reached the age of puberty and those who have knowledge of
sexual stuff
d. Can young child touch quran without wudu? Yes cause you dont need wudu to touch it
anyway
e. Can kids combine prayers for bed?
i. No. you can wake them
f. Do young kids need to wear hijab for praying? Like 3 no cause they arent obligated but
train them
g. Is underarm hair sign of puberty? No
h. Clothing with images? Yes it is permissible cause its not honored and SAW said unless
its on clothing. But its not allowed to have shirts with idols on them
i. What about hanging wild life pictures hanging up?
i. It still prevent the angels from entering
j. Kids can sleep with their parent s at all ages as long as they have their own cover.
k. Can I attend my friends delivery? Yes but dont look at her 3awrah and sit by her face.
l. Can you watch a dvd of the delivery before you deliver your baby? It shows the 3awrah?
Is it is permissible for educational purposes
m. Are you supposed to beat kids if they dont pray?
i. Physical beat isnt allowed
ii. Theres a hadith that says you are not allowed to hit after 14
iii. There is a ruling he doesnt agree with that says it is forbidden to spank your kid.
CHAPTER TWO:
RULING RELATED TO WORSHIP WHICH ARE SPECIFIC TO WOMEN:
All the rules related to females and males are the same unless specifically noted otherwise with proof.
SAW said females are the other halves of males -ahmad
a) RULINGS RELATED TO TAHARAH, WUDU, AND GHUSL
a. If a womens dress is long and she walk and in the bathroom get dirty there is no need to
wash it. even if it touches something unpure which normally needs to be washed. SAW
said the land after it will purify it. abu dawud. This is only for this specific ruling why to
make it easy cause it commonly happens so the shari3a makes it easy for you. There is
consenseus on that issue
i. Shafi3i: if she finds it wet and due to najasa then she should wash it
b. Wetness in the vagina is pure according to the strongest opinion. A wife of SAW would
see stain from SAWs sperm on his clothes and she would just scrape it off (it was a mix
of her wetness and his sperm cause of intercourse) so its pure according to shafi3i.
i. Someone, bukhari, and others said it needs to be washed. Man asked SAW if he
had intercourse and didnt ejaculate does he need to make ghusl? He was told
he needs to wash his private parts-which has been used as a proof it need to be
cleaned
c. Discharge:
i. Arousal is called madhi if its by sexual emotions or activity w/o intercourse or
an orgasm ----this is impure and must be washed. The genitals and anything
soiled must be washed. It breaks the wudu and does not necessitate
shower/ghusl by the consensus of the scholar
ii. Discharge after intercourse, a wet dream or an orgasm-mani- she must take
ghusl and clean underwear and sheets
iii. If its not related to sexual arousal and is of natural secretion the 3ulama
debated
1. Strongest opinion says its pure; she doesnt need to make wudu cause
if we say otherwise it is hardship (imagine having to make wudu left and
right. the shari3a doesnt impose anything thats that much of a
hardship) and SAW would have explained it (if it was najis he would
have explained it to all the women cause its something everyone would
need to know about) but he didnt. you are allowed to pray with it.
anytime there is hardship to look after it then it isnt najis
2. Some say it breaks wudu cause any discharge that comes out of the
3awra is najis? Not true cause gas isnt najs physically.
3. Air from the vagina doesnt break wudu and this is agreed upon.
d. A woman must do ghusl after intercourse, regardless of whether there was any orgasm,
discharge or not. SAW also said if the two circumcised parts meet, then ghusl becomes
mandatory-Muslim
e. You can wait till the time for the prayer .
f. During ghuls for this sexual stuff you must wash hair with water reaching the roots of all
the hair. AISHA R said when one of us wanted to make ghusl from janaba, she would
por three handfuls of water onto her head.. --let it get to the roots. If a woman has her
hair braided she does not have to undo them before ghusl
i. If I have long hair do I have to wash it all? Yes
ii. Does it have to be soaking wet? No
g. There isnt a difference between ghusl janaba/after sexual stuff and the ghusl for after
you period. What are the steps to a perfect ghusl?
i. Start with cleaning you private parts and after your period you begin by washing
it with something with a good smell
ii. The make wudu
iii. Then wash the right side of your body
iv. Then left side of your body
v. Then let the water run all the way over your body
h. That perfect but what's sufficient? Just being under water, and some say you need to
wash mouth and nose too and any trace of blood.
i. We have lots of water now but ppl didnt before.
i. It is permissible to wipe over the khimar/scarf for wudu just like its allowed for men to
wipe over their turban. If she is able to include wiping the forefront of her hair and then
wipe over the khimar, that would be safer---Cause SAW in hadith pushed the turban
back and wiped hair and then wiped the turban but sometimes he just wiped over the
turban
j. Common questions:
i. How does a women wipe the head? The sunnah is to go all the way to the back
and come forward. Is it the same for a women? Yes cause theres nothing to
prove thats only for men. Only one time is the common practice.
1. Imam Ahmad said dont need to go all the way back cause Aisha R used
to do it only to the front area.
ii. Do I need to wipe over all my hair? The quran says wipe your head not your hair
so wipe the hair thats on the head.
iii. Can I wipe over socks?
1. We have record of 8 companions stating permissibility of wiping over
sock not just leather ones
2. Yes you can wipe over socks if you put them on after you made wudu.
Resident can keep the same socks on 24hr and travelers 3days before
taking them off to make a fresh wudu under them
a. If its really cold you can keep them on for longer
b. If you have a boot on theres no restriction for how long that
wudu will last before you would have to take them off and
make a fresh wudu
iv. Theres nothing in shari3a that says the sock has to be thick and non-
transparent
v. What if I have a hole in my sock? Can I still wipe over it? Yes you still can cause
the sock of the sahaba werent perfect.
vi. Does touching the male break the wudu? Difference between you touch
someone and someone touch you
1. Shafi3i: If a man touches a woman breaks his wudu not hers.
2. Shafi3i: awlamastumun nisaa-the aya referring to touching---used an
evidence ().If the woman shakes hands of a male mahrum or not it
breaks her wudu
a. Vast majority of scholars said no, touch doesnt break wudu. ibn
abbas interpreted this aya (noted above) when it says touching
it means intercourse and there is a lot of evidence like when
SAW would be praying and he would move his wifes feet to
make sujud proves he didnt loose his wudu.
3. Ibn umar and ibn mas33od say if you kiss make wudu but just touching
you dont need to
4. Which lead to a middle view; if you touch with lust then make wudu if
not dont make wudu
vii. Is sperm pure?
1. Shafi3i and one narration of imam ahmad: yes cause humans cant be
made of something impure
2. Hanafi and others yes it isnt pure cause SAW used to wash it off of
things. But aisha used to remove it with her nails. If its wet it should be
washed if dry it can be flaked off
viii. If you dip in the bath or pool its sufficient for ghusl/wudu if your hair and face
get wet
ix. Are ghusl and showers a substitute for wudu?
1. If youre taking it after sex or your end of your period then yes it is
sufficient. This gets rid of major impurities and wudu is for minor
impurities
2. If Im taking a shower for jum3a? yes it counts for wudu too
3. What about a regular daily shower is it sufficient for wudu? No unless
you make wudu steps or you have the intension of wudu.
x. Do women have to do ghusl for jum3a? no but its highly recommended for
those who go to the salah. We take the shower for the salah not just cause its
Friday. SAW said whomever comes to jum3a which proves its for both men and
women
xi. Do women have to take out bun to take a ghusl? No. SAW said it would be
sufficient to take 3 hands full of water and dumping in on the top
xii. Does a health check/gynecological check break the wudu? No.
xiii. Do I have to wash oils out of my hair before wudu?
1. In the old days before you went to hajj ppl used to put this gel like stuff
to keep their hair down/manageable. They would make wudu over it. If
these cream block your hair from water then you hve to wash out but if
you can penetrate then its all good
2. Nail polish doesnt let you clean the nail/is a barrier/blocks the water
from reaching the nail (which is part of the hand that needs to be
washed for wudu) vs henna which lets you clean the nail and lets water
penetrate it.
3. Same rule for make up: waterproof mascara doesnt let water get in so
wash it out for wudu. Foundation and other makeups that let water
wash face are okay as long as they dont block the water from reaching
the face
xiv. Can a bride make tayammum so she doesnt mess up her make up? No thats
not sufficient
xv. Does touching privates break wudu? Out of lust yes but just cleaning self no.
xvi. Is more than one ghusl for multiple reasons (mensus, wetdream, ect) nedded?
No one is sufficient.
xvii. Can a woman touch the mushaf/Arabic quran and read quran?
1. Vast majority to scholars say youre: Not allowed to read quran while on
menses. Evidence is hadith of SAW saying a women in her menses or
while sexual impurity is not allowed to read the quranbut very weak
hadith as well as other hadiths along the same lines are weak.
2. Old opinion of shafi3i and some malikis and some hambalis: She can as
much as she wants. Bukhari as well held this opinion and said when
Aisha R came to SAW and said I have my period and SAW said to do
everything of hajj but the tawaaf. Part of hajj is reading quran. Also
dont you think if it was the case that women couldnt read SAW would
have explained this cause it happens very often?
xviii. 4 imams say you should have tahara to touch the mushaf; highly recommended
but not wajib. What about the Quran on your cell? While the app is opened it
will take the same rules of not being in the bathroom, etc but with touch
doesnt follow the rules of mushaf.
1. In sura waqi3a it says this book is only touched by the mutaharoon
purified (not something I did. Either referring to angles or eman. Ppl
have never been referred to as purified) vs tutatahiroonyour are
purifying yourself. NOT SURE WHAT THE POINT WAS HERE
2. SAW said only tahir ppl touch the quranit is weak thought
3. There isnt a single authentic hadith to show you need tahara to touch
the quran
xix. Dhahiri and a famous shafi3i: that says you can
1. SAW went to the bathroom and someone gave him water for wudu and
he said wudu is meant for the salah.
2. SAW encouraged us to make thikr all the time w/o exception.
3. SAW sent letters with quran to non Muslims (we know they dont have
wudu and would be touching it so that makes sense) but that was
verses not the whole quran
xx. Can a women say athkar/words of remembering Allah SWT on her menses? Yes.
Even those who say dont read quran say you can say it if its part of dhikr.
xxi. Nose bleed doesnt break wudu
xxii. You have to wash ears if wiping over scarf for wudu
b) Rulings related to hayd-menstruation, istihadah-bleeding outside of menstruation, and nifas-
post partum bleeding
a. Menstruation:
i. Natural release of blood w/o outside causes during specific times. Not due to
stress or medical reasons. Something Allah decreed on the daughters of Adam.
Not disgrace like some religions see it to be.
ii. Typically between 12 and 50 can be before and after depending on her
condition and environment. no specific age for it is the strongest opinion
iii. Difference of onion on what is the length-8 different opinions-the strongest
according to him is that the shari3a didnt limit it to days but presence of blood
regardless of light or heavy (opinion of Shaykh ibn taymiyyas opinion amongst
others). Evidence is aya 2:222:
1. And they ask you about menstruation. Say, it is harm, so keep away
from wives during menstruation, and do not approach them until they
are pure. And when they have purified themselves, then come to them
form where Allah has ordained for you. Indded, Allah loved those who
are constantly repentant and loves those who purify theselves.
iv. Doctors define the menses differently then fuqahaa so be careful.
v. There are many different changes that affect the state of menses:
1. Increase and decrease e.g. a period that normallt lasts for six days
continues for one more day or ends a day early
a. Number of days is something that doesnt affect the ruling of
period. Meaning if its there less being praying or if its longer
then dont pray.
2. Advancement or delay (normal time isnt the same) should still be
treated like menses. , e.g. a woman have her normal period at the end
of each month finds herself menstruating at the beginning of the month
or vice versa.
3. Yellow discharge (which looks like yellowish pus) or khdrah: looking
between yellowish and blackish discharge. If this occurs during the hayd
period or immediately after it and prior to the state of taharah
(cleanliness which will be defined later), then it is to be considered as
hayd-its still part of the period with all the rulings being applicable.
a. If the discharge occurs after the state of taharah, then it is not
hayd in lieu of the saying uf umm 3atiyyah R, we never
considered yellowish discharge after cleanliness as a thing of
importance-as menses-abu Dawud
b. Also Aisha R said some women used to send their pads of
cotton with traces of yellowish discharge to her (for a verdict to
know weather they had become clean from menses or not), and
Aisha would say, do not hurry till you see al-qussatl-baydaa
(white discharge from the womb; the cotton pad will be
white,) meaning perfect disappearance of meses-al bukhari
c. How to you declare purity?
i. Clear white discharge
ii. No more bleeding.
iii. Or if area its completely dry w/o anything and able to
wipe clean w/o anything on wipe
d. If yellow comes after purity then its not part of the period
vi. Discontinuation: in menstruation such that blood flows on one day and it stops
the next day. There are two circumstances associated with this type:
1. If theres bleeding a gap in-between all the time-consistently (one day
there and then not, then back again, etc) then it is a blood of bleeding-
istihaadah not period so still pray
2. What if theres a break of the blood flow of your period? Shafi3i says its
part of the period cause no sign of purity was seen (the white discharge
etc) and a lot of the women have break in between- the blood doesnt
constantly flow. So dont rush to declare purity wait 24hr and some say
2 days. If the second day it comes back its continuation (also abu hanifa
and ibn taymiyya say this)
3. The hanabila say no. if you dont see blood and you wipe and its clear
you have to shower and pray and if it comes back and goes then shower
again and do this for 15 days and then after its all purity even if theres
blood.
b. the rulings regarding menses
i. the blood of menses is najas: by consensus. If it gets on your clothes you need
to wash it off
ii. prayers:
1. women are not al.owed to perform salah in this state. She does not
need to mke up the prayers that she missed. Aisha R reported SAW to
have said stop formal prayer when your menses begin. When it
finished, wash off the blood from your body and return to formal
prayer. Some ppl are shy and they pray anyways BUT you cannot do
that. Some hanafi say it could be an act of kufr to do that.
iii. fasting:
1. has to break fast regardless if she feels weak or not. Allah SWT has not
permitted them to fast his infinite wisdom, which the believers are
required to accept unquestionably, abu said al-khudri R quoted SAW as
sayinga woman can neither pray nor fast during her menses-Muslim.
2. The days must be made up. Aisha R said: when we would have our
menses during the lifetime of the prophet SAW, we were ordered to
mke up the days of fasting that we had missed but were not ordered to
up the prayers that we had missed-albukhari
iv. hajj rites:
1. with regards to the rites of hajj, menstruating women are allowed to
perform all of them, with exception of the formal prayers and the rite of
waling around the ka3bah seven times-tawaf.
2. Aisha R reported we set out with the sole intention of performing hajj
and when we reached saraf-a place six miles outside of makkah, my
meses began. The messenger of Allah SAW came to me while I was
crying and asked what is the matter with you? Has your menses
started? I replied yes. He said that is something which Allah has
destined for the daughters of adam so do all the rites that the pilgrims
do, except tawaf-bukhari and muslim
3. aisha R related that she told SAW that safiyyah bint huyayy began
menstruating (before the farewell tawaf) and he said perhaps she will
delay us. Did she make tawaf? We replied, yes. he then told her to go
ahead-al bukhari
a. ibn taymiyyah discussed if you get your period and your
caravan/group is gonna leave you; he said you wash yourself
and secure yourself to not let blood drop then you can go and
make tawaf cuase its by need. Not sure how to explain this
properly
v. Touching and reciting the quran and dhikr
1. see above
2. most scholars prohibit menstruating women and those in the state of
sexual defilement/janabah from reciting the quran or touching it.
however, some of them are of the opinion that she can recite the quran
w/o touching it except with her hands covered
3. Ibrahim al-nakhaI said: there is no harm on menstruating women
reciting a quranic verse. It was also the opinion of al-imam malik
4. She is allowed to mention Allah. Umm 3atiyyah reported that they were
instructed to let the menstruating women come out for the eids and say
Allahu akbar (bukhari used this to show if they were instructed to speak
Allah swts names and attributes the shouls also be allowed to read the
quran, in which Allahs names and attributes are also mentioned.)
5. Ibn abbass r quotes abu sufyan as saying, Heraclius asked for the letter
from SAW and read it. it began: in the name of Allah, the beneficient,
the most merciful. O pople of the scripture, let us vome to a common
principle between us, that we do not worship anyone (or anything)
besides Allah al bukjari
a. Dont know how this relates but it was in the book
vi. Entering the Masjid
1. The scholars have differed in regarding the permissibility for a
menstruating woman to enter the mosque.
2. Masjid is the place of prayerthe musallah not other areas that ppl
sometimes pray
3. Vast majority say you cant be in the prayer hall. What is the evidence?
a. SAW ordered all the ppl to attend the eid prayer and he order
those with their menses not to be in the prayer areathis is the
only strong ahadith BUT they didnt pray in the Masjid it was in
the public.
i. But how would they line up for salah? It would be
unorganized so thats why those who could and
couldnt pray were told to spilt up.
b. Because the woman who has her menses is like the one with
janaba who cant go in the Masjid. SAW was reported to have
said I do not allow women who has her menses or one who has
sexual impurity to enter the Masjid. This came from a weak
narrator
c. b/c its not proper and puritylogical reason
d. SAW would put his head in the window and his wife on her
period would brush his hair from inside the house (she didnt
come in the Masjid to brush it he stuck his head in the house)
BUT other times shed do it in the Masjid
4. Those who permitted it used the following evidence:
a. Rule of permissibility due to absence of prohibition
b. No explicit proof aside from weak hadith.
c. Almost explicit hadith in bukhari that there was a woman who
lived in the Masjid and cleaned it and SAW never told her to
stay outside when she had her period.
d. SAW told aisha when she got her period during hajj do
everything the one performing hajj does except tawaf-muslim
e. Hadith SAW said a believer does not become impure bukhari
and Muslim.
f. Also this isnt explained well and if it was haram wed know
more about it. also if you have no need why would you go?
g. If theres a need like a class thats good but the sunnah is to
make 2 raq3aat and she cant do that.
h. SAW said to aisha go get me the garment from the Masjid she
said SAW I have my mensus and he told her its not on her hand
so go get it for me-in Muslim
i. Maymuna used to put SAWs cloth in the Masjid while she was
menstruating-ahmad
i. The others say it doesnt mean she entered the Masjid
but realistically she might have
j. For learning purposes it was allowed by some of the majority
ppl.
k. Imam malik refused going in as well as another famous person
but didnt hear who
vii. having sexual intimacy with the husband while on your period:
1. intercourse is prohibited based on the ayah they ask you concerning
menstruation. Say : that it is an adha (a harmful thing for the husband to
have sexual intercourse with his wife while she is having her menses),
therefore keep away from women during menses and go not unto them
till they have purified (from menses and have taken a bath) 2:222
2. whoever does have intercourse during this time must seek forgiveness
from Allah swt and turn to him in repentance, and he must give a dinar
or half a dinar in charity as an expiation for what he has done, as
reported by imam ahmad and the compilers of the sunan with a good
chain of narration, on the authority of ibn abbass that SAW said,
concerning one who had had sexual intercourse with his wife while she
was menstruating, give a dinar or half a dinar in charity, and whichever
of them you do you will have its reward. Abu-Dawud
3. its permissible to be intimate but not have intercourse. SAW said, Do
everything except intercourse.-Muslim
4. aisha said if one of us was menstruating and the messenger of Allah
SAW wanted to be intimate with her he would tell her to wear an izar
(waist wrapper) at the peak of her menstruation, then he would be
intimate with her. Bukhari and Muslim
5. 3ikrimah R narrated from one of SAWs wifes that when SAW wanted to
engage in any intimacy with one of his wives when she was
menstruating, he would put a piece of cloth over her private part---abu
dawud
a. Some say she must cover the area of navel to knees and can do
stuff
b. other say she only has to cover her private part
6. she has to take a shower first. But abu hanifa yes she doesnt have to
viii. ghusl:
1. it is obligatory for a menstruating woman, when her bleeding stops, to
perform a complete ghusl; based on the prophet SAWs statement to
Fatimah bint abi hubaysh when the menstruation starts, leave off
salah; and when it finished, then perform a ghusl and offer salah
bukhari. has to
ix. divorce:
1. it is prohibited to pronounce diverce when a woman is on her menses.
Instead, she must be in a period of purity/between menses in which her
husband has not had sexual relations with her. Abdullah ibn umar R
reported that he had divorced his wife while she was menstruatingn and
his father had asked SAW about it. he SAW replied instruct your son to
take her back and keep her till it is clean. Then he should wait until she
menstruates and becomes clean again, if he then wishes to divorce her,
he may do so without having intercourse with her. That is the period
which Allah prescribed for divorcing womenbukhari and muslim
2. the pronouncement of diverce during menses is still counted as a
pronouncement. Yunus ibn jubayr asked ibn umar R is the
pronouncement of divorce counted if a person diverces hiw wife while
she is in a state of menses? He replied why not? Was he helpless or
foolishbukhari
3. however one who does so has committed a din. When ibn Umar R was
asked about the a person who diverces his wife during this time he
replied if he pronounced one of two divorces, Allahs messenger SAW
would command him to take her back, allow her respite until she enters
her second menses, aloow her respite until she is purified, then divorce
her without having sex with her, if he had ppronounced three divorce,
but she would be irrevocably separated from him-al bukhari
c. istihaadah
i. Is vaginal bleeding for reasons other than menstruation or childbirth. In some
women, bleeding never stops. In others, it continues for longer than a normal
period, but it does stop for a short period. The woman affected by it is in on eof
three conditions:
1. she had a known regular mensus before the onset of the istihaadah-
a. saw the signs of purity and then new blood. You still pray and
fast during those days after signs of purity.
b. If she didnt see purity but continuous blood?
i. Do you have a regular period if so the use your regular
time frame example 7 days in the middle of the month
and it continue then shower at day 7 and begin praying.
2. she did not have a regular period or does not remember when it used to
occur.
a. Try and distinguish between the two types of blood? Period
blood is dark with a smell and thicker nd istihadah is bright red,
thin, and less odorous
3. she didnt have a regular period and even cannot distinguish between
the two types of blood either b/c its always the same or casue its always
changing.
a. She should then go by the average period of most women; so
far 6 or 7 days every month, she should consider herself as
menstruating and that should be calculated from the time she
first noticed vaginal bleeding. The rest of the days should be
treated as istihadah.
b. Do you have a sister who has regular days? Go with her period
cause environment has an effect. If not look at your ethnicity or
common in age group. A woman asked SAW and he said stop
for 6 or 7 days and then its done.
4. Do you need to make wudu each sala if you have constant bleeding?
a. Imam malik (not sure not if thats who he said) no if you dont
break it in the other ways like gas and stuff
b. Others say yes it does so make wudu for each salah and change
your pad.
ii. There is no difference between a woman beset by istihadah and a woman who
has a complete cessation of menstrual flow, except as follows:
1. If a woman beset by istihadah wants to make wudu, she should wash
the blood from her vaginal area then apply a new pad and any blood
that comes after that is of no account.
2. She must perform wudu for every single fard prayer as SAW ordered
women in this condition perform wudu for every salah -bukhari
d. nifaas: this is the post-partum bleeding after the birth of a baby or during delivery, or
two or three day before delivery accompanied by labor pains, the following are the rules
of nifaas:
i. theres no minimum limit to the length of the bleeding the upper limit is
generally within 40days (hanafis and hambali) or 60days ( shafi3i and maliki up
to 60days) these numbers are from the sahabah like ibn abbas and ibn umar
ii. umu salama said the women of their time used to bleed for 40days. Imam
awzaa3i said he know someone who bled for 60 days and thats where that
came from. BUT if its the same type of blood why limit?
e. most of the rules are just like rules of menstruation-hayd
f. Questions:
i. Does miscarriage blood or abortion take the same ruling? If it happened in the
first 80 days it is not nifaas so make wudu and pray. After 80 day it does.
Stronger opinion based on if the baby takes the shape of human it takes the rule
of human
1. Other say after 120 days (a lot of scholars said this)
ii. If your water broke do you stop praying? It depends cause some have it break
w/o contractions of labor so just make wudu even if theres blood. If it is during
labor you stop praying. If theres blood before labor still pray.
iii. What if youre pure after some days it comes back?
1. When the blood stoped did you see signs of purity? If so then after that
the blood is either her period or istihaadh random bleeding. If you cant
tell consider it a haydd-menses.
iv. can get your period during pregnancy some yes yes and others say no. he says
no
v. IUD bleeding isnt period so pray and clean it
vi. Brestfeedning women can have period
vii. Can you take the pill to delay period for hajj you can consult a doctor and if it
isnt bad for you then you can but he doesnt recommend it cause it messes you
up
viii. If you finish your period before sunrise do you need to finish Maghrib and isha
or just isha?
1. Some say If she finishes before sunset and there is enough time to take
a shower and pray 5 raq3aa you must pray dhuhr and 3asr.
2. Some say if she finished before Maghrib and has enough time to pray
one raq3ah then she should pray both. But why?
a. she was excused from dhuhr while she is at dhuhr time and they
are connected to one another like for the travelor? Hanabila,
shafi3is and malikis.
b. Abu hanifa said no she only need to make salah of the prayer of
the current time-3asr (strongest opinion). No proof for the
other opinion she was exempt from it before when it was dhuhr
time so why does she have to pray now when the time passed?
3. What if you get your period after athan of dhuhr and you didnt pray
yet?
a. Some say yes you must make it up. This is a safe side
b. No. cause it wasnt obligated to pray at the beginning of the
salah time and you were stopped from fulfilling the obligation
by the period. Makes most sense
ix. When do you know your period has ended:
1. Whitish discharge
2. Wiped dry
3. No blood
c) Reluings related to athan, iwaamah, salah, and dhikr
a. The Masjid, athan and iqamah
i. Not recommended to call athan and iqamah for women (based on ibn umar
saying athan and iqaamah are not for women) but it is permissible for her to do
so between women. You cant do it in front of men.
ii. Women are allowed to gather in the Masjid. In Muslim SAW said do not
prevent the female slaves of Allah from the mosques of Allah.
iii. They used to go for fajr and late at night. Aisha R said the believing women
used to witness the fajr congregation with the prophet SAW in the masjid
bukhari and muslim
iv. SAW said I considered elongating my prayer, but when I hear a child crying, I
make it short because I do not want to make it difficult upon its mother.
v. The women used to hurry home as to not to mix with men. If theres a mixed hall
try and avoid blocking the entrance and causing traffic.
vi. SAW assigned a specific entrance for women
vii. When women come to the Masjid they should avoid wearing perfume and
makeup and extra beautificationavoid shiny clothing really fancy, flashy, etc.
SAW said if one of you witnesses the salah in the masjid, she should not wear
perfume Muslim. In another hadith they should come tafilaat (i.e not
beautifying themselves) abu dawud
viii. There was a women who cleaned the Masjid and she died and SAW was mad he
wasnt informed of her death and prayed on her. This shows that women can be
part of the structure of the Masjid. She can still be in the role and follow rules
specific to her
ix. Hearts attached to the Masjid as a shade on the DOJ is applicable to men and
women
b. Salah and dhikr
i. Prayer on time is equally obligatory on women and men
ii. Indeed, prayer has been decreed upon the believers a decree of specified
times 4;103
iii. SAW was askedwhat is the most beloved deeds to Allah? He replied praying at
the beginning of the appointed time. Jibreel came several times to teach the
times of the salah to SAW which shows the importance of the timings.
iv. When women pray it is obligatory to cover body with loose clothes and only
show her face and hands (according to the majority of the scholars)
1. Hanafi, shafi3i, al-thawri, and al-muzani added feet to be allowed to
show in prayer.
2. Hadith from SAW isnt strong but the statement from his wife is and it
said can you pray with a long dress? as long as you have a long dress
(UNSURE WHAT THIS MEANT)
3. Scholars who view it as obligatory for women to veil their faces in the
presence of non-mahram men view that a woman should cover her face
during prayer if non-mahram men are present
v. Uncovering part of the body during prayer?
1. Anything thats covered before salah and then became uncovered
doesnt break the salah. Proof the imam was a young boy who had short
clothes and this lady said why dont you cover your imams bottom and
they covered it for him. So if the wind blows but it back and ur good
2. Also an opinion says if a part that needs to be covered becomes
uncovered the salah is invalid and must be repeated ONLY if the
uncovered area is a large area and remains uncovered for a long period
of time.
3. If you believe covering the face is a must and you are with men cover
your face but without men must uncover their face and hand
vi. You can pray in congregation but its not a must. Can you pray a bunch at a time
but each alone? Its permissible. Aisha R reported umm salamah R led women in
prayerabdulrazzaq in al-musannaf. So is it better to pray together? Allahu
a3lam
vii. If a woman prays with a male (mahrum or not) she should pray behind him.
Anas R reports that he prayed with an orphan boy behind the prophet SAW and
his mother prayed behind thembukhari and Muslim
viii. SAW said the best lines for men are the front rows and the worse are the back
rows. And the best lines for women are the back rows and the worse for them
are the front rows. Muslim.
ix. Do you stand in the middle or in the front? Both are correct and have been
reported by the sahaba. The most famous one is to stand in the middle of the
womens line.
x. Women cant lead men in prayer. There is a hadith of ummu waraqa that says
SAW let her lead her family in salah but he said is it a weak hadith but even if it
wasnt it could be only females in her family and even if there was a male then
we say it could have been for taraweeh
1. Theres one opinion that if theres no one to lead taraweeh amongst the
men and she knows quran she can lead.
xi. A woman may read aloud in prayer as long as there are no non mahrams
present
xii. It is not permissible for one man and one woman who are unrelated to pray
together in seclusion. Some of the scholars from shafi3i and hanbali schools
disliked that a man lead a group of women in prayer unless another male or
female relative was present.
xiii. Men and women in salah have the same rulings but some say stuff like:
1. Hand for women on chest and men down. Both should have them
between their breasts.
2. Elbows in and men out? Not true no proof
3. Women pray quiet and men loud. Not true but if there are men and she
scared to cause fitnah she can lower her voice
4. SAW said dont leave a space for the shaytaan so all of our feet should
touch.
5. Women should keep legs together but not true
6. Women should sit on bottom not on the floor like men for tashahhud.
Should keep feet the same way as men.
xiv. Some scholars like al bayhaqi brought forth some differences (women should
bring her thughs together, not raise her hands high during takbir, not extend her
arms away from her sided during sujud, lock her arms closely to chest during
qiyam, and not stretch out her body during sujud) but there is no proof for any
of these differences.
xv. Valid differences based ahadith include that a woman must clap to alert the
imam to a mistake as oppsed to saying subhanallah. Clapping is done by tapping
the back of the left hand with the right.
xvi. It is from the sunnah to have specific advice for women during the eid khutbah.
Jabir and ibn abbas witnessed SAW approaching the women during eid ul fitr
and speaking to them-bukhari. Sometimes SAW would leave the minbar and
address the women by giving the women his shoulders.
xvii. If an adult women walks in front of a man (in his area of sujud or between he
and his sutra/barrier) does it invalidate the salah?
1. Ibn umar, anas, abu hurayrah, hasan albasri, and the majority of ahlul
hadith and ibn al qayyim say if she goes between the sutra it will
invalidate the salah. The proof is:
a. The women the donkey and dog break the prayer-Muslim.
Aisha said ibn umar is wrong about that b/c I used to lay in front
of SAW when he was praying. Ibn umar was relayed by several
companions (not sure what that means). She thought because
she was laying there its the same as passing in between which
they make a difference.
b. They say If your behind an imam and a women walks it doesnt
break your salah
2. Vast majority of Muslim jurists say it wont invalidate it but decrease
concentration etc. stronger opinion
a. Nothing can break salah unless you break it yourself
b. Imam ahmad said they only thing that breaks your salah is a
black dog and he was asked about the woman and he said hes
not comfortable saying that.
xviii. Sunnah to go to eid in whatever state. Hadith talked about them going and
saying taktir outloud so you can do so as long as it doesnt cause fitnah.
xix. Change thikr to be gender specific for example allahumma inne abduk should be
changed to ..inne amatuk-female slave.
c. Questions:
i. Repeat after digital ahthan?
1. No. theres no ajr cause its an act of worship and theres no niyyah for
this athan. Not islamically a correct athan. Masjid cant replace
muaththin with a clock
ii. Cant follow the imam on tv in prayer
iii. Ive missed so many prayers and have repented what should I do?
1. The only thing between kufr is salah. What about making them up?
General rule: if you missed cause you forgot or were in surgery or
overslept make them up.
a. A lady came to SAW and said I have a bad husband cause he
doesnt let her fast, doesnt let her pray at night and doesnt
pray fajr. He said he was of the people who dont wake up till
the heat of the sun wakes him up and when his wife starts
praying she doesnt stop and he wants to be intimate with her.
SAW said pray when you wake up. He was lenient with him.
Cause he was trying his best not out missing fajr out of laziness
2. But what about the ones you missed on purpose? Some say make it up.
Bid3a to pray two fajr two dhuhr and so on.
3. Other opinion is you dont have to. If you leave it intentionally there is
no rule or allowance for making it up. The only thing that will take care
of it is tawbah-repentance. Same applies to fasting but not zakah cause
thats the right of the poor not Allah swt.
4. If youre not sure how many go with which you are sure of.
iv. Can I pray in the car if the time is about to end? No cause standing in the salah is
a pillars just like sujood.
v. Can you pray in public? Yes who cares if ppl look at you
vi. Can pray sitting in the airplane? yes and the ship where SAW said pray sitting.
So theres qiyaas for airplain based on hadith of the ship scenario. If you cant
wait till you reach your destination then pray. Dont have to make it so obvious
just bend a little and a little more for the next podition/step.
vii. Can you pray with pants? Lose then yes but jeans or tight pants and blouse you
can but disliked. according to all 4 mathahibs as long as she covers her body
with the clothes even if tight and not see-through it is valid but disliked. Just at
home not in public. Even if it shows the shape? One opinion of shifi3yeen it will
not be valid but imam nawawi said thats not their mathhab.
viii. Can you lead a boy who hasnt reached puberty in salah? Not allowed to if he is
of maturity like 10yrs who knows the rules of salah
ix. Can a young boy lead adult women? If he knows the rules of salah and what to
do if mistakes happen then he can. Should be of maturity
x. Can you pray by husband? No hadith said there was a lady with her husband
and son and she prayed in the back
xi. If a baby has a dirty diaper can you hold them while praying?
1. If you knew about it your prayer is invalid. Carrying najasa invalidates
prayer.
2. If you smell it put the baby down
3. If you find najasa on you after youre done, your salah is valid.
a. Proof: SAW removed his shoes and was told by Jibreel that they
had najasa on them but he didnt go back and redo his salah.
xii. Should our bodies touch is salah like men. Yes
xiii. Women dont have to pray jum3a and dhuhr cause theres consensus that we
only pray 5 times a day and that would make 6. also we know jum3a is a
replacement for dhuhr.
xiv. If a child passes in front of you do you stop them. Yes you do SAW stopped a
sheep and he moved up till it went behind him then he moved back.
1. Does this apply in makkah and madina? If its super crowded its hard
and will be exempt .
xv. If women walk in front of another women it doesnt break salah
xvi. Can you combine salahs if at the mall or work? Not the mall but at work if its
not a habbit and there is a need. This is based on SAW combining a salah for no
reason to make it easy on us.
xvii. Women came to the Masjid wearing perfume and not having good behavior etc
as reported by aisha in relation to her statement of if SAW witnessed what
women were doing today he would have forbidden them from going to the
Masjid like bani israeel.
xviii. Do you need a partition?
1. In SAWs Masjid there wasnt a partition
2. The salah is acceptable without the partition
3. The salah is acceptable with the partition if the women has the ability to
follow the imam and musalleen in front of her by sight or sound (some
say they even have to see cause what if the mic gets cut? Their salah
wont be valid)
4. Partition isnt bid3a cause its not an act of worship. Its meant to give
privacy so women can relax
5. Also if there isnt a partition there might have to be strictness on those
coming to the Masjid with full makeup, and improper hijab.
6. If you want to make i3tikaaf the partition makes it easier for you to relax
(they used to bring tents to SAWs Masjid and it got really crowded and
he said take all the tents down and he canceled his own i3tikaaf too to
not have hard feelings).
7. Disadvantage of it is theres communication barrier
xix. Wheres the best place for the women to pray?
1. The first line if theres a partition
2. The back if theres no partition
xx. Do you need wudu and hijab and face the qiblah for sujood tilawah and shukr
1. maliki, and others say no cause its not salah. Plus if you get good news
you would delay to find all these so it doesnt make sense
2. Shafi3i say you need all three cause its one of the actions of salah but so
is dua so it isnt logically.
xxi. Dont need hijab for reading quran.
xxii. SAW prevented women from wearing perfumes in the Masjid
1. This goes for those that can be recognized if passing men
2. Its okay as long as its not a strong smell and only those really close can
smell. Almost an agreement on this. Also if shes not with men its all
good
xxiii. Do the ahadith that mention reward of remaining in dhikr after prayer (like the
one that says you get the reward of 3umrah) apply to women praying at home?
1. Debate over this
a. Imam malik also great hanafi and zurqa3e-great shafi3i scholars:
they say yes
d) The rulings related to al-janaaiz-funerals and al hidaad-mourning
a. SAW said he who slaps the cheeks, tears the clothes and follows the tradition of the
days of ignorance is not from us-bukhari.
i. SAW forbade women to wailing and hittnig self and other things like that over
someones death.
ii. What about crying? SAW cried over his kids deaths and his uncle and friends
and some said his tears where like rain.
b. SAW also said the naihah (one who wails and screams loudly, usually accompanied by
hitting the body and saying things that show extreme anger at al-qadar), if she does not
repent before she dies, she will be brought on the day of ressuraction in a dress of tar
and an outer garment of scabs-Muslim
c. SAW said A Muslim whose three children die before the age of puberty will go to
janna-bukhari and in another narration he was asked even two and he replied even
two.
d. SAW said Allah does not punish because of the tears of the eyes or the sadness of the
heart, rather he pushes or gives mercy because of this and he pointed to his tongue--
muslim
e. If a women passes away and has long hair she should have 3 braids and put behind her
back
f. A woman is shrouded in five sheets, while a man is shrouded in three.
g. SAW used to do the funeral prayer next to the cemetery
h. Its okay to follow-drive behind the janaza it is acceptable (its a reminder, its a right of
the Muslim, if you follow it you get reward of qiraat-a reward as big as the mount of
uhud. Also SAW said when you follow the janaza your dua is excepted)
i. The imam stands facing the middle of the womens body during her janaza prayer, not
the head like for men
j. If there are multiple dead bodies put in order of men, then children then women
k. Can a women visit the graveyard?
i. Hanabila: No. they used the hadith were SAW said the curse of Allah is on the
person who visits the graves and those who put light on the grave. The Shaykh
goes with this first opinion.
1. Al qurtubi however said Allah curses the women who visit the grave is
for those who go often. Zawaraat-means constantly visits.
a. But if its recommended and you do it too often how could it be
a bases for you to be curse
ii. Vast majority allow it casue the general hadith abrogated it saying I forbade you
but not I give you permission to do so. Also aisha narraeted hadith of what to
say when you visit the graveyard and what she should day. Also aisha asked for
permission to go visit her brother and SAW allowed her. SAW passed a woman
at the grave and told her to have patience and have taqwah and she told him to
leave-she didnt know himand she was told and apologized. SAW saw her
there and didnt tell her to leave so thats proof of allowance. They also use the
hadith in Muslim visiting the graves reminds you of death, so visit them.
l. Questions:
i. What's hidaad? After husband dies she needs to stay for 4months and 10days
and cant
1. Wear perfume
2. Not allowed to put extra beautification jewelry on
3. Not allowed to have dressing for extra beautification
4. Not allowed to get engaged or married during this time
5. Time to remember him and readjust to the new situation shes in
6.
ii. Can she stay in her husbands house or can she go to her familys house during
hidad?
1. Ibn abbass and aisha: she can stay anywhere. She can travel. Aisha let
them go to hajj during this time. Allah didnt say stay at home
2. Umar and uthman said she must stay at her husbands house. They say
she cant travel. Umar forbade and sent women back to Iraq in this
scenario. They take the hadith of a lady asking SAW after husband died
if she could go to her parents and SAW called her back and said you
must stay at your husbands place till your time finished. The Shaykh
says theres a debate over authenticity but vast majority of scholars use
it. hanafi, malik, and shafi3i, and ahmad use it for as long as she can stay
there.
iii. Should you wear black. No evidence
iv. SAW said if you want to put yourself in hidaad over someone else it is not
permissible for a woman who believes in Allah and the last day to practice hidad
for more than three nights on a dead person, except for her husband, four
months and ten days --bukhari
v. Can you wear jewelry in hidaad: SAW forbade from wearing jewelry but qurtubi
said if her custom is to wear a lot dont wear it
vi. can you give salaams to SAWs grave as a woman? Its blocked off so youre not
allowed to but YES theoretically you can stop by and say salaam. Unless its too
crowded dont push ppl cause he said anywhere you give him salaams it will
reach him as if you are in front of him.
vii. The dad is punished by the familys weeping over himthis is authentic. Aisha
rejected it but she said may Allah forgive you ibn 3umar and said it is the
disbeliever cause the mumin cannot be punished by anyones actions (she used
the aya wala taziru waaziratun wizra ukhra)
1. But if what she said is correct she should not say the kafir gets this
cause Allah is just with both Muslim and kafir.
2. SAW said that and so many others heard him say that.
3. The 3ulama said 3 things
a. if he requested in his will for that to happen then he will be
punished
b. or if he knows they will do it and he didnt stop them he will be
punished.
c. Yu3athabu-punished is a wrong translation. Suffer is better
cause he will suffer when he hears them cry about him. The
Shaykh prefers this. Just like SAW said traveling is 3athab-not
punishment but suffering. The deceased can hear them crying
and it will make him sad.
viii. You can wash a dead body if you have your period
ix. You can wash your spouse
1. Hanafis and sufyan aththawri say you cant wash your wife cause shes
not your wife anymore after she dies. But he does inherit her so that
doesnt make sense and why would she have to do hidaad or why would
they be together in jannah if she is no longer his wife?
a. They say cause when she dies you can marry her sister but not
that strong of an evidence. You are allowed to but thats for
different reasons that dont apply here
x. Can she wash the body of her mahram
1. Cause you can cover the 3awrah yes
2. No casue SAW didnt wash his daughters bodies and he asked women to
do it. thats not enough evidence to draw a ruling though
3. A wife of SAW said she and her co wives wished they washed SAW
Asma was washed by Abu bakr
xi. SAW sees a woman competing with him to get into janna and its cause she took
care of her kids after the husband died and raised them well and didnt get
married-thought its not bad to get marrid again--(just an anecdote given for
someone to have patience in times of hardship)
e) The rulings regarding zakah, sadaqah, sawm, and hajj
a. Zakah and sadaqah
i. Giving sadaqa is a sign of eman. The best donors were women. SAW used to say
oh women donate. They would take off their jewelry a give it.
ii. SAW asked a lady with gold braclets if she pay zakat and she disnt and he told
her thy would be replaced with one of fire and she tok them off and gave them
away.
iii. In the aya they give zakah and offer siyaam (as signs of iman). Another aya
mentioned women donors specifically (cause men give on their behalf but they
still need to). Qard-loan. Allah uses this work for the charity cause the loan must
be given back and it will in the dunya and aakhriah.
1. The ayah referred to were 9;60, 33;35, and 57;18.
iv. SAW said oh women give in charity, for I have seen you the majority if the
people of the hellfire. They asked what is the reason? he replied you curse
frequently and are ungrateful to your husbands.---al-bukhari
v. Learn how to give. Some of the sahaba used to not have something and would
give an onion or one guy crushed a cookie for the ants. Some women used to
work to be able to donate more.
vi. Questions:
1. Give zakah to parents husband and children who are poor or in debt?
a. Majority say no to father cause you have to support them
already.
b. Ibn taymiyya and other said: there is no proof that you have to
financially support your dad. SAW said the best sadaqa (which
also includes zakah) is what you give to your family and SAW
never excluded parents. Arent they more deserving?
c. Shaykh says you can if you have extra money but if you want to
be on the safe side dont but give them sadaqa
2. Abdullah ibn mas3oods wife worked and complained she was
supporting her husband and his son and SAW told her that okay (super
paraphrased)
a. From that you can give to kid
3. Dont need husbands permission to give away your money and in the
ahadith the women would take off their jewelry on the spot and give it
4. Can you give your husbands money w/o permission? Yes as long as you
dont corrupt his wealth (will cause him to be in debt or financially
unstable). Even a servant can give from the master with the same ruling
as above.
a. What if he doesnt feel comfortable with the org or ppl you are
giving it to? Then take permission but if its your money you can
5. It is sufficient for the husband to give zakah on your behalf and your
father
6. Zakah is obligated on you but your dad can pay it for you even if they
live far from you but its your responsibility to make sure it gets done
7. Do you have to give zakah on dowry that you havent gotten yet? 2
opinion
a. If your husband is rich and he can afford to pay you, you give
zakah even if it is for the divorce dowry
b. No. there isnt zakah on debt regardless if hes rich or not
(wealth can go anytime).
8. What about zakah on jewlry that you have, do you need to pay? Yes!
Jewelry only means gold and silver not diamond or white gold. Can give
cash or from the gold. Can delay it if theres a need for it (waiting for
cash and dont want to lose your jewelry but only delay like 1 week or
few days)
a. Hanafi: yes cause its a gold you own and Allah said those who
posses gold also the hadith of that lady who gave her
bracelets, and another hadith of the same idea with his wife
wearing new jewelry.
b. Shafi3i and hanabihal: no. cause it takes the ruling of your
clothes and car/horse/etc.
9. No specific time is needed to pay this zakat but has to be the same time
each year according to the lunar calendar.
b. Fasting
i. Greatest acts of worship. SAW said nothing similar in reward to fasting.
1. SAW divorced hafsa nd was told by jibril that Allah ordered him to take
her back, for she was one who fasted and prayed frequentlyalhakim
in al-mustadrak
2. SAW said fasting is a protection and absolute fortification from the
hellfire-ahmad
3. whoever fasts one day for the sake of Allah, Allah will keep his face
safely away from the hellfire at a distance of 70yearsbukhari and
Muslim
ii. Not permissible for a menstruating woman or one with post natal bleeding to
fast.
iii. You cant fast voluntary fasts w/o husbands permission but if he wont care
then you dont have to ask for permission.
1. In bukhri SAW said a woman should not fast while her husband is
present except with his permission.
iv. You can taste food. Dont swallow though. Also allowed for men to do it
v. You can do i3tikaaf with permission of wali and as long as its safe.
c. Hajj
i. Aisha said o messenger of Allah, we hear that jihad is the best of deeds, should
we not then participate in jihad? he said no, but the best jihad is a pure,
accepted hajj--bukhari
ii. Its a must. SAW would take his wives. SAW said you cant wear niqab or gloves
in hajj (in bukhari) if you cover and men pass by the wives used to just cover
quick. This is while she is in the state of ihramreported in ahmad
iii. Dont need to do the final tawaf if on period or have post partum bleeding
based in hadith in bukhari and Muslim
iv. Questions:
1. If I missed fasting and didnt make up when I was young what do I do?
Repent and dont need to make them up unless after the repentance
additional day were missed.
2. If I dont remember how many I missed? Go with what is certain if 5 or 6
go with six cause ur sure no more than 6.
3. Do you have to make them up as soon as you can? No Aisha would
delay till sha3baan.
4. What if ramadan comes and I didnt make up my days? Its a sin and
repent and make up asap and add to new days (ie from the ramadan
that you are now in) you have to make up. Ibn abbas said give a fee of
feeding one poor person for everyday you missed.
5. What should a pregnant and brestfeeding mom do about missed days?
a. Some say make them up whenever you can. The Shaykh says
you make them up.
b. Some say you dont have to but feed one poor person for each
day you missed
c. Ibn abbass said if you missed cause of your own health then you
make up those day and if you break cause you worry about the
child ---feeding/making milk---then make up and feed a poor
person.
6. Do you carry the penalty of sex with your husband during the day of
ramadan if he pushed for it? A guy told SAW about this and SAW only
gave the penalty to the guy. But if she seduced him then thats different
7. Can I openly eat and drink if im not fasting? Yes but you might send the
worng message so think about it. in a Muslim country you shouldnt
cause you are respecting those fasting the same with the Masjid.
8. Can I fast 6 days of shawal before missed ramadan days (so many dont
consider fsting these days to be sunnah cause theres a debate if its
based on a statement from SAW or a statement from a shahabi)? Yes
you can.
a. Some say that 30 plus 6 times 10 is the whole year and if you
dont make those up it will be less but he says if you make it up
late its the same so that doesnt make sense
b. 3ashura can be fasted too before you fast your make up days
9. Do you need permission to go to hajj from your husband? Can he
prevent you from going?
a. No he doesnt have the power to cause its wajib
b. Unless she already went cause this is voluntary now not wajib
10. CaN I TRAVEL W/O a mahram?
a. Imam ahmad and shafi3i: narrated by uman that SAWs wifes
went to hajj w/o mahrum and they didnt stop them. Not
obligated to thought
b. Hanafis and hamabalis: used the travel without a mahram
hadith and no matter how safe things can happen. (I think this
means they forbade it but Allahu a3lam)
11. Your husband is not obligated to take you to hajj
12. If youre a new Muslim and not married you dont need a mahrum
13. You can wear whatever you want in whatever color to hajj.
14. You can do it before marriage
15. How should a woman cut her hair at the end of ihram? If in braid cut the
tip if not cut a little from each section.
16. Can you walk fast during tawaf and sa3y? no from aishas report
17. Can a women raise her voice with talbiyah (labbak allahummah labbayk)
a. Some say no casue in salah you clap not saying subhanallah out
loud like men. Some say there consensus
b. Ibn hazam, and ibn taymiyya and Others say no you can cause
SAW said the best way is to make it loud and he didnt give an
exception for only men. Also if she sees someone bothering her
because of it move over. Someone heard Aisha doing it loud and
thats also proof

CHAPTER THREE
RULINGS RELATED TO CLOTHINGS AND BEAUTIFICATION
a) General guidelines:
a. The goals and principles of shari3ah that govern this area. If you understanding these
you will be able to deal with new issues that come up. This doesnt make us a faqih but
it will help us understand the rulings. These principles are:
i. Prohibition and permissibility are sole rights of Allah swt.
1. 16;116 and do not say about what your tongues assert of untruth, this
is lawful and this is unlawful, to invent falsehood about Allah. Indeed,
those who invent falsegood about Allah will not succeed.
2. You need proof from the quran and sunnah. Is consensus a proof? Well
it has to be based on a textual proof. Not based on personal preference
like some who say Yea its bad but I dont see the big deal.
ii. The realm of halal is vast and options are plenty. There is no need to delve into
the haram and doubtful matters
iii. Matters are by their objectives and intentions
1. Example: a girl asks the Shaykh can I have colored contacts? He says yes
and she tricked a guy to marry her with that fake color. Also SAW told
an old white haired man to die his hair but not black and the 3ulamaa
say cause it could be deceiving. But young men can die it black.
iv. The default ruling regarding clothing and beautification is that all is permissible
except that which is prohibited in the shari3ah
v. One of the goals of shari3ah is to cover 3awrah and one of the goals of shaytan
is to expose them
1. Allah swt said the shaytan inspired adam and eve and tried to get them
to expose themselves 7;20.
vi. One of the goals of shari3ah is to establish modestly and morality in society
vii. The shari3ah rules are intended to help a person control his/her desires and
channel them in the right directions, not to be controlled by them
1. Beautification is a desire
viii. Of the goals of shari3ah is beauty for Allah swt is beautiful and love beauty
1. It doenst want you to look ugly and dirty. Modesty doesnt equal ugly
2. Allah is beautiful and love beauty. Iron your clothes for example
ix. The presences of difficulty requires that allowance be made to effect ease
x. One must not imitate non-believers or evildoers-fasiq- in what is known to be
specific to them. Imitation on the other exterior level often affects the interior
1. Ibn abi 3aas was seen by SAW and was told to take off his two thawbs
cause the non Muslims wear that
a. Cant wear cross, star of david, hijab like a nuns; cant copy
people like lady gaga
xi. A women must not imitate what is specific to a male and vice versa
1. What will define this is for man not women? The culture
xii. Common culture is a reference as long as it is within the guidelines of the
shari3ah
xiii. The shari3ah came with rulings to block the means to haraam. SaddI-dharaaI,
closing the door against the possibility of committing illegal things. Sometimes a
permissible act may be forbidden by the law because it leads or may most
probably lead to illegal actions
1. People take to an extreme level though
xiv. Extravagance and wasting money are prohibited in the shari3ah
1. o children of Adam, take your adornment at every Masjid, and eat and
drink, but be not excessive. Indeed, he likes not those who commit
excess 7;31
2. SAW said eat and drink and dress and give in charity without
excessiveness or arrogance al-nasai
xv. Wasting time is prohibited in the shari3ah
b) Rules regarding womens clothing:
a. Hijab was made an obligation upon believing women once they reach the age of puberty
i. o prophet tell your wives and your daughters and the women of the believers
to bring down over themselves (part) of their outer garments. That is more
suitable that they will be known and not be abused. And ever is Allah forgiving
and merciful33;59. so they will be known and not abused.what does that
mean?
1. Some scholars say it was ordered to not show beauty (in the first stage
they had a head thing but neck and chest was out) then the next aya
wala yadribna.draw it closed to cover chest and cover necklace and
some say it talks about covering the face and other say that was only for
SAWs wife.
ii. and abide in your houses and do not display yourselves as (was) the display of
the former times of ignorance. 33;33.
iii. Covering the face?
1. Recommended by most if you feel safe. If you see someone whose
checking you out or giving you a dirty look you need to cover your face
b. The scholars have mentioned the following conditions regarding hijab:
i. The garment itself must be intrinsically be lawful
ii. It covers the body, with a difference of opinion amongst the scholars regarding
the face and hands, and abu hanifa and one narration of malik adds the feet.
Abu yusuf also added the lower arm
iii. It may not be transparent or tight so that it details any part of the body
iv. It cannot be particularly eye-catching
v. It should not resemble clothing that is specific to non-Muslims, evil doers-fasiq,
or men
vi. It may not be perfumed,
vii. It should not be a dress of shuhrah-something that makes a person ostensible
have no clue what that means. The prophet SAW said he who wears a garment
of shuhrah, Allah will dress him is a garment of humiliation and fire abu dawud.
c. Attabarruj is to display the beauty that Allah commanded be covered in public and this
act is a sin in Islam. When umaymah pledges allegiance to SAW in Islam he said I will
take your pledge that you will not commit shirk, that you will not steal, that you will not
commit adultery, that you will not kill your child, that you will not make a false claim,
that you will not wail (in mourning), that you will not display your beauty as was the
display of the former times of ignorance. Ahmad
d. SAW said of the people of hell, there are two types whom I have never seenthe
second one, the women who would be naked in spite of being dressed, who are
seduced to wrong paths and seduce others with their hair high like humps. These
women would not get into paradise and they would not perceive its oder, although its
fragrance can be perceived from such and such distanceMuslim
e. He SAW also said the example of the one who flaunts her beauty to other than her
family, she will be in complete darkness with no light on the day of resurrection al-
tirmidhi
c) Beautification:
a. SAW said Allah is beautiful and he loves beautyMuslim
b. SAW said ten things are part of the fitrah: cutting the moustache, letting the beard
grow, using siwak-tooth stick-, snuffing up water into the nose, butting the nails,
washing the finger-joints, plucking the armpit hairs, shaving the pubes and washing the
private parts after relieving oneself. zakariyya said, musab said I have forgotten the
tenth but it hink it was rinsing the mouth-Muslim
i. These have to do with keeping fresh
c. SAW said whoever grows his hair should take good care of it-abu dawud
d. 3alwamah related that Abdullah said Allah curses women who tattoo and are tattooed,
women who pluck their eyebrows, and women who file their teeth to make gaps for
beauty, altering Allahs creation. Why should I not curse those whom the prophet SAW
cursed when that is iin the book of Allah. so take what the messenger assigns you and
deny yourself that which he withholds from you 59;6 bukhari and Muslim
e. SAW was reported to have cursed the women who joins on hairs and the one who has it
joined on al bukhari
i. Meaning extensions, etc
