SUBJECT: Approval to Proceed with Purchase of Goods and Services – RFP 16-001383

In response to your letter dated October 14, 2008, the attached requirement has been reviewed
in light of the current budget shortfall and we have made a determination that this requirement is
an essential and necessary expenditure to continue the core missions of this Department.
Please proceed with the processing of this request for award of contractual services, solicitation
of bids, or the presentation of this requirement before the Board of Awards for approval.

The following information applies to this procurement:

Specific Requirement:
This specific requirement is to acquire riparian buffer mitigation units in the Service Area for the
Neuse River Basin.

Justification:
This requirement is for needed buffer mitigation for the EEP to successfully meet permit
conditions mandated by the State and Federal Regulatory Agencies.

Source of Funds:
Receipts from the Department of Transportation - $3,714,987.00.
