Application for bail under Section 167(2) of the Code of Criminal Procedure
Respectfully Showeth:
1.

That the XYZ was arrested for the aforesaid offences by the police of Police
Station_______.

2.

That the accused was produced before this Honble Court on_________and
was remanded to judicial custody on the same day. Since then the accused/
applicant is in judicial custody.

3.

That the statutory period of 60/90 days for the presentation of challan/ report
under S. 173 Cr.P.C has elapsed, but no such report has yet been filed by the
police before this Honble Court.

4.

That the accused/ applicant has become entitled to grant of concession of

bail under S. 167(2) Cr.P.C as the challan has not been presented in the
statutory period.

5.

That the accused will abide by all the conditions of bail as fixed by this
Honble Court.
It is therefore respectfully prayed that the instant

application for grant of concession of bail may kindly be allowed and the accused/
applicant be released on bail during the pendency of trial in the interest of justice.
