OF LITCHFIELD [TORRINGTON Y LIMITED : PARTNERSHIP IVs. 7 AT LITCHFIELD CITY OF TORRINGTON A APRIL 26, 2010 COMPLAINT | TO THE SUPERIOR COURT FOR THE JUDICIAL DISTRICT OF LITCHFIELD, AT LITCHFIELD comes TORRINGTON Y LIMITED PARTNERSHIP a Connecticut limited [partnership with its principal place of business in Torrington, Connecticut, appealing pursuant to |General Statutes § 12-117a fiom the actions of the CITY OP TORRINGTON Assessor and [Board of Assessment Appeals and complains of the defendant, CITY OF TORRINGTON and says: 1. Ateall times relevant the plaintiff TORRINGTON Y LIMITED PARTNERSHIP Iwas the owner of certain real property in the CITY OF TORRINGTON located at 63 Mason ‘Street (Unique ID Number 15335) and identified as Map 117, Block 008 and Lot 004/2 on the lax tist of October 1, 2009 (the “Property”); 2. On October 1, 2009 the Assessor of the defendant, CITY OF TORRINGTON (“Assessor”), assessed the Property as follows: Building: s 484,750.00 Total: 8 484,750 00 | 3. The defendant's Assessot determined that ll property in the municipality should | ‘be liable for taxation at 70% of its truc and actual valuation on the assessment date; 4, The aforesaid assessment of the Property was grossly excessive, unreasonable, disproportionate, unlawful and was not in accordance with @ uniform percentage of true and | actual value and was discriminatory to the plaintiff and disproportionate with the assessments of Jother taxpayers owning similar property located and assessed within the CITY OF TORRINGTON; | 5. Within the time prescribed by law, by application dated March 16, 2010, the plaintiff, TORRINGTON Y LIMITED PARTNERSHIP appealed to the defendant’s Board of Assessment Appeals (“Board”) claiming to be aggrieved by the action of the Assessor regarding the assessment of the Property on the October 1, 2009 Grand List; | 6. By decision dated April 12, 2010, and mailed to the plaintiff, the Board notified the plaintiff that it denied the plaintiff's appeal. 7. Asasesult of the Board’s denial of the Plaintiff's appeal, the assessment remains grossly excessive, unreasonable, disproportionate, unlawful and not in accordance with a juniform percentage of true and actual value and discriminatory to the plaintiff and disproportionate with the assessments of other taxpayers owning similar property located and assessed within the CITY OF TORRINGTON; 8. The plaintiff is aggrieved by the doings of the Assessor and the Board WHEREFORE, the plaintiff appeals from the action of the defendant’s Assessor and the acilpn and ruling ofthe defendant's Boatd of Assessment Appeals and prays: 1, that the assessment of the aforesaid property on the October 1, 2009 Grand List be reduced equitably and proportionately in accordance with the uniform, percentage of true and actual valuation as required to be used by the Assessor and/or Board of Assessment Appeals under the Connecticut General Statutes; and reimbursement from the CITY OF TORRINGTON for the excess of the taxes paid by the plaintiff together with interest and costs, and 3. such other relief as shall in justice and equity appertain led at Torrington, Connecticut, this 26 day of April, 2010.
