Chapter III: ACTION, CAUSES OF ACTION AND PARTIES

Action: Legal and formal demand of ones right from another person made and insisted upon in a
court of justice.
- Action and suit are synonymous.
CIVIL ACTION: One by which a party sues another for the enforcement or protection of a right or the
prevention or redress of a wrong.
CRIMINAL ACTION: State prosecutes a person for an act or omission punishable by law.
Real and Personal Actions:
1. Real: When it affect s title to or possession of real property or an interest therein. All other
actions are personal actions
2. Real: Founded upon the privity of real estate.
