somecases,manythinkthatteensshouldbetriedasadultsinothers,manybelievethat
juvenilesshouldbegivenasecondchanceduetotheiradolescence.So,wheredoesthisline
getdrawn?Shouldunderagedcriminalsbechargedandpunishedthesamewayasadult
criminalsdo?Therearemanyfactorstoconsiderwhendealingwithjuvenilecriminaljustice.
Youngpeoplearebiologicallydifferentfromadults.Brainimagingstudiesrevealthatthe
regionsoftheadolescentbrainresponsibleforcontrollingthoughts,actions,andemotionsare
notfullydeveloped(Garlinger).Garlingerpointsoutthattheyouthbrainissignificantlydifferent
fromafullydevelopedbrain,thus,givingsomereasonastowhyyoungadultsshouldbegiven
slightlymoreslack.Notonlydotheagesofthemurderersmatteralot,butthementalityofthe
murderermatteralotaswell.Thereareverymanycaseswheremurderousjuvenilesare
mentallyunstable.Beingmentallyunstableisnotanexcuseformurder,butitcouldpotentially
coincidewiththereasoningofthecrime.Theageandmentalstateofthecriminaldohavealot
offactorofthehomicide/crimeofanymatter.
Notonlydotheageandmentalstateofajuvenilemurderermatteralot,butthesituation
ofthehomicidehavealottodowiththecourtsdecisiontosubmitachildtoalifesentence
withoutparole.Childrenlackmaturityandhaveanunderdevelopedsenseofresponsibilitythey
aremorevulnerabletooutsidepressureandtheircharactersarelessformedandmoreopento
rehabilitation(Barnes).Inthe2012Washingtonpost,Barnesnoticesthatminorsaremore

vulnerableinstiffsituationsduetotheiradolescence.Manyofthesecasesaredealingwith
eitherachilddefendingthemselves,orjustmurderingoutofmerepleasureandcuriosity.
1. Selfdefenseisjustifiableinmanycases(evenwithoutbeingaminor).
2. Ifachildhastheurgetomurderanotherhumanoutofcuriosity,therearesomemental
issuesthatneedtobetakencareof.
Thesearenottotallyjustifiable,butinsomecases,bothoftheseexplanationsshouldnot
deservealifesentencewithoutparole.About20yearsago,Jacob,asixteenyearold,had
murderedhismotherandstepfatherafterschool.Jacobwassubmittedtolifesentencewithout
paroleeventhoughhisparentswerenotcompletelyallthatinnocent.Jacobsstepfatherhad
beenrapingandabusingJacobandhisbrotherforyearswhilehismotherhadclaimedtohate
herownson.BeingputintoJacobsshoes,mostwouldagreethatJacobsreasoningfordoing
socouldatleastgivehimlesstime.Althoughhomicideisnotsomethingthecourtshouldtake
lightly,therearemanysituationsanddifferentstoriesforeachjuvenilecriminalthatshouldbe
appropriatelyconsidered.
ItmayseemthatJuvenileshavemoreofanadvantagethanadultsdo,buttruthis,the
pointsbeingmadebythesewriters/researchersofjuvenilejusticeandlifesentencingarevery
important.Minorshaveundevelopedbrains,lackofcontrolinthoughts,emotions,actions,and
duetotheirvulnerability,mayfeelpressuredtotakeactionwhenfeelingdangered.Some
minorsmaybementallyill,abusedandfedupwiththeirhomesituations.Thisdoesnotgivethe
courttherighttothrowtheseissuedminorsintoalifesentencewithoutparole.Whendealing
withjuvenilejustice,allofthesefactorsshouldbeseriouslyconsideredwhiledealingwiththe
punishment.Adolescenceisnotanexcuseformurder,butsubmissiontolifewithoutparolefor
anundevelopedhumaniscompletelyunfair.
