WHAT IS FAIR USE?


Fair Use:
allows copyrighted material to be used under
certain guidelines, without the copyright
holders permission, for purposes such as
news reporting, teaching, research, criticism,
and parody.

EXAMPLES OF FAIR USE


-Criticism/Review Quoting a work in order to review or comment
on the piece (NOLO, 2015).

-News Reporting Summarizing an address or article, with brief


quotations, in a news report (NOLO, 2015).

WHEN IS IT FAIR USE?


-When creating something new Even when parodying a work, the film
Space Balls for example, as long as it is mostly your own work, its fair use.
-When you are NOT competing with the source youre copying from.
-When you obtain the right to use another authors material Simply citing
a work doesnt mean using the material is legal.
-When you use the other authors work sparingly Dont copy the entire
piece and simply comment.
-When you are mindful of the content you are using Dont quote the heart
and soul of a piece and claim it as your own genius. Take from someone
else only what you wouldnt mind someone taking from you, (NOLO, 2015).

WHAT IS A COPYRIGHT?
Copyright:
Provides legal protection for original creative
worksincluding poetry, movies, viedo
games, videos, plays paintings, sheet music,
recorded music performances, novels,
software code, sculptures, photographs,
choreography, and architectural design.

COPYRIGHTS AND VIDEOS


-Material must be legitimately acquired or purchased by the school.
-Must be for instructional classroom use, not entertainment.
-Clips used in a multimedia presentation may be 10% or three
minutes.
-Copyright and attribution must be provided.

COPYRIGHT VIDEO EXAMPLE


Because this clip is three
minutes long and intended
for use to educate students
on the historical, social, and
political effects of the event
of 9/11 in 2001, it is fairly
used under copyright laws.
The video was legitimately
acquired off of Youtube.

COPYRIGHTS AND PICTURES


-Five images or fewer of an
artist/photographer in one program or
printing, and not more than 10% or 15% from
published collective work, whichever is less.
-Copyright and attribution must be provided.

WHEN IN DOUBT?
Cite your source and look up whether or
not the material you want to implement
in your classroom is fair to use under fair
use and copyright laws.
