Secondly, it thrives to capture and cover the most significant human rights developments and issues of the past two months including ‘activities to mark the human rights week, all 139 recommendations accepted by the Malegssy government atthe end of the 20” session Universal Periodic Review working group ofthe Human Rights Coun- «il in Geneva in November 2014, as well as the advocacy, sensitize. tion and traning activities that resulted inthe adoption of a number of landmark laws which will strengthen the national architecture and mechanism for the protection of human rights and the promotion of rule of law, democracy and good governance. These laws include the law on the abolition of death penalty, the law against human traffick- ing, the law establishing the High Court of Justice, the law authorizing the ratification of the UN convention on the rights of persons with disabilities the law establishing the High Couneil forthe defense of the democracy and rule of law and the updated Charter of the ‘environment, Despite these key achievements which constitute a positive and ‘conerete impact of the UN in the country, a number of human rights issues and challenges remain unaddressed, principally chronic corrup- ‘and impunity, the implementation of genuine national reconcili ation process that upholds the four pillars of transitional justice (truth, justice, reparation and guarantee of non-recurrencs) , the rights to Teparation of the victims of rights human rights violations and buses perpetrated by the dahalos and security and dofense forces in ‘connection with insecurity in the south, as well as harsh prison condi tions, sometimes resulting in deaths, prolonged pre-trial detention, Societal diserimination and violence against women and persons with disabilities, community trafficking of women and children, child labour, child prostitution and pomography as well as inability to fully ‘enjoy basic social and economic rights. I can be recalled that in Mad= agascar, 90% of children have no access to pre-school: 1.5 million children of primary school age are out of school. Only 3 out of 10 ‘complete primary level and 120 children die each day before their $® birthday. Neonaial complications are responsible for 26 % of deaths for children under 5, each day, 8 women die during pregnancy or due to childbirth complications. Madagascar is 6* in the world in terms of stunting, | in 2 children suffer from stunting. The country ranks S* Worst country in the world with regard to water access, 8" worst in the world in terms of sanitation. ‘The UNCT will continue to ensure that human right principles, norms ‘and standards are upheld in the overall politcal, legislative, judicial, humanitarian and development agenda of the country. In this regard, the UNCT is providing technical and financial support to the ‘government in drafting an operational plan for the implementation of recommendations from the treaty bodies, the special provedures and the universal periodic review. This plan which is adopted in @trans- parent and inclusive manner, will serve as a new compass for national ‘and international interventions in the field of human rights in Mada- ‘gascar. Institutionalized Human Rights education programme in special- ized institutions and high education institutions are at the center of OHCHR priorities in Madagascar, HU one Cooruntrahe ee May Atdeny 2) In Antsirabe (170 km south of Antananarivo), on 19 December, the Rights Adviser on behalf of the UN Resident Coordinator/UNCT and the General Commander of the Antsirabe Military Academy (ACMIL) officially signed an Memorandum Of Understanding (MOU) on the integration of Human Rights modules into the curricula of the academy. The UNCT principally the OHCHR. will provide technical assistance and human rights trainings for military students, and support the creation of a human rights and peace resources center within the ACMIL. The MOU was signed in the presence of the secretary general of the ministry of defense represen Human ting the minister and the deputy chief of staf of the Malagasy army. BUILDING MOMENTUM FOR THE ABOLITION OF DEATH PENALTY On 10 December, on the occasion of the celebration of the Human Rights Day, the National Assembly has adopted the law on the abolition of death penalty. The private bill was tabled by the President of the National Assembly. This landmark law is the culmination of intensive sensitization and advocacy activities organized by the Ministry of Justice, UNCT, OHCHR, EU, AU, FLACAT/ACT (Action des Chrétiens pour I"Abolition de la Torture), the intemational coalition for the abolition of death penalty, Human Rights NGOs, France, Norway and Switzerland, On 10 October 2014, during the national forum on the abolition of death penalty, participants had adopted the Antananarivo declaration in which they called upon the arliament to adopt a national law to abolish death penalty. THE AGHT AGAINST HUMAN TRAFACKING INTHE HEADLINES In Antsirabe (170 km South of Antananarivo), on 13-14 November, OHCHR participated in a 2-day workshop orga- nized by the office of the Prime Minister and the Ministry of Justice on the drafting of @ national action plan to fight ‘against trafficking in persons. At the end of the workshop, raft action plan and a chronogram were adopted On 16 December the law against human trafficking was adopted after intensive advocacy, training and sensitization activities organized by OHCHR in partnership with IOM, EF, UNFPA and UNDP. This landmark law provides protection for vietims of trafficking in persons, punishment Of perpetrators, and state responsibility with regard to the right of the victim to compensation as well as the return of the vietms to the country. OHCHR provided technical assis- tance in ensuring its compliance with international standards ‘and principles. The UNCT is providing technical support to ing. the national plan of action the government in fin ‘against human trafficking A SIGNIFICANT STEP TOWARDS THE REALIZATION OF THE RIGHTS OF PEOPLE LIVING WITH DISABILITIES: (n 24-25-26 November, the OHCHR participated in a 3-day workshop on the situation of people living with disabilities in Madagascar. 125 people including 70 women participated in the workshop organized by Handicap Intemational, the Ministry of Population and Social Affairs and the Platform of Association working for the promotion and protection of {the rights of people living with disabilities. OHCHR made presenations on the interational and regional mechanisms for the protectin ofthe rights of people living with dsabil ties as well as on the importance of a Human Rights-based ‘approach to dlsabilties. OHCHR called forthe ratification of the UN convention on the rights of people living with disabilities signed by Madagascar on 25 September 2007 On 3 December, on the occasion of the official launching of the Human Rights week, and to mark the United Nations ‘international day of people with disabilities, the National Assembly has adopted the law authorizing the ratification of the UN convention on the rights of persons with disabilities (CRPD).This landmark adoption would help strengthening the national Human Rights protection system, and building a disabled-friendly environment in Madagascar. Pista Edkor MARKING THE 25 ANNIVERSARY OF THE (CONVENTION ON THE RIGHTS OF THE CHILD (CRC) ‘OLICHR participated in a number of activities organized by ‘the government, the UNCT, civil society organizations and ‘UNICEF to mark the 25" anniversary of the convention on the rights of the child. In the locality of Vontovorona (20 km west ‘of Antananarivo), at the auditorium of SOS Villages «Enfants, OHCHR on behalf of the UN Resident Coordinator ‘made a presentation on the theme: “25 anniversary of the ERC and Madagascar: achievements, challenges and pro- pects” during an in-door ceremony co-presided over by the ‘minister of culture representing the minister of population and social affairs and the representative of the first lady, in the presence of the vice president of SOS villages ¢’Enfants France, the city mayor of Vontovorona, members of the diplo- ‘atic corps, representatives of the UNCT as well as 600 ‘children including 350 girls. This ceremony coincided with the 25" anniversary of the erea- tion of SOS Village d’ Enfants Madagascar. REINFORCING PARLIAMENT COMMITMENT TOHUMANRIGHTS If Human Rights are to become a reality for everyone, parlia- ments must fully play their role and exercise to this effect the specific powers they have, namely legislating, adopting the budget and overseeing the Government. Upon OHCHR’s remark and advice, the government ‘committed itself 10 allocating a budget line for the INHRC in the next amended financial law (loi de finance rectificative) in March 2015. The government also committed to allowing the participation of two representatives of the civil society in a consultative capacity without deliberative mandate within the ad-hoc commission pro- vided by article 31 of the 19 June 2014 law on INHRC, and tasked with preparing the INHRC’s budget. OHCHR also supported reflection meetings on the best ways to. censuring transparency, inclusiveness, legitimacy and gender parity in the nomination process of the 07 representatives of civil society ‘organizations within the INHRC. ENHANCING THE HUMAN RIGHTS CAPACITY AND EXPERTISE OF THE OMBUDSMAN’S OFFICE OHCHR organized a 2-day Human Rights training workshop ia Antananarivo, on 13-14 November, for the benefit of 4 experts including one woman attached to the office of the Médiateur de la République (Ombudsman). “Modules covered included introduction to Human Rights, Hunan Rights principles, and national mechanism Sor the protection of Hunan — Rights, regional and international mecha- nisms for the protection of Huunan Rights, the 29 April 1992 ordinance creating the Ombudsmer, the proceedings before the ‘ombudsman as well as the rote ofthe ombudsman tn promoting Human Rights, rule of law end good governance. INTEGRATING /MAINSTREAMING WORKS ON HUMAN RIGHTS INTO BUSINESS ACTIVITIES. On 18 December, in Antananarivo, OHCHR made a presentation on the 31 Guiding principles on Human Rights and business for the benefit of 10 managers drawn from mining and extractive associations and companies operating in Madagascar. Further meetings will be organized to discuss pers- pectives of cooperation, especially on OHCHR support in integrating Human Rights standards and principles into Mining and Petroleum Companies’ Social Corporate Responsibility policies. The Malagasy delegation led by the Minister of Justice, described the efforts of the Government to improve the ‘Human Righ's situation in the country since the submission of its first UPR report in February 2010. The Director of Human Righis within the Ministry of Justice explained the 139 UPR recommendations accepted by Madagascar on 6 November 2014. OHCHR maul a presentation on the UPR mechanism and explained Special Procedures and Treaty Bodies recommendations issued to Madagascar. A frst draft of the plan was adopted at the end of the workshop.
