8 SYNOPSIS: Under existing law, the amount of the toll

9 for a private toll road or toll bridge is not

10 subject to regulation.

11 This bill would provide that the amount of

12 the toll charged by a private entity operating a

13 private toll road or toll bridge would be set by

14 the Public Service Commission.

20 Relating to toll rates charged by a private entity

21 licensed to operate a private toll road or toll bridge; to

22 provide that the amount of the toll charged by a private

23 entity operating a private toll road or toll bridge would be

24 set by the Public Service Commission.

25 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

26 Section 1. Notwithstanding any provision of law, the

27 amount of the toll charged by a private entity operating a

1 private toll road or toll bridge shall be subject to approval

2 by the Public Service Commission. In determining the amount of

3 the toll, the commission shall utilize the same process it

4 follows in regulating utilities. In any determination by the

5 commission as to what constitutes a fair rate of return, the

6 commission may give consideration to the average rates of

7 return it allows for utilities.

8 Section 2. This act shall become effective on the

9 first day of the third month following its passage and

10 approval by the Governor, or its otherwise becoming law.
