1. Introduction
International Society for Fair Elections and Democracy presents a report of monitoring salary expenditures
(wages, bonuses and supplementary pays) made to the
management team of the Central Election Commission of
Georgia (hereinafter, the Commission or the CEC), its
members, staff and freelance workers.

Georgian electoral management body (EMB) is an administrative body independent from other state bodies within the scope of its competencies. The EMB is responsible
for ensuring fair and democratic elections, which are the
cornerstone of any democratic state. In light of this, we
believe that public may find salary expenditures made to
members and employees of the Central Election Commission particularly interesting. Because of the important function of the EMB, compensation should ensure
that in discharging their duties employees of the CEC
remain fair and independent; on the other hand, compensation shouldnt be unreasonably high, especially in
light of the existing social situation in Georgia. Purpose
of this report is to evaluate effectiveness of budget expenditures for compensating the CEC employees and to
propose subsequent recommendations.

The monitoring was carried out on the basis of public information provided by the Central Election Commission.

2. Legal framework for wages and bonus-

es in the Electoral Management Body

Rules for providing bonuses in public institutions in


Georgia are established by the July 15, 2014 Decree of
the Government of Georgia .1 On September 15, 2014, two
months after promulgation of the Decree, by its Decree
no.44/20142 the Commission approved the rules for determining amount of and providing bonuses to employees of
the electoral management body of Georgia and the Legal
Entity Under Public Law (LEPL) - Center for Electoral Systems Development, Reforms and Training.
The normative act upholds the July 15, 2014 Decree of the
Government of Georgia and determines grounds for providing a bonus, its aims, persons authorized to provide
bonuses, and amount and frequency of providing bonuses. In particular,

amount of his/her wage;

A bonus may be provided once per quarter;

A bonus may also be provided no more than


three times a year, in connection to the holidays foreseen by the Labor Code of Georgia, according to the set limit and the above
principles.

In addition, exceptions are allowed in the first two cases


above, in terms of frequency and amount of bonuses provided and on the basis of a reasoned written statement
of a head officer and consent of the CEC chair.
As to supplementary pay, by virtue of the Law of Georgia
on Civil Service, Head of a state agency has the right
to determine other supplementary pay during the fiscal
year, taking into consideration overtime work or especially important workload of a civil servant, within the
limits of the salary fund and pursuant to the rules. Supplementary pay should be made within the limits of assignments set by the budget law for spending agencies.
By virtue of Article 9 of the Election Code, during the
election period3, except for by-elections, members and
head officers of the CEC and district electoral commissions, as well as the CEC staff and employees of the Legal Entity under Public Law (LEPL) Center for Electoral
Systems Development, Reforms and Trainings receive
double wage 4. During by-elections, double wage is paid
only to DEC members and head officers in the electoral
district where the by-elections are held.

The Central Election Commission


Payroll
Under the Decree no.26/2015 of the Central Election Commission of Georgia, dated 20 March 2015, the CEC payroll
includes 69 staff members and 13 members of the Commission, and their following wages:
Head Officers: monthly remuneration for the CEC Chair is
5,500 GEL; 4,700 GEL for the CEC Deputy Chair and 4,600
GEL for the CEC Secretary.
10 members of the CEC (non-managerial positions):
monthly remuneration for each member of the CEC is
3,900 GEL.
Employees of the CEC (staff members): department head
3,000 GEL; division head 2,300 GEL; third category
specialist 1,700 GEL; second category specialist 1,450
GEL, 1st category specialist 1,150 GEL.
Freelance workers: the CEC provided total remuneration
for freelance workers, without specifying remuneration
for each individual position.
As noted above, during the election period members and
head officers of the CEC and district electoral commissions, as well as the CEC staff and employees of LEPL
Center for Electoral Systems Development, Reforms and
Trainings receive double wage.

. Compensation for the CEC Senior Officers

4.1. Chair of the CEC


4.1.1. Zurab Kharatishvili
Zurab Kharatishvili served as the Chair of the Commission from January 2011 to September 2013. During his
tenure at the Commission, he managed the 2012 parliamentary elections.5
From January 2011 to September 2013, Zurab Kharatishvili
received a total salary of 320,271 GEL, including 168,156 in
wages, 82,322 in bonuses and 69,793 in supplementary
pays. Total amount of bonuses and supplementary pays
for the CEC Chair amounted to 90.5% of his total wage
(bonus 49%, supplementary pay 41.5%).

amounted to 100% of his wage, while the highest amount
of bonuses and supplementary pays (in terms of their
percentage relative to the wage) was received in months
of October (200%), December (190%) and April (109%).

the CEC Chair received bonuses and supplementary
pays ranging between 50%-250% of
his wage. In April and in November,
bonuses amounted to 100% of his
wage, while the highest amount of
bonuses and supplementary pays (in
terms of their percentage relative to
the wage) was received in December
(250%). In addition, amount of bonuses and supplementary pays was
high in September (113%) and October (138%). Notably, from August

through September the CEC Chair received double wage because it was
an election period, while the amount
of bonuses and supplementary pays
received during the election period
ranged between 65%-138% of that
double wage. Subsequently, remuneration received by the CEC Chair in
September and October was over four
times the remuneration received during non-election period.

between 45% to 258% of his wage, while the highest
amount of bonuses and supplementary pays (in terms of
their percentage relative to the wage) was received in
months of March (258%), April (196%), May (123%) and
August (111%).

4.1.2. Tamar Zhvania


Tamar Zhvania was appointed to the office of the CEC
Chair in September 2013. During her tenure at the Commission, Ms. Zhvania managed two elections the 2013
presidential elections and the 2014 local self-government
elections. 6
From September 2013 through November 2015, Tamar Zhvania received a total salary of 329,520.55 GEL, including 165,123.55 GEL in wages, 66,762 GEL in bonuses and
97,635 GEL as supplementary pays. Total amount of bonuses and supplementary pays received by the CEC Chair
from September 2013 through November 2015 amounted
to 99.6% of her total wage (bonuses amounted to 40.4%,
and supplementary pays to 59.1%).

September through November Ms. Zhvania received double wage. Subsequently, her remuneration in September

From 2011 through December 2013, the CEC Deputy Chair
Davit Kirtadze received total remuneration of 346,869.50,
including GEL 172,408 GEL in wages, 79,977 GEL in bonuses and 94,484.50 GEL as supplementary pays. Total
amount of bonuses and supplementary pays received by
the Deputy Chair amounted to 101.2% of his wage (bonuses amounted to 46.4%, while supplementary pays
amounted to 54.8%).

March (257%), December (232%), November (214%)
and May (123%). During the election period from July
through November, the Deputy Chair received double the
wage; subsequently, in August, September, October and
November he earned more than four times his wage in
non-election period. In April (non-election period) the
Deputy Chair received total remuneration of nearly four
times his wage.

Giorgi Sharabidze was appointed to


the office of the CEC Deputy Chair in
December 2013. From December 2013
through November 2015, he earned
total remuneration of 218,775.36 GEL,
including 116,060.36 GEL in wages,
47,882 GEL in bonuses and 54,833 GEL
in supplementary pays. Total amount
of bonuses and supplementary pays
received by the Deputy Chair during
the period amounted to 88.5% of his
wage (bonuses amounted to 41.3%,
supplementary pays 47.2%).

to 100% of the wage. The Deputy Chair received highest
amount of bonuses and supplementary pays (in terms of
its percentage relative to the wage) in months of July
(175%), December (150%) and April (131%). Similar to the
Chair, the deputy chair also received double wage during
the election period of April-July, and his bonuses and
supplementary pays in April-July amounted to 100% or
more of the increased wage. Consequently, during the
election period in 2014 (May, June, July) the Deputy
Chair earned at least four times his wage in non-election period.

The CEC provided information about total (as opposed
to individual) compensation for 10 members of the Commission (not including the CEC chair, deputy chair and
secretary), stating that based on requirements of law,
personal information can only be provided upon consent

law based on substantiated decision of court, which
does not apply to personal information about head officers7 . By virtue of Article 2 of the Law of Georgia on

specialist, 2nd category specialist, 3rd category specialist) equaled to 3,078,845.54 GEL, including 1,491,633.14 GEL
in wages, 662,964 GEL in bonuses and 924,248.40 GEL as
supplementary pays. Bonuses and supplementary pays
received by the staff amounted to 106.4% of their wage
(bonuses amounted to 44.4%, supplementary pay 62%).
In 2015 (throughout 7 months) total wages received by
the CEC staff (department head, division head, counselor, 1st category specialist, 2nd category specialist, 3rd
category specialist) equaled to 741,669.16 GEL, bonuses
332,782.50 GEL, and supplementary pays 60,247.50 GEL.
Bonuses and supplementary pays received by the staff
amounted to 53% of their wage (bonuses amounted to
44.9%, supplementary pay 8.1%).
We thought it would be interesting to compare bonuses
and supplementary pays received by the CEC members
and those received by CEC staff, in terms of their percentage relative to respective wages, in order to identify
any differences that may exist between members of the
CEC and other employees of the Commission. As an example, we decided to compare the data from 2014.

In 2014, thirteen members of the CEC earned total compensation of 1,555,741.02 GEL, including 751,357.62 GEL in
wages, 337,994 GEL in bonuses and 466,389.40 GEL as
supplementary pays. Consequently, total bonuses received by the CEC members amounted to 44.98% of their
wage, while total supplementary pay amounted to 62%
of their wage.
Total compensation received by the CEC staff in 2014
(department head, division head, counselor, 1st category specialist, 2nd category specialist, 3rd category specialist) equaled to 3,078,845.54 GEL, including 1,491,633.14

Compensation for Freelance Employees

Total compensation received by the freelance employees


of the Commission in 2014 equaled to 2,305,492.40 GEL,
including 1,216,805.48 GEL in wages, 364,282.50 GEL in
bonuses and 724,404.42 GEL as supplementary pays. Bonuses and supplementary pays received by the freelance
employees amounted to 89.5% of their wage (bonuses
amounted to 29.9%, supplementary pay 59.6%).
Total compensation received by the freelance employees
of the Commission in 2015 (throughout seven months)
equaled to 483.212.33 GEL, including 347,949.83 GEL in
wages, 131,862.50 GEL in bonuses and 3,400 GEL as supplementary pays. Bonuses and supplementary pays received by the freelance employees amounted to 38.9% of
their wage (bonuses amounted to 37.9%, supplementary
pay 1%).

Key Findings

Amounts of bonuses and supplementary pays vary each month,


while criteria for determining their amounts and their frequency remains ambiguous. This hinders transparency of spending in
public agencies;

Bonuses and supplementary pays for the CEC members, staff


members and freelance employees are provided on a regular basis, instead of providing them in exceptional cases;

Although Decree of the CEC no.44/2014 determines frequency of


providing bonuses (once per quarter and in connection to holidays), head officers of the Commission continue to have a broad
discretion when it comes to bonuses, because the Decree allows
exceptions based on a reasoned written statement of a respective
head officer and consent of the Chair;

Unlimited amount and frequency of bonuses and supplementary


pays provided throughout years is a systemic problem;

Supplementary pays provided during election period in most cases


are equal to or greater than wages, while during election period
members of the CEC are already receiving double wages;

In most cases, total bonuses and supplementary pays received by


the CEC head officers and members is greater than 50% of their
total wage and in some cases is as high as over 200% of their
wage. We believe that such amounts of bonuses and supplementary pays are unreasonable and uncalled for.

Recommendations

Frequency, justification and amount of bonuses and supplementary pays for members of the EMB and its employees should be
defined clearly and unambiguously, than it is by the existing legislations;

Minimum and maximum percentage of bonuses and supplementary pays relative to wage should be defined. These amounts may

Any financial incentive should be provided for a specific reason


e.g. based on employee evaluation, special merit, etc.;

Supplementary pays should not be provided during election period


as CEC members and employees receive double wage;

Considering the importance of functions fulfilled by the CEC members and the amount of remuneration that they receive, information about wages, bonuses and supplementary pays of each member should be public, like it is in the case of the Chair, the Deputy
Chair and the Secretary.
