Has a protection of 20 years (providing significant commercial
gain)
o In return, owner must share the full description of the
invention to the public in the form of the intellectual
property official gazette
Elements:
1. Invention is new
2. Involves an inventive step
3. Capable of industrial application
4. Invention is technical solution of a problem in any field of human
activity
5. Grant of patent is not excluded by the other provisions of the
patent law
General types of Patents:
1. Utility patent new useful process, machine, or composition of
matter or any new and useful improvement
2. Design patent protects ornamental design of an article of
manufacture. Only the appearance of the invention, not its
structure or utilitarian features
3. Plant patent granted on any distinct and new variety of plant
