that the matter is under active consideration and from the concerned

Administration Department proposals are being sent to the Law
Department for taking necessary steps. He prays for four weeks
time for the aforesaid purpose.
Shri Naman Nagrath, Ld. Sr. Counsel appearing on behalf of
the interveners in the matter submitted that as a result of the
pendency of the matter before this Tribunal, their applications are
not being processed.
Since the matter is before the Government, it is for the
Government to expedite the matter at its end so that necessary
directions may be issued by the concerned officer on the
applications and deal with them in accordance with law.

This application has been filed by the MPPCB giving the
details of the pending cases in compliance of our directions dated

01.08.2014. It is submitted that there are in all about 311 cases


pending in various Courts in the State and about 60 cases are more
than 10 years old.
We would impress upon the Member Secretary, MPPCB to
take up the matter with the Honble High Court for necessary
directions to expedite the aforesaid cases. The very purpose of
institution of such cases for violation of environmental laws and
there being a deterrent with violation, is lost if cases are kept
pending for such a long time. The MPPCB must also insist upon its
Law Officers not to seek unnecessary adjournment and ensure
whatever is required to be done on the part of the PCB for the
progress of the trial of these cases, the same must be done on the
date fixed in such cases.
