Legal Realism on Stare Decisis

Legal realism emphasizes the indeterminacy or looseness of the use of Stare Decisis. It
states that future decisions are not binding with past ones. Because the facts in one case are
entirely different from the facts in other cases.
Hence, it states to reject what happened in the prior case. Society changes faster than
law.

A cases predictability is based on the facts of that case, not on decisions of prior
cases.
American Realism
One judge may render a different judgment compared to the other. A judges decisions
are the outcome of his personal history.
