Enclosed please find a completed “Comprehensive Permit Site Approval Application/Rental” to be
financed with 2 New England Fund Lender,
‘The rental development, currently referred to as Liberty Green Apartments, will consist of two garden
style apartment buildings which shall be approximately three (3) stories high as well as seven (7) two (2)
story high Townhouse style attached buildings. The buildings are proposed to be wood frame, asphalt
roofing and viny! siding, trim, and windows. There will be a total of 104 units between the apartment
and townhouse style buildings. The development will have an interior sidewalk to encourage pedestrian
travel as well as bike racks and an outdoor pool, playground and amenities area. The proposed
development is conveniently iocated in downtown Falmouth along Main Street within short waking
distance of numerous restaurants, retail facilities, service facilities, public transportation, and Town Hall.
‘The site also provides easy access to |-495 and MA-28. Various forms of public transportation are
available between 1-12 miles from the site.
“The 2.5 acre site does not contain any wetlands and does not have any mapped habitat of rare or
endangered species, The property currently contains numerous commercial and warehouse structures
in various states of disrepair. The Applicant proposes to redevelop the blighted site by razing the
existing, poorly maintained structures and constructing the proposed buildings thereon. The Applicant
‘proposes to minimize lot coverage by constructing parking facilities below the two apartment buildings
80 as to provide a total of 112 covered spaces. Thirty two (32) spaces are proposed to be uncovered and
adjacent to the respective buildings. There are also a total of 14 proposed garage spaces associated with
the townhouses.
‘This area of Falmouth is well developed with predominately commercial development fronting Main
Street with adjacent residential properties directly to the North of the site, The lot to the West of the
site is a mixed use condominium with residential and commercial units, Directly to the East of the site is
a realty office as well as a Dunkin Donuts. The proposed development meets the character of the
neighborhood which includes both commercial and residential development along Main Street and
Lantern Lane and is consistent with the primary underlying zoning district (BR) which does allow certain
multifamily residential uses as well as commercial uses,

Attached Is the Massachusetts Housing Finance Agency ("MassHousing") application form for Project Eligibility/Site
‘Approval (Site Approval’) under the state's comprehensive permit statute (W.G.L. ¢. 40B, Sections 20-23 enacted as
Chapter 774 of the Acts of 1969) knovin as "Chapter 408" Developers seeking e comprehensive permit to construct
affordable housing under Chapter 408 and intending to use a MassHousing financing program or financing through
the New England Fund ("NEP program must receive Site Approval from MassHousing. This approval (also referred to
a5 “project eligibility approval") is a required component of ary comprchensive permit application to be submitted to
the local Zoning Board of Appeals of the municipality in which the development is to be loca
‘As part af its review of your application, MassHousing will conduct an inspection of the site and will solicit comments
from the relevant municipality. MassHousing will consider any relevant concerns that the municipality might have
about the proposed project or the developer. The applicant is encourages, therefare, to make contact with the municipality
prior to submitting the Site Approval application in order to ensure that the applicant understands any concems that
‘the municipality may be likely to raise regarding the proposed development.
In order for a project to receive Site Approval, MassHousing must determine that (i the applicant has sufficient legal
control of the site; ithe applicant isa public egeney, non-profit organization or limited dividend organization; and
(ii) the applicant and the project ate generally eligible under the requirements ofthe MassHousing program selected
by the applicant, subject to final eligibility review and approval. Furthermore, MassHousing must determine that the
site of the proposed project is generally appropriate for residential development (taking into consideration municipal
actions previously taken to meet affordable housing needs) and that the conceptual project design is generally appropriate
for the site. In order for MassHousing to be able to make these findings (required by 760 CMR 56.04 (4), it is important
‘that you answer all questions in the application and include all required attachments.
Please nate that MassHousing requites that all applicants meet with a member of our 40B Department staff before
submitting their aplication, Applications for any projects that have not been the subject ofa required pre-application
meeting will not be accepted or processed.
Upon completion ofits analysis, MassHousing wil ether issue a ite Approval Letter that approves, conditionally
approves or denies the application Ifthe application is approved, te applicant should apply to the Zoning Board of
Appeals within two years from the date ofthe Site Approval Letter (unless MassHousing extends such term in writing)
Please note that Site Approval from MassHousing does nat constitute a oan commitment by MassHousing or any other
Financing program. All potential MassHousing financing is subject to further review and underwriting by MassHousing's
Rental Lending Department.
