SECTION1.SHORTTITLE

ThisactmaybecitedastheMarijuanaSentenceReductionActof2015.

SECTION2.FINDINGS

Congressherebyfindsanddeclaresthat,
1)Withlargenumbersofinmateshousedtogetherintriplebunkcells,thereisanincreased,substantialriskfor
transmissionofinfectiousillnesses.
2)Withsomanyinmateshousedinlargecommonareas,thereisanincreased,substantialriskofviolence,and
greaterdifficultycontrollinglargeinmatepopulations.
3)In2011,thereweremorearrestsformarijuanapossessionthanfor
allviolentcrimesputtogether
.
4)Itcostsanaverageofabout$47,000peryeartoincarcerateaninmateinprisoninCalifornia.Overtwothirdsof
thesecostsareforsecurityandinmatehealthcare.
5)BetweenOctober2012andSeptember2013,27.6percentofdrugoffenderswerelockedupforcrimesrelatedto
marijuana
.
6)AttheFederallevel,prisonersincarceratedonadrugchargecomprisehalfoftheprisonpopulation,whilethe
numberofdrugoffendersinstateprisonshasincreasedthirteenfoldsince1980.
7)Asthenumberofpeopleconvictedofdrugoffenseshasgoneup,thefederalprisonpopulationhasincreased
almost790percentsince1980,whentherewereonlyabout25,000inmates,accordingtoa2012Congressional
ResearchServicereport.
8)Overcrowdinghasbeenknowntocausefarmorestressfulsituationsandhaspromptedprisonofficialstoreact
inappropriatelyonoccasionduetobeingforcedtoaccommodateilladvisednumbersofprisoners
9)Eachyear,enforcinglawsonpossessioncostsmorethan$3.6billion,
accordingtotheAmericanCivilLiberties
Union
.
10)In2009alone,1.66millionAmericanswerearrestedondrugcharges,morethanwerearrestedonassaultor
larcenycharges.
11)Drugconvictionswentfrom15inmatesper100,000adultsin1980to148in1996,analmosttenfoldincrease.

SECTION3.STATUTORYLANGUAGE
A)TheMarijuanaSentenceReductionActof2015shallhenceforthreducethemandatoryminimumsentencesof
marijuanaoffenderschargedwithpossessionofmarijuanafromoneyeartothreemonths.Marijuanaoffenders
chargedwithsaleshallhavetheirsentencesbasedonamountpossessed.Foreach10kgofmarijuanaoffenderswill
spend1yearandbefined50,000dollars.Thiswillgountilacapof50kgwithapenaltyof250,000dollarsand5
yearsinprison.Finally,marijuanapossessionshallbecomeafelonyonthefourthoffenseinsteadofthethird.All
marijuanaoffenderscurrentlyincarceratedforoffenseslistedabovewillretroactivelyhavetheirsentencesreducedto
theaforementionedamount.Allprisonerscurrentlyincarcerated,whohavespentgreatertimeinprisonthantheir
newsentencesrequired,willbereleasedoveraperiodofsixmonths.Stateswithlawslessseverethanthoselisted
abovewillnothavetoimplementtheprovisionsofthisbill.
B)ThisbillwillbeimplementedbytheFederalBureauofPrisons.Anyprisonnotfollowingthislawwillhavetheir
federalfundingreducedby1milliondollars.Allexcessrevenuecreatedbythisbillfromthepreviouslymentioned
reductioninovercrowdingwillbereturnedtotheFederalBureauofPrisonstobeusedastheydeemfit.
C)ThisbillshallbeenactedonJanuary1,2017.Therewillbenoexpirationdateforthisbill.
