The trail, on land leased from the Bacchus
Marsh Golf Club by council, was severely
damaged by flooding more than five years
ago, however a subsequent proposal by
council to build a new path alignment
through land owned by the Club was
rejected, and a current resolution by council
to abandon the existing lease agreement has
not been accepted by the Club.
The April council meeting saw council
reiterate its desire to abandon the current
lease agreement, but noted that re-building
the trail, in any form, is listed on the long-
term capital works program for consideration
at the annual budget.
The matter has been raised at the past
three council meetings, and legal advice has
been sought by officers on the current lease
agreement.
“The most relevant lease obligation imposed
on Council is to ‘construct and maintain the
path’. Advice received states that, renewal
or reconstruction of the path would not be
a requirement of the lease,” read a report
tabled at the April council meeting.
The report stated the cost of works required
to restore the path to its original condition in
its original location, would be $700,000, and
the cost of a new boardwalk-style path with
the new alignment would be $900,000.
Councillors resolved to continue negotiating
with the Club to abandon the lease, with the
option to re-enter the lease should funding
be acquired in the future, while officers will
also work with the club to finalise a new
path alignment for estimation purposes.
Council will also perform a one-off weed
and pest spraying along the trail.
East Ward Councillor Dave Edwards
initially raised the issue at the February
council meeting, and called for more
collaboration to resolve the issue.
“My views are that any project that can
be done in conjunction with Council and
community groups working together and
benefit the broader community, should be
perused,” Cr Edwards said.
“I look forward to Council working with
Bacchus Marsh Golf club to get a good
outcome for the community.”
