I am at the end of my patience on this matter and see this as nothing other than stonewalling me and an attempt to violate my First
Amendment Rights as well as multiple Freedom of Information laws. Some of which I believe to border on criminal acts.
Additionally, it has come to my attention that ALL members of the City Council, the City Manager, the City Clerk and the City Attorney are all
aware of this attempt to cover-up this incident and have done so in a concerted effort to deny the release and access to public records. It has
also come to my attention the aforementioned City Officials are aware of the editing / altering of public records that the City disclosed on May
13th - also enclosed.
In accordance with 45-11-1. Offenses involving public records, documents, and other items, may also be a criminal act.

(a) If any public officer or other person shall steal, embezzle, alter, corrupt, withdraw, falsify, or

I am requesting the immediate release of all of the records to which I have filed Open Records Requests, which involve J Max Davis spraying
a household product on a City Employee, the resulting investigation, and all correspondence concerning this matter as outlined in my requests

Brookhaven, GA, May 13, 2015 At the direction of the city manager, the city attorney on March 17, 2015, commenced
the investigation of an incident where an aerosol can was sprayed in the vicinity of two
city employees by the mayor. After interviewing the two employees, the mayor, the city
manager and the human resources director, Mr. Tom Kurrie has concluded that there
was no intentional conduct that rose to the level of harassment of any type. Neither of
the employees involved claimed or inferred that this incident involving the mayor was
sexual or harassing in nature. Mayor J. Max Davis said, "I have spoken with both
employees present and they have accepted the sincere apology that I offered. The
action was innocent and was not intended to bring discomfort."
Mr. Kurrie also said that "There is not presently nor was there any investigation of
sexual harassment being conducted by the City of Brookhaven. Furthermore, there has
been no claim or complaint filed by anyone, employee or otherwise, alleging sexual
harassment by the Mayor."

Thank you for meeting with me this morning and providing the briefing of events. Upon further
reflection, after reviewing the released redacted document in comparison to the e-mail you
showed me on paper this morning (prior to our meeting I hadn't seen the document in its
entirety), I believe that we are in violation of Title 45 Chapter 11 section 1 of the Georgia Code
because the released document was altered and there were several paragraphs not
included. Also, I see no reason for any references of me to be redacted. Unless there is a legal
reason that I am not aware of and since I am not in possession of the e-mail, I believe that the
document should be released in full.
The citizens want an open and transparent government.

I am disheartened to read the news of the day on The Brookhaven Post. Please take all claims of
sexual harassment seriously and investigate thoroughly and report to the public completely all
findings. If there are no claims of sexual harassment to the City of Brookhaven HR department or the
EEOC as of today 13 May 2015, please explain why the City of Brookhaven's Communications
director is making such statements to the press. If Megan Mattencci made a mistake ALL media
outlets need to be notified before this goes to print.
This needs much attention at many levels. Please investigate the claims of sexual harassment and
Megan Mattencci statements to the press as a official spokes person of the City of Brookhaven.
If Mayor Davis is found to have sexually harassed City employees after due process I expect him to
resign immediately.
If Megan Mattencci is found to have provided inaccurate information to the press about an
investigation into the actions of an elected official of the City of Brookhaven after due process is
granted to her, her employment should be terminated.
Lets be fair to Mayor J. Max Davis and Megan Mattencci.

All,
After reading Mr. Edwards' response, I have some serious concerns. As I stated in a previous email, I
believe that our best course of action is to release all e-mails. On its face, it looks like the city is trying to
hide something.
I am particularly bothered that my name has been redacted, since it looks like I have something to hide.
I ask that any references to me not be redacted. It is my right to waive any right to privacy I might have.
He asserts "that additional material in this city document has been made to appear as if it did not
exist." I don't have a copy of the e-mail, but I do remember that several paragraphs were omitted
rather than merely redacted from the e-mail that I was shown, so it seems that his assertion is true.
I stress the fact that it looks like we have something to hide, and it seems that this will all get released
eventually. I think it's best to "rip the band-aid" now.
As public officials, I don't believe we have any right to privacy. I ask that we release all requested
documents immediately.

I cannot yet comment on your citations in paragraphs 2 and 3 because the city has not produced any
documents in response to my request (save one city policy), so I do not have the benefit of knowing
what you plan to withhold or redact under those citations. When the city does produce records, if you
withhold records or make redactions, I ask that in each case you specify what type of information is
being withheld under these code sections, subsections and paragraphs.
As to paragraph 4, concerning the email that you have previously released in heavily-redacted form, the
city will be in violation of the Georgia Open Records Act if it continues to withhold that record in
unaltered form. You may not cite privacy to withhold records generated by city email or in the
conducting of city business. Contrary to your assertion in subparagraph (b)(i), city emails or emails
produced in conducting city business most certainly are public records as described in 50-18-70(b)(2).
Neither that citation nor the Georgia Constitution may be used to deny public access. You are suggesting
that a communication between the city manager and the human resources director, concerning in part
an incident involving the mayor and an employee that took place in the city office space, is personal in
nature and not part of city business. This seems disingenuous at best. I am also concerned that
additional material in this city document has been made to appear as if it did not exist.
You also cite 50-18-72(a)(2), but an email concerning the mayors behavior toward a female city
employee is clearly not a medical or veterinary record. Nor could the remainder of the email constitute
such a record, for that matter. You have no basis for redacting employees names, city officials names
or details of the incident and ensuing complaint. And the mere fact that Mr. Kurrie has discussed this
matter does not allow the city to withhold these public documents under attorney-client privilege.
I am highly concerned about the citys intentions in responding to my open records request filed 8
business days ago. I have therefore alerted attorneys for The Atlanta Journal-Constitution and Channel 2
Action News, and they will be following up early next week.
Again, I strongly ask that you reconsider and make all of the records I have requested immediately
available, in accordance with the Georgia Open Records Act.

My apology for my tardiness to responding to you because of my scheduling issues and researching the
disclosure issues:
Ms. Hiott is compiling the list of the emails and other documents requested by you. I will be completing
my investigative memorandum of finding of facts and conclusions of law with respect to the aerosol
spray incident hopefully by the end of this week.
The following will not be disclosed or redacted for the reasons cited below:
1.
All documents relating to any complaint filed with the EEOC naming the City. They are not
required to be disclosed during the period of investigation by the EEOC. See, OCGA Section 5018-72(1). As I am sure you are aware that federal law requires all matters under consideration
by the EEOC to be kept confidential. While such regulation is directed to the EEOC, absent any
case law in Georgia to the contrary, we believe that that this exemption from disclosure of
matters involving the EEOC is applicable with respect to governmental entities in Georgia.
2. The items identified in OCGA Sections 50-18-72(a)(20)(A) and 50-18-72(a)(21) will be redacted.
3. Records containing communications subject to the attorney client privilege will not be
disclosed.
4. Other than to the extent previously disclosed, the contents of the email dated March 18, 2015
at 10:46 AM from Marie Garrett to Rick Stone are not subject to disclosure:
a. The paragraph of the email describing the aerosol spray incident has been and will
continue to be redacted to avoid disclosure that would invade an individuals
privacy. Such individuals have a legitimate expectation of privacy and that privacy
interest outweighs the public need for disclosure. See, OCGA Section 50-18-72(a)(2) and
Article I, Section I and Paragraph I of the Georgia Constitution.
b. The remainder of the document is not subject to disclosure:
i. The subject matter is not a public record within the
meaning of OCGA Section 50-18-70(b)(2). This material is personal in nature
and was not prepared in the performance of a service or function for or on
behalf of the agency.
ii. If the subject matter is determined to be a public
record:
1. The subject matter had been discussed privately with the City Attorney
on March 17 and is subject to the attorney client privilege pursuant to
OCGA Section 50-18-72(a)(41).
2. The subject matter if disclosed would invade Ms. Garretts right to
privacy. See, OCGA Section 50-18-72(a)(2) and Article I, Section I and

As you know, the Act does not require an agency to impose fees for providing access to public records,

an agency shall utilize the most economical means reasonably calculated to identify and produce
responsive, nonexcluded documents. . [T]he charge for the search, retrieval, or redaction of records
shall not exceed the prorated hourly salary of the lowest paid full-time employee who, in the reasonable
discretion of the custodian of the records, has the necessary skill and training to perform the request;
