DefinitionofTerms:
Airpollutantmeansanymatterfoundintheatmosphereotherthanoxygen,"nitrogen,
watervapour,carbondioxide,andtheinertgasesintheirnaturalornormal
concentrations,thatisdetrimentaltohealthortheenvironment
Airpollutionmeansanyalterationofthephysical,chemicalandbiologicalproperties
oftheatmosphericair,oranydischargetheretoofanyliquid,gaseousorsolidsubstances
thatwillorislikelytocreateortorendertheairresourcesofthecountryharmful,
detrimental,orinjurioustopublichealth,safetyorwelfareorwhichwilladverselyaffect
theirutilizationfordomestic,commercial,industrial,agricultural,recreational,orother
legitimatepurposes
Greenhousegasesmeanthosegasesthatcanpotentiallyorcanreasonablybeexpected
toinduceglobalwarming,whichincludecarbondioxide,methane,oxidesofnitrogen,
chorofluorocarbons,andthelike;
Ambientairqualityguidelinevaluesmeantheconcentrationofairoverspecified
periodsclassifiedasshorttermandlongtermwhichareintendedtoserveasgoalsor
objectivesfortheprotectionofhealthand/orpublicwelfare.Thesevaluesshallbeused
forairqualitymanagementpurposessuchasdeterminingtimetrends,evaluatingstages
ofdeteriorationorenhancementoftheairquality,andingeneral,usedasbasisfortaking
positiveactioninpreventing,controlling,orabatingairpollution;
Ambientairqualitymeansthegeneralamountofpollutionpresentinabroadarea;and
referstotheatmosphere'saveragepurityasdistinguishedfromdischargemeasurements
takenatthesourceofpollution
Ecoprofilemeansthegeographicalbasedinstrumentforplannersanddecisionmakers
whichpresentanevaluationoftheenvironmentalqualityandcarryingcapacityofan
area.
Itistheresultoftheintegrationofprimaryandsecondarydataandinformationonnatural
resourcesandanthropogenicactivitiesonthelandwhichareevaluatedbyvarious
environmentalriskassessmentandforecastingmethodologiesthatenabletheDepartment
toanticipatethetypeofdevelopmentcontrolnecessaryintheplanningarea;
Hazardoussubstancesmeanthosesubstanceswhichpresenteither:(1)shorttermacute
hazardssuchasacutetoxicitybyingestion,inhalation,orskinabsorption,corrosivityor
otherskinoreyecontacthazardortheriskoffireexplosion;or(2)longtermtoxicity
uponrepeatedexposure,carcinogenicity(whichinsomecasesresultinacuteexposure
butwithalonglatentperiod),resistancetodetoxificationprocesssuchasbiodegradation,
thepotentialtopolluteundergroundorsurfacewaters;

OzoneDepletingSubstances(ODS)meanthosesubstancesthatsignificantlydepleteor
otherwisemodifytheozonelayerinamannerthatislikelytoresultinadverseeffectson
humanhealthandtheenvironmentsuchas,butnotlimitedto,chlorofluorocarbons,
halons,andthelike;Ambientairqualitymeansthegeneralamountofpollution
presentinabroadarea;andreferstotheatmosphere'saveragepurityasdistinguished
fromdischargemeasurementstakenatthesourceofpollution
PersistentOrganicPollutants(POPs)meantheorganiccompoundsthatpersistinthe
environment,bioaccumulatethroughthefoodweb,andposeariskofcausingadverse
effectstohumanhealthandtheenvironment.Thesecompoundsresistphotolytic,
chemicalandbiologicaldegradation,whichshallincludebutnotbelimitedtodioxin,
furan,PolychlorinatedBiphenyls(PCBs),organochlorinepesticides,suchasaldrin,
dieldrin,DDT,hexachlorobenzene,lindane,toxaphereandchlordane;
Standardofperformancemeansastandardforemissionsofairpollutantwhichreflects
thedegreeofemissionlimitationachievablethroughtheapplicationofthebestsystemof
emissionreduction,takingintoaccountthecostofachievingsuchreductionandanynon
airqualityhealthandenvironmentalimpactandenergyrequirementwhichthe
Departmentdetermines,andadequatelydemonstrates;and
Stationarysourcemeansanybuildingorimmobilestructure,facilityorinstallation
whichemitsormayemitanyairpollutant.

prepareanannualNationalAirQualityStatusReportwhichshallbeusedasthebasisin
formulatingtheIntegratedAirQualityImprovementFramework

ofone'sprivateresidence,privateplaceofworkoranydulydesignated
smokingareaisherebyprohibitedunderthisAct.

FinesandPenalties

theDepartment,throughthePollutionAdjudicationBoard(PAB),shallimposea
fineofnotmorethanOnehundredthousandpesos(Php100,000.00)foreverydayof
violationagainsttheowneroroperatorofastationarysourceuntilsuchtimethat
thestandardshavebeencompliedwith.
thePABshallordertheclosure,suspensionofdevelopment,construction,or
operationsofthestationarysourcesuntilsuchtimethatproperenvironmental
safeguardsareputinplace:Provided,Thatanestablishmentfoundliableforathird
offenseshallsufferpermanentclosureimmediately.
ApassshallhereinbeissuedbytheDOTCtoauthorizetheuseofthemotorvehicle
withinaspecifiedperiodthatshallnotexceedseven(7)daysforthesolepurposeof
makingthenecessaryrepairsonthesaidvehicle.
Inaddition,thedriverandoperatoroftheapprehendedvehicleshallundergoa
seminaronpollutioncontrolandmanagementconductedbytheDOTCandshall
alsosufferthefollowingpenalties:

FirstoffenseafinenottoexceedTwothousandpesos
(Php2,000.00);
SecondoffenseafinenotlessthanTwothousandpesos
(Php2,000.0)andnottoexceedFourthousandpesos(Php4,000.00);
and
Thirdoffenseone(1)yearsuspensionoftheMotorVehicle
Registration(MVR)andafineofnotlessthanFourthousandpesos
(Php4,000.00)and
notmorethanSixthousandpesos(Php6,000.00).
