The Constitution and Its Ever Lasting Effect
Imagine you have found the love of your life. You're ready to start your life together and
get married. Yet, there is a problem, it is illegal for you to be married. Homosexual marriage is a
highly debated topic as it conflicts with some religions ideas of marriage. However, the preamble
points to an acceptance of homosexual marriage through the verbiage of several phrases.
Marriage itself falls under the preambles right to secure the blessing of liberty and to insure
domestic tranquility, and is completely and undeniably constitutional whether homesexual or
heterosexual.
Preamble
The preamble is essentially a summary of the constitution. It states we must create a
better place to live, give everyone fair rights and provide a peaceful life/home. We must also
help protect each other, get paid and rewarded for our work, and make life easier for ourselves
and future generations by enacting and creating this constitution for everyone. The preamble was
designed to provide the people with a synopsis of the constitution so it could be understood
without being read word by word. The preamble is written in simpler terms and thus is easier for
the average person to understand. It was created to replace the Articles of Confederation, as they
were not as efficient.
Deciphering the Preamble

Howell2

To gain a more indepth understanding of the preamble we can refer to several phrases
and decipher the meaning and implication of the phrase. The line We the People, is to include
everyone as identical and equal, no matter rich or poor, and now male or female, black or white,
gay or straight. The next line is In order to form a more perfect union, which means to make a
united and more efficient union as a whole. Third, establish justice, means fairness for all and
every individual will be guaranteed their rights . Insure domestic tranquility, was added to
maintain the peace between citizens and the state. Next, Provide for the common defence, this
means all the states will unite and fight against any foreign or domestic threat as individual states
were not strong enough to fight a war alone. Promote the general welfare, requires the
government to assist as much as possible to ensure the well being of the people and to obtain the
opportunity to earn money and prosper. Then, and secure the blessings of liberty to us and our
prosperity, meaning to protect the people from a corrupt government and to maintain the
liberties this country has worked so hard for. Last, Do ordain and establish this constitution for
the United States of America this has been said to be one of the most powerful phrases of the
preamble as it state this agreement was made by the people for the people. In other words, the
government is made up by the people and therefore the people have the all the power.
Why Homosexual Marriage is Important
It is easy to see the preamble was written to guarantee equal rights and liberties for all
citizens and to make our country stronger, united and just. With all this considered, we can not
deny the right of marriage to homosexual couples. We can see Homosexual marriage should be
legal as it is undeniably constitutional, and therefore the marriage should be perceived by law as
valid. According to, http://gaymarriage.procon.org/, 52 percent of the population supports
homosexual marriage, so it is unacceptable as to why it is still illegal. Additionally, the site states

Howell3

support has increased 1 to 1.5 per year, proving it is likely even more of the population will
approve the marriages by next year. Currently 32 states have approved same sex marriage. I
believe over the next several years more and more states will legalize same sex marriage as it
clearly unconstitutional to deny citizens their right to establish justice, Insure domestic
tranquility, and ...secure the blessings of liberty to us and our prosperity.
*This chart shows the positive and peaceful color symbolism the homosexual
community has adopted as a symbol of homosexual pride during the homosexual movement.

Famous Homosexuals/Supporters
One of the most influential artists in the world, Leonardo Da Vinci (creator of the Mona

Lisa), was accused of being homosexual, along with a few of his young proteges. Leonardo had
no wife, no kids and raised many young boys. As a result of being accused of being a
homosexual, many people thought he was crazy and ignored his astonishing art. According to
http://www.bnl.gov/bera/activities/globe/leonardo_da_vinci.htm ,

during the renassiance period

Florentines did not make the distinctions we make about sexuality. It was even common at the
time for young men to get into homosexual relationships. Although the general population at the
time viewed homosexuality as wrong and illegal. Today, homosexulaity is gaining acceptance.
There are now songs about accepting homosexuality and what it is like to love the same gender,

Howell4

such as Same Love, by Macklemore, Girls/Girls/Boys, by Panic! at the Disco, and Stay
with Me, by Sam Smith, which all discuss the importance and struggle of homosexuality.

*This chart shows same sex marriage is gaining acceptance.

Although the preamble also allows citizens to practice religion without persecution. I do
not believe the preamble gives religious groups the right to influence laws and deny others rights
based on religious beliefs. This is why we need to have a separation of church and state. Once
religious beliefs impact human rights then religion has crossed the line. Consequently, we should
not take into consideration religious beliefs when debating homosexual marriage.
Conclusion
Homosexual marriage is still a highly debated topic as it conflicts with some religions
ideas of marriage. However, the preamble points to an acceptance of homosexual marriage
through the verbiage of several phrases. Marriage itself falls under the preambles right to secure
the blessing of liberty and to insure domestic tranquility, and is completely and undeniably
constitutional whether homesexual or heterosexual. Some of the worlds greatest people have
been homosexual and denied their right to marry which is undoubtedly unconstitutional.
However, it appears the acceptance of same sex marriage is gaining ground with 32 states now

Howell5

approving the marriages. In addition, the general population's attitudes about same sex marriage
is changing and becoming more accepting. I believe it is only a matter of time before
homosexuals are granted the same rights as hetrosexual citizens of America as it is their
constitutional right.
