DEED OF PARTITION

KNOW ALL MEN BY THESE PRESENTS:


This Deed of Partition is made and entered into by and between,
SHERYL ANNE M. GARCIA, of legal age, Filipino, married to Roderick R.
Garcia, residents of Matina, Davao City; and
MARTINIANIO G. BERNARDO, of legal age, Filipino, married to Ana Ma.
Rita F. Bernardo, residents of Matina, Davao City.
W I T N E S S E T H:
1. That the parties hereto are the registered owners of a parcel of land situated at
Davao City, Province of Davao del Sur, and more particularly described as
follows:
Lot 8, Block 23 of the Consolidation Subdivision Plan Pcs-11-000239
A parcel of land (Lot 8, Block 23 of the consolidation subdivision
plan Pcs-11-000239, being a portion of Lots 5, 6, 7 & 9 (LRC) Psd-71122
& 8-A (LRC) Psd 282639, situated in the City of Davao, Island of
Mindanao. Bounded as follows: On the NE., along line 2-3 by Road Lot
20; on the SE., along line 3-4 by Lot 10; on the SW., along line 4-1 by Lot
9; and on the NW., along line 1-2 by Lot 6, all of Blk. 23 of the
Consolidation-subdivision plan. Beginning at a point marked 1 on plan
Being S.46 deg. 58W., 3007.56m from Mon. No. 9, Davao Townsite;
thence
N. 76 deg. 02 E., 20.02 m. to point 2;
S. 13 deg. 58E., 15.00 m. to point 3;
S. 76 deg. 02W., 20.02 m. to point 4;
N. 13 deg. 58W., 15.00 m. to point of beginning.
Containing an area of THREE HUNDRED (300) SQUARE METERS,
more or less.
This title thereto being evidenced by Transfer Certificate of Title No. T451363 of the Register of Deeds of the City of Davao.
1.
That with the express consent of SHERYL ANNE M. GARCIA and
MARTINIANO G. BERNARDO, and that of their respective spouses, they
agreed to divide and partition the above-described parcel of land as follows:
a. Lot 8-A with an area of 75sqm
b. Lot 8-B with an area of 75sqm
c. Lot 8-C with an area of 75sqm
d. Lot 8-D with an area of 75sqm described as A parcel of land (Lot 8-D
Psd-11-110888) being a portion of Lot 8, Block 23, PCS-11-000239,
situated in the Barrio of Matina Aplaya, City of Davao, Island of
Mindanao. Bounded on the NE, along line 2-3 by Lot 10, Blk 23, Pcs-11000239; on the SE, along line 3-4 by Lot 10, Blk 23, Pcs-11-000239; on

the SW, along line 4-1 by Lot 9, Blk 23, Pcs-11-000239 and on the NW,
along line 1-2 by Lot 8-C, of the subdivision plan. Containing an area of
seventy-five (75) square meters, more or less.

That with the express consent of SHERYL ANNE M. GARCIA and
MARTINIANO G. BERNARDO, and that of their respective spouses,
MARTINIANO G. BERNARDO shall waive his claim of Lot 8-D in favor of
SHERYL ANNE M. GARCIA;
3.
That both SHERYL ANNE M. GARCIA and MARTINIANO G.
BERNARDO shall maintain co-ownership of Lots 8-A, 8-B and 8-C.
