AFFIDAVIT OF ADVERSE CLAIM

I, SHIRLEY C. ACOSTA, of legal age, Filipino, married, and a
resident of Ilagan City, Isabela, after having been sworn to in
accordance with law, depose and say:
1. That I am one of the heirs of the late Esteban R. Canicula;
2. That a certain Jaime Dijamco previously entered into a Deed
Sale with Priscila Canicula for the purchase of a parcel of land
which is a portion of lot no.6115;
3. That such lot sold is part and covered by TCT no. T-65546;
4. That as agreed, the owners copy of the said TCT be given to
Dijamco for purposes only of transferring the lot covered by
the sale, however, since then, he never returned the owners
TCT copy
5. That it has come to my knowledge that Dijamco is presently
claiming to have an interest over the whole of the
aforementioned parcel of land and is attempting to sell or
dispose of the same despite the fact that he only bought a
portion of it;
6. That with earnest effort to recover the owners TCT copy to
subdivide among us the heirs the remaining portion of the lot,
he continuously does not heed to our plea to surrender the
same to us;

7. That with fear that our rights as heirs over the portion of the
whole lot unsold to him be transgressed, I cause this adverse
claim;
8. That unless an adverse claim is annotated on the
aforedescribed Transfer Certificate of Title, the heirs of
Esteban R. Canicula are in danger of being defrauded and
deprived of their just and valid right over the aforedescribed
portion of the whole of the unsold parcel of land and, as such,
I am executing this Affidavit in support of my request for the
annotation of an adverse claim over the parcel of land
described herein.
