WHEREAS, it is the responsibility of state government to provide the citizens of
this Commonwealth with an economical and efficient governmental structure, as well as
regulatory practices that are administered in a consistent, ethical and coordinated manner;
and
WHEREAS, Kentucky’s boxing, sparring, kickboxing, mixed martial arts, and
wrestling shows provide job opportunities and entertainment to the citizens of this
Commonwealth; and
WHEREAS, Kentucky has a proud boxing heritage and has produced world-class
professionals, including Muhammed Ali, the greatest of all time; and
WHEREAS, participation in boxing, sparring, kickboxing, mixed martial arts,
and wrestling promotes the work ethic and character of its participants; and
WHEREAS, boxing, sparring, kickboxing, mixed martial arts, and wrestling
events attract tourism, economic investment, and heighten the stature, reputation, and
prominence of the Commonwealth; and
WHEREAS, participants in boxing, sparring, kickboxing, mixed martial arts, and
wrestling, and their enthusiasts, embody, symbolize, and represent the Unbridled Spirit of
the Commonwealth; and
WHEREAS, it has been determined that the Kentucky Boxing and Wrestling
Authority, as established by the provisions of Chapter 229 of the Kentucky Revised
Statutes, should be abolished, recreated, and restructured with a more focused vision onSecretary of State

unleashing the regulatory and market conditions necessary to attract world-class
professional athletic events to Kentucky and to protect the safety of event participants;
and
WHEREAS, it has been determined that the Kentucky Boxing and Wrestling
Authority Medical Advisory Panel, as established by KRS 229.260, should be abolished,
recreated, and restructured with a focus on providing the newly created Kentucky Boxing
and Wrestling Commission with the advice and guidance it needs to advocate for, and
oversee the health and safety of, participants in boxing, sparring, kickboxing, mixed
martial arts, wrestling, and other full-contact combative sports:
NOW, THEREFORE, I, Matthew G. Bevin, Governor of the Commonwealth of
Kentucky, by virtue of the authority vested in me by the Kentucky Constitution, Sections
69 and 81, and KRS 12.028, do hereby Order and Direct the following:
- The Kentucky Boxing and Wrestling Authority is abolished. The terms of the
members serving on the Kentucky Boxing and Wrestling Authority as it
existed prior to the filing of this Order shall expire immediately upon the
filing of this Order.
I. The Kentucky Boxing and Wrestling Commission (“Commission”) is created
and established as an agency of state government charged with the
responsibility for regulatory oversight and the establishment of sound policies
and procedures governing the conduct of boxing, sparring, kickboxing, mixed
martial arts, wrestling, and other full-contact combative sports within the
Commonwealth of Kentucky. The Commission shall be attached to the Public
Protection Cabinet for administrative purposes. All duties, functions,
responsibilities, records, equipment, staff, and supporting budgets of the
Kentucky Boxing and Wrestling Authority and all functions, rights, powers,
duties, and obligations as set forth in the following statutes and other relevant
provisions of law are transferred to the Commission: KRS 229.011, 229.021,
229.031, 229.041, 229.051, 229.061, 229.071, 229.081, 229.091, 229.101,
229,111, 229.121, 229.131, 229.141, 229.151, 229.155, 229.171, 229.180,
229.190, 229.200, 229.210, 229.240, 229.250, 229.260, 229.991.
Ill, The Commission shall consist of four (4) members appointed by the Governor
and, in addition, shall include the Secretary of the Public Protection Cabinet or
the Secretary’s designee who shall serve as an ex officio, voting member. OfSecretary of State

those members appointed by the Governor, one (1) member shall be a medical
doctor licensed to practice medicine in Kentucky; one (1) member shall be an
attorney licensed to practice law in Kentucky; and one (1) member shall have
experience in sports marketing or promotion. At least one (1) member shall
have no financial interest in the business or industry regulated. The appointed
members of the Commission shall serve for a term of three (3) years at the
pleasure of the Governor, except that of the members first appointed, one (1)
shall serve for a term of one (1) year; one (1) shall serve for a term of two (2)
years; and two (2) shall serve for a term of three (3) years. Any member
appointed to fill a vacancy occurring other than by expiration of a term shall
be appointed for the remainder of the unexpired term. A majority of the
‘members of the Commission shall constitute a quorum for the transaction of
business.
Members of the Commission shall receive one hundred dollars ($100) per day
for each meeting attended and shall be reimbursed for all expenses paid or
incurred in the discharge of official business.
The Governor shall appoint one (1) member of the Commission to serve as its
Chairperson. The Governor shall further designate a second member to serve
as Vice Chairperson with authority to act in the absence of the Chairperson or
if the office of the Chairperson is vacant. The Chairperson and Vice
Chairperson shall serve at the pleasure of the Governor.
Except as otherwise provided, the Commission shall be responsible for the
following:
A. Developing programs and promulgating regulations and procedures which
will aggressively fulfill its oversight and regulatory role with full
accountability and internal controls to protect professional athletes,
spectators, and event participants;
B. Adhering to the best regulatory practices and due process procedures to
protect the regulated community and the interests of the Commonwealth;
C. Developing the Commonwealth's goals of providing professional staff
necessary to ensure that events are effectively regulated while allowing
Commission members to provide the policy oversight necessary to protect
the integrity of the regulatory program; and
D. Promoting Kentucky as a host site for world-class boxing, kickboxing,
mixed martial arts, and wrestling events.
To carry out the functions relating to its duties and responsibilities and to
afford the full experience and resources of the Public Protection Cabinet, the
Secretary of the Public Protection Cabinet or his designee will carry out the
duties and responsibilities of the executive director of the Commission until
such time as revenue of five hundred thousand dollars ($500,000) is generatedSecretary of State

in two (2) consecutive fiscal years by the Commission. After such revenue
condition has been met, and upon request of the Secretary of the Public
Protection Cabinet, the Governor shall appoint an executive director who shall
serve at the pleasure of the Governor. The Governor shall set the
qualifications and salary for the position of executive director under the
provisions of KRS 64.640.
The executive director, who shall employ sufficient regulatory staff for the
Commission, shall be responsible for the day-to-day operations of the
Commission including, but not limited to:
A. Complying with regulations;
B. Issuing licenses and permits;
C. Establishing appropriate organizational structures;
D. Carrying out policy and program directives of the Commission; and
E, Performing all other duties and responsibilities assigned by law.
With the approval of the Commission, the executive director and regulatory
staff may enter into agreements with any state agency or political subdivision
of the state, any postsecondary education institution, or any other person or
entity to enlist assistance to implement the duties and responsibilities of the
Commission.
All administrative regulations previously promulgated under the authority of
the Kentucky Boxing and Wrestling Authority prior to the filing of this Order
shall remain in full force and effect and shall be administered by the
Commission.
‘The Kentucky Boxing and Wrestling Authority Medical Advisory Panel is
abolished. The terms of the members, if any, serving on the Kentucky Boxing
and Wrestling Authority Medical Advisory Panel as it existed prior to the
filing of this Order shall expire immediately upon the filing of this Order.
The Kentucky Boxing and Wrestling Commission Medical Advisory Panel
(Medical Panel”) is created and established as an agency of state
government. In the areas regulated by the Commission, the Medical Panel
shall advise the Commission on matters involving the health and safety of
contestants, medical policy for events and contests, and the fitness of an
individual referred to the panel to compete. All duties, functions,
responsibilities, records, equipment, staff, and supporting budgets of the
Kentucky Boxing and Wrestling Authority Medical Advisory Panel and all
functions, rights, powers, duties, and obligations as set forth in KRS 229.260

‘The Medical Panel shall consist of three (3) to five (5) medical doctors
licensed to practice medicine in Kentucky. The Secretary of the Public
Protection Cabinet shall appoint the members of the Medical Panel except that
the Commission member who is a medical doctor licensed to practice
medicine in Kentucky shall be an ex officio, voting member of the Medical
Panel and shall serve as the Medical Panel's Chairperson. The Medical
“anel’s members shall practice in medical fields that are related to the types of
juries of which a boxing, wrestling, or mixed martial arts contestant is most
likely to sustain. At least one (1) of the Medical Panel’s members must
practice in the field of neurology or neurosurgery.
‘The Medical Panel shall meet at least semi-annually, Each member of the
Medical Panel shall receive one hundred dollars ($100) per day for each
meeting of the Medical Panel and for each day or portion thereof that the
‘member is engaged in carrying out the duties of the Medical Panel.
The Public Protection Cabinet, the Office of State Budget Director, the
Personnel Cabinet, the Finance and Administration Cabinet, and the
Commission shall take all necessary action to effectuate the provisions of this
Order.

This Reorganization is primarily for administrative purposes. This Reorganization
establishes certain membership requirements for the Kentucky Boxing and Wrestling
Commission and the Kentucky Boxing and Wrestling Commission Medical Advisory Panel.
These membership requirements are intended to increase participant safety, promote the
regulatory process, and enhance Kentucky’s ability to compete to host world-class boxing,
wrestling, mixed martial arts, and similar events. It is not anticipated that this Reorganization
will have any budgetary or personnel impact.
