Q: What is the Ees RIGHT TO SELF-ORGANIZATION?

A: It is the right of the employees to FORM, JOIN or ASSIST in the FORMATION of a labor organization of their own
choosing for purposes of collective bargaining through representatives of their own choosing and to engage in LAWFUL
CONCERTED ACTIVITIES for purposes of collective bargaining or for their mutual aid and protection.
Q: What is the DUTY TO BARGAIN COLLECTIVELY?
A: It means the performance of the mutual obligation of the Er and the union to promptly and exeditiously in good faith to
bargain collectively for the purpose of negotiating an agreement with respect to salaries, wages, hours of work and all other
terms and conditions of employment.
Q: What is a LABOR ORGANIZATION?
A: It is a union or association of employees whihc exists in whole or in part for the purpose of COLLECTIVE
BARGAINING or DEALING WITH ERS conerning terms and conditions of employment. If it is duly REGISTERED with
wthe DOLE, it is called "LEGITIMATE LABOR ORGANIZATION".
Q: What is an INDEPENDENT UNION?
A: It is any labor organization operating at the enterprise level whose legal personality is derived through an independent
action for registration.
Q: What is a CHARTERED LOCAL?
A: It is a labor organization in the private sector operating at the enterprise level that acquired legal personality through the
issuance of a CHARTER CERTIFICATE by a DULY REGISTERED FEDERATION or NATINAL UNION and
REPORTED to the Regional Office.
Q: What is a NATIONAL UNION?
A: It is a group of LEGITIMATE LABOR UNIONS in a private establishment ORGANIZED FOR COLLECTIVE
BARGAINING or for DEALING WITH EES CONCERNING TERMS AND CONDITIONS OF EMPLOYMENT for their
member unions or for PARTICIPATING in the FORMULATION of social employment policies, STANDARDS and
PROGRAMS, registered with the Bureau.
Q: Who are ENTITLED under the Code to EXERCISE the RIGHT TO SELF-ORGANIZATION?
A: (a) All persons employed in COMMERCIAL, INDUSTRIAL and AGRICULTURAL ENTERPRISES and in MEDICAL
or EDUCATIONAL INSTITUTIONS RELIGIOUS, CHARITABLE.
(b) AMBULANT, INTERMITTENT and ITINERANT WORKERS, SELF-EMPLOYED people, RURAL WORKERS and
those WITHOUT any definite Er.
