‘Your application for Site Plan Approval to redevelop the subject site by demolishing ten
structures to construct a 15,650 square foot grocery store (ALDI Foods) with related
parking is APPROVED ON CONDITION.
Site Plan Approval is not the final step. You must take additional steps to
‘complete the approval process and obtain a Bullding Permit. Itis your
responsibilty to read and understand the approved plans, conditions, and additional
approvals required to obtain a Building Permit.
‘This approval will expire on April 29, 2017 unless you have obtained a Building
Permit before that date. If you require an extension of time, you may do so in wating
before the expiration date.
‘This approval Is subject to the following CONDITIONS:
1. That three final sets of site drawings and elevations shall be submitted to the
Bureau of Planning and Zoning for Sito Plan approved. The Certificate of Zoning
Compliance, Building Permit and Cortficate of Occupancy willbe prepared. One
set will romain in the Site Plan Review file, and two sets will be transferred to
Plan Review for Building Code raview and issuance of the building permit and
any other required permits. You may submit two sets of architectural drawings to
lan Review to begin building code review, or along with the site and elevation
drawings.
2. That the project shall be constructed in accordance with the approved site and

‘That any project modifications to either the site or the proposed building
‘envelope that differ trom the approved plans shall be brought to the attention of
‘Jason Haremza at 585-428-7761 or jason haremza@ cityotrochester.gov, and
approved by the Director of Planning & Zoning prior to the changes taking eect.
That the on-site signs required by Monroe County Department of Transportation
(MCDOT) shall be installed and maintained. Further, MCDOT identified that a
roview of futuro traffio data at the Blocsom Road acoees may be required to
reassessment the on-site trafic mitigation methods to ensure that safety
concems are addressed and an adequate level of service is maintained. This

‘new trafic regulation signs, or lane restriping. These mitigation measures will be
implemented on a case-by-case basis as approved in collaboration with the
developer, MCDOT, the City of Rochester, and adjacent landowners, if

from the Department of Environmental Services (DES) Permit Office, and shall
adhere to and be coordinated with the following:
a. Right-of-way work on North Winton Road and Blossom Road is restricted;
‘no work is to between the hours of 7 AM to 9 AM and 4 PM to 6 PM.
‘The North Winton Road Reconstruction project is underway and all right
cof-way work (utity installations, curb cuts, water abandonments, ec.)
shall be coordinated with Sam Priem, OES-Constructon at 428-7168.
¢. An existing light pole on Blossom Road will be impacted by the driveway
ccurb cut. All costs associated withthe relocation ofthe light pole are the
responsibility of the developer. More information may be obtained by
contacting Joe Borell, DES-Street Lighting at 428-7979.
‘That confirmation from New York State Department of Environmental
Conservation (NYSDEC) shall be submitted to the Bureau of Planning and
Zoning indicating that the remedial action work plan prepared by GEI Consulting,
Inc., dated April 28, 2016, is acceptable to the Agency.
‘That a Site Preparation Permit is obtained in conjunction with the building permit
to manage the grading, drainage, erosion and sediment control relating 10
construction related activities and post-construction stormwater management
features, such as the bioretention and infitration basins.
‘That any permits required for work in the public right-of-way are obtained from
the City of Rochester Department of Environmental Services-Permit Office (585)

Findings:
1. The proposal is to demolish ten structures with a cumulative square footage of
+#/-18,000 square feet to construct a 15,650 square foot grocery store. Building
and parking lot lighting, landscaping, and decorative brick and metal fencing will
bbe provided. The refuse and loading area is at the rear of the building. Four of
the six existing driveway curb cuts will be closed, the southerly curb cut on North
Winton Road will be modified, and the curb cut on Blossom Road will remain to
access the site as a traffic mitigation measure. A 63-space parking area is,
‘proposed along the south side of the building, and all stormwater runoff will be
‘managed on site in two bioretention areas and an infiltration area.
‘The exterior of the building will be clad in high-quality brick and block materials,
clear storefront glazing, and metal canopies and awnings. Benches are
‘proposed along the front of the building to enhance the pedestrian experience.
2. On September 24, 2015, the Zoning Board of Appeals (ZBA) granted area
variance approval (V-008-15-16) to waive the maximum square footage of a
Principal use or structure inthe C-1 Distt; the transparency requirement for
"new construction along a primary street; access to th site on the principal
Pedestrian-oriented street; and the maximum height requirement and number of
detached signs for the proposed Aldi Foods. As mitigation measures, the ZBA
determined that the sizeof the building is mitigated by conditioning the approval
on additional exterior bulding modifications and increased site landscaping,
which improve the aesthetic appeal and the pedestrian experience. A copy of
the ZBA decision is attached.
3. On October 19, 2015, the City Planning Commission (CPO) reviewed and
accepted a parking demand analysis to exceed the parking maximum. There are
63 off-street parking spaces proposed where the maximum number of spaces
allowed is 34; an excess of 29 spaces. A copy of the CPC decision is attached.
4. Iman effort to effectively manage potential traffic congestion, MCDOT has
accepted the developers pian to install on-site signs to restrict certain vehicular
‘movements during peak PM times atthe Blossom Road entrance, and
acknowledges on-site traffic mitigation methods may be reevaluated inthe future
to ensure that safety concems are addressed and an adequate level of service is
maintained. These mitigation measures may include driveway curb cut
‘modifications or turing movement restrictions, new traffic regulation signs, or
lane restrping, which willbe determined on a case-by-case basis and approved
in collaboration with the developer, MCDOTT, the City of Rochester, and adjacent
landowners, i necessary.
5. _ Inthe Preliminary Site Plan Findings issued on July 10, 2016, it was identitid
that the projact was referred to the New York State Department of Environmental
‘Conservation (NYSDEC). Thomas Hall, Environmental Program Specialist,
‘advised that the ownerideveloper should draft a remedial action plan forthe site
‘and forward it to NYSDEC for review. A copy of ths report prepared by GE!Site Plan Approval (sP-019-14-15)

Consulting, Inc., dated April 28, 2016, was received in Planning and Zoning via,
‘email on April 28, 2016. A latter from NYSDEC is required to be submitted to
Planning and Zoning indicating that this report is acceptable to NYSDEC.
6. The Stormwater Pollution Prevention Plan (SWPPP) was accepted by the City of
Rochester on September 11, 2013. Any modifications or updates to the SWPPP
shall be submitted to Tom Mann, Permit Office Manager, Bureau of Planning &
Zoning.
