conflict of interest for Candace Brewster-Gayoso to litigate cases in front of Judge Oliver
Lynch for the following 4 cases:

Dear Commission on Judicial Qualifications:

I would like to make a complaint against Honorable Lori Bolton Fleming in case number
lSCV4g because it is a conflict of interest for her to hear the appeal of 201SCY4gbecause
Lori Fleming is biased and prejudiced against me for signing a grand [ury petition that is
going around Crawford County to oust all 11th judicial district judges including her and her
father-in-law Robert Fleming.
I also think it is a conflict of interest for Lori Fleming to hear this case because of her
religious conflict of interest ties to the Lady of Lourdes Church with city prosecuting
attorney John Mazurek who was the city prosecutor in my criminal part of this DUI appeal.
First off Mr. John Mazurek and Lori Fleming are both members of the private "CRESTWOOD
COUNTRY CLUB" and therefore Judge Fleming would never rule against her private
member in court. Second, they both are members of the same "Our Lady of Lourdes"
church where Lori Fleming's father-in-law Robert Fleming and mother-in-law Peggy
Fleming are both Eucharistic ministers with John Mazurek's wife Diann Mazurek on
November 17-18 of 2012 at 9:00 was Diann Mazurek and 10:30 was Bob and Peggy
Fleming. On January 26-27 of 2013 the Eucharistic Ministers at 10:30 were Bob and Peggy
Fleming and Diann Mazurek as well. Lori Fleming's husband attorney Kyle Fleming is also

on the "Pastorial Council" and a Eucharistic minister at the same church wi Diann
Mazurek as well. Honorable Lori Fleming is also a lecturer at the same-church and they all
donate money to the "PARISH"which I think is an economic conflict of interest. Crawford
County Sheriff Dan Peak is a member of the same church along with Crawford County
Deputy Stu Hite who Lori Fleming is also members with at Crestwood Country Club. With
all these affiliations with the prosecution and Crawford County Sheriffs ~partment it
shows biased and prejudiced for the prosecution against me.
Judge Kurtis Loy is also an "ORDAINEDMINISTER"for the ST. Peter's Episcopal Church so
it seems that the residents of Crawford County are all being "DISCRIMINATEDAGAINST
ECONOMiCALLy,RACIALLY,
ANDRELiGiOUSLY;'by the fact that we have never had a
minority judge that was not Catholic and that is yet another reason why the "GRANDJURY
PETITION"to oust all 11th judicial judges is being passed around Crawford County,
I have also been discriminated against because my girlfriend of over sixteen (16) years is
African American and she and I have been discriminated against for years because of the
racial prejudice in Crawford and the fact that we have never had a judge who was not white
and who was not Catholic and that is "RACIALANDRELIGIOUSDISCRIMINATlON".Last I
checked this was "2015" not 1815, didn't the CivilWar end in 1865????
It also makes it an economic conflict of interest for Judge Lori Fleming to hear any
attorney's cases that attend "Our Lady of Lourdes Church" because her mother in-law
Peggy Fleming teaches at ST. Mary's Colgan and her retirement is with the Catholic Diocese
and her retirement goes up the more members of the church donate to the "PARISH"!!!
The fact that John Mazurek is the head of the "Knights of Columbus" is yet another layer of
conflict of interest as the Fleming family has been members of that private organization as
well. Another conflict of interest is the fact that John Mazurek is a prosecuting attorney for
the city of Pittsburg and Lori Fleming was the assistant prosecutor for Crawf9rd County in
2002 and she is biased and prejudiced for prosecuting attorneys. John Mazur.ek is also the
city judge in Cherokee County and yet that is just another conflict of interest. Another
conflict of interest is the fact that Lori Fleming is biased for prosecuting attorneys which
"John Mazurek is" because her husband Kyle Fleming was the campaign manager for

"Crawford County Prosecuting attorney Michael Gayoso" which I think it is wrong for her to
hear any of his cases as well. Mr. Gayoso is also a member of the same Lady:OfLourdes
church as Judge Fleming and they have even performed in a band together called "TEAM
JESUS".
Judge Fleming does hear the cases of Michael Gayoso's office because she is ~e criminal
judge and I feel that is a conflict of interest as well and maybe that is the reasen that Mr.
Gayoso's office has only had 1 jury trial I think since the man came into office is because the
DUIprocess is all just a little money making scam. It seems Eucharistic minister Stu Hite of

Crawford County Sheriffs Department and fellow Lady of Lourdes Member Sheriff Dan
Peak arrests people for DUI,then Kyle Fleming acts like he is suppose to be a-defense
attorney but in reality he is just there to work out an easy plea bargain since his wife is the
criminal judge and his wife is in the same band as the county prosecutor Michael Gayoso
who Kyle Fleming is the campaign manager for and since Kyle Fleming hangs out at private
Crestwood parties with Stu Hite makes this whole DUImoney making SCA~ "EXTREMELY
UNETHICAL"!!!!
I also just recently mailed in a complaint on Crawford County Attorney Michael Gayoso for
failing to pay me restitution in case number 13CR144P "STATEOF KANSASv. EDWINA
FONSECA"where my van was shot up and vandalized but Mr. Gayoso failed,to do his job
and failed to pay me restitution. I have enclosed a copy of that complaint thft was sent to
the "Officeof Disciplinary Administrator" with this complaint as weH.andMr. Gayoso has
been asked by the "Officeof Disciplinary Administrator" to respond to my complaint.
I think it is a total conflict of interest for Lori Fleming to be the criminal judge when the
criminal p~osecutor ~ichael Gayoso's campaign manger was her h~sband, d~ense attorney
Kyle Flemmg. Accordmg to the 2008 St. Mary's Colgan Newsletter It ShOW5-th~ta "BAND"
that performs at Youth and Parish events by the name of "TEAMJESUS"consists of Lori
Fleming, Michael Gayoso, and attorney Steve Stockard and it should be a conflict of interest
for Lori Fleming to hear any case litigated by Michael Gayoso or Steve Stockard. It should
also.be another layer of conflict of interest is the fact that Mr. Gayoso mar~d CandaceBrewster-Gayoso and Candace Brewster's uncle is Daniel Brewster-and her fpther is David
Brewster who were both Iljudicial district judges as well. Take in the fact that according
to Lori Fleming's father-in-law Robert Fleming's financial disclosure report form that
ShDWSthat Loir Fleming's father-in-law has a CDwith Daniel Brewster which ShDWSthat
the Flemings and Brewster's have known each other for years and it is an eC~lOmic conflict
of interest for Judge Fleming to. hear any cases that Michael Gayoso prosecute,.
The committee should also check into the cases of 11thjudicial judge Oliver Lynch and
attorney Candace Brewster Gayoso for conflicts of interest in case number 1998DMI0l
where Candace Brewster Gayoso is the attorney and a Brewster is the judge Which is either
her uncle or father. Case number 2005CR114 shows that the judge is Judge Lynch and the
attorney is Candace Gayoso and the defense attorney is Eddie Battitori and~r husband
Michael Gayoso is working at "Meek, Battitori, and Gayoso" and Judge Lynch is still getting
money from the buyout of "Lynch, Meek, and Battitori" and that was an economic conflict of
interest. Case number 2005CR56 shows that Oliver Lynch is judge again aJ\d Candace
Gayoso is prosecutor and Judge Lynch is still receiving money from Meek
Battitori for
the buyout of "Lynch, Meek, and Battitori" and Judge Lynch was suppose te-svalt five (5)
years to hear his past law partners Dr their wives cases due to. an economic conflict of

interest. Case number 2011CR13 shows that Oliver Lynch is the judge agai~ and Candace
Gayoso Brewster is the prosecutor again which is another conflict-of interest,
Kent & Dana Lynch are on the Cherokee County Arts Committee and Dana Lynch is Judge
Oliver Lynch's wife. Kent Lynch is none other than "Judge Oliver Lynch" himself and he is
the Secretary of the Cherokee County Arts Committee. Michael Gayoso is also on this
committee and Judge Lynch continues to hear the law cases of Michael Gayos9 and his wife
Candace-Brewster-Gayoso and this is another conflict of interest. [udge-Lynca also hears
cases of Joanna Derfelt and Cherokee County Arts Association Treasurer Darryl Shumake
who are prosecuting attorneys and both members of the Cherokee County Arts Association
and this is a conflict of interest as well. ihave enclosed a copy of the Cherokee County Arts
Association to show this.
The last conflict of interest that Lori Fleming and I have is because Judge Lori Fleming is
biased and prejudiced against me because I am one of 100's of people from Crawford
County so far that have signed a "GRANDJURYPETITION"under KS.A 22-3001 and an
ouster proceeding to oust all 11thjudicial district judges under K.S.A60-12~6(a) because
all judges of this district have failed to honor Rule 2.11(A) and disqualify4ilePlselves from
cases where they are biased and prejudiced and they also have heard their past law
partners cases when they were still receiving money from the firm for buyouts when they
were business partners as attorneys.
I have included a blank copy of the "GRANDJURYPETITION"that has.beengoing around
Crawford County since some time in January of 2015 when I first heard about the petition
and signed it immediately because Judge Robert Fleming and Judge Kurtis Loy had both
already failed to honor the "OATHOF OFFICE"in case numbers 2014CV7P in Crawford
County and 2014CV53PA in Labette County both judgers took and that is wr I am filing
these complaints and that is why I signed the "GRANDJURYPETITION".
I don't feel like I could get an impartial and unbiased judge in the 11thjudicial district now
that I have signed the Grand Jury Petition to oust the judges and I would like to quote the
court case of "St. David's Episcopal Church v. Westboro Baptist Church,
Inc., 22 Kan. App. 2d 537, 556, 921 P. 2d 821 (1996)" Where, a jud.ge
had signed a petition opposing picketing of funerals, the-appeals
court removed her from a case in which the picketers were a defendant.
Although the Court did not detect "any hostile feelings or a spirit of
ill will," the Court ordered recusal "to avoid" 'even the appearance'
of bias.

Iwould like the committee to take a serious look into these easesfar.fallure to honor Rule
2.11(A) Disqualification of Rules Relating To Judicial Conduct and please reassign this case

to an unbiased out of county judge to help avoid any future lawsuits for racial and religious
