Response from PFR General Manager concerning the Lease Agreement

between City of Toronto, TRCA and Empire Communities Ltd.

My Email Question:
To whom it may concern,
I'm having difficulty understanding a Lease Agreement between the City of Toronto, TRCA and Empire
Communities Ltd. Specifically a condition where the term General Manger is used.
The condition is "upon the expiry or other termination of this Agreement or any renewal thereof, at
the Tenants own risk and expense, to remove from the Leased Premises within Sixty (60) Days (Ninety
(90) days if the removal is of a structural nature), all chattels belonging to the Tenant, (and any or all
structural or other improvements to the Leased Premises, but only if so requested by the General
Manager), with all damage, if any, caused by such removal made good by the Tenant, and to leave
the Leased Premises in good repair, reasonable wear and tear only excepted, and free of all waste
material/debris/rubbish, all to the reasonable satisfaction of the General Manager."
Could you explain how this would work? The lease on this land expired March 31, 2016. However, two
new agreements for this land were enacted in August 2015. These new lease agreements end in December
2017.
There is a sales centre on this property, which is part of Humber Bay Park East. Originally, it was going
to be used as a community centre for the Humber Bay Shores community. It was donated by the
developers via Councillor Grimes to HBSCA in 2014. However, the Councillor later said it didn't meet
City Standards. Now there will be a new pavilion built in Humber Bay Park East in a different location.
Empire Communities committed to improving the subject site with a park after the lease was terminated.
The first lease is expired. The building is still there. The two new leases end in 2017. Can you explain
how this overlap and clash work?

Hello Jason,
My name is Ryan Glenn and I am the Manager of Business Services, Parks, Forestry and
Recreation ("PFR"). I am responsible for any business interests in the City's parks, and these
agreements are administered by my group.
The "GM" as referenced in the agreements is the, "General Manager, Parks, Forestry and
Recreation". Since the operational jurisdiction for this property is under that of PFR, our GM has
the overall corporate administrative responsibility for this agreement.
There are actually 3 separate and distinct agreements between the City and Empire
Communities at this location. They are summarized as follows:
1. Lease of Humber Bay Park East for a condo sales centre (Term: March 1st, 2013 February 29,
2016)
2. Licence for a crane swing over Humber Bay Park East for construction of adjacent condo (
Term: November 1, 2015 for 32 months)
3. Licence for construction tiebacks for adjacent condo (This is a onetime fee)
With respect to your question of the removal of the condo sales office ( 3.1(o) of the condo sales
office lease), the City has not asked to have the sales office removed as the City is in the process
of entering into a new agreement with Empire Communities to continue the current use as a
sales office. Until the new agreement is executed, the current agreement (which expired on
February 29, 2016) will continue on a month-to-month basis.
