AMENDMENT TO MEMORANDUM OF UNDERSTANDING

BETWEEN THE PLANNING AND DEVELOPMENT SERVICES DEPARTMENT


AND THE PUBLIC WORKS DEPARTMENT

REGARDING PROJECT VESTING UNDER THE OLD CRITICAL AREAS
REGULATIONS

The Memorandum of Understanding (MOU) documents projects and activities that have been deemed
to be vested under the version of the Critical Areas Regulations in effect prior to October 1, 2007.

In January 2006, a landslide occurred along the North Fork of the Stillaguamish River, since known as the
Steelhead Haven Landslide. The County, along with the Corps of Engineers, took emergency actions to
open the river channel after it was completely blocked by the landslide. As part of the post-permitting
process, the County is required to mitigate for the emergency actions. The emergency actions and the
required mitigation were inadvertently left out of the original MOU, dated 2-6-08.

This document amends the original MOU to include the Steelhead Haven Landslide emergency and
mitigation actions with project numbers WA9022 and RR49022.
