To make access to your unemployment benefits easier
and safer, the Kansas Department of Labor will issue your
benefit payment by debit card (refer to page 9 for further
information).

T his brochure provides general information about your rights


and responsibilities when filing for unemployment insurance
benefits. This information does not have the effect of law or
regulations, but may help answer questions you have about filing
your claim. If you have questions or a problem with your claim
that is not covered in this brochure, contact the Unemployment
Contact Center. Phone numbers, Web site address and business
hours are provided on page 19. You can also visit our Web site
to review the Frequently Asked Questions.

Y ou may file an application for unemployment through the


Internet or the Unemployment Contact Center.
EXCEPTION: In the past 18 months, if you worked in a
state other than Kansas or had military service and/or
federal employment, you will need to file your claim through
the Unemployment Contact Center.

Initial Claim Information

To be eligible to receive unemployment benefits, you must be unemployed


under circumstances that do not disqualify you from receiving benefits – be
able to work; be available for work; and be willing to accept suitable work.

If you have earned enough wages to qualify for benefits, you will be entitled
to receive unemployment benefits for those weeks when you are either totally
or partially unemployed and meet all unemployment requirements. The law
sets qualifying requirements in several areas: your past wages, your job
separation, ongoing availability and work search. You must meet all of the
requirements to receive benefits.

A formula is used to calculate the amount of benefits based upon wages paid
to you during a prescribed base period.

Your weekly benefit amount (WBA) is how much you can receive each
week. To calculate your WBA, multiply your highest quarter wages by 4.25
percent. There is a minimum and maximum WBA set by Kansas law. If your
figure is higher than the current maximum, you will receive the maximum
WBA. If the calculated WBA is less than the current minimum benefit amount,
you will receive the minimum WBA.

Example: If your claim was effective in July 2009, your base period would be
the 2nd, 3rd and 4th quarters of 2008 and the 1st quarter of 2009.

BASE PERIOD EARNINGS


2nd qtr. 2008 (Apr/May/June) – $4,500
3rd qtr. 2008 (Jul/Aug/Sep) – $10,260 Highest earnings
4th qtr. 2008 (Oct/Nov/Dec) – $6,500
1st qtr. 2009 (Jan/Feb/Mar) – $5,000
$10,260 x 4.25% = $436 as the WBA

To qualify for benefits you must have been paid wages from insured
employment in at least two quarters, with the total of your wages being at least
30 times your WBA. Using the example shown above:
30 x $436 (WBA) = $13,080 Total base period wages are $26,260
(In this example the individual would qualify.)

If you qualified under the alternate wage base period, your benefit amount will
be based on the last four completed calendar quarters.

Your total benefit amount (TBA) is the smaller of two possible amounts.
Using the information from the example above:

#1 – Multiply your WBA times 26 . . . . . . . $436 x 26 = $11,336


#2 – Divide the total of your base period wages by 3

Total Base Period Wages: $4,500 + $10,260 + $6,500 + $5,000 = $26,260


26,260 divided by 3 = $8,753
$
Therefore, $8,753 is the total benefit amount as it is less than $11,336.

The benefit year is a period of 52 consecutive weeks which begins on the


Sunday of the week in which your application is filed. Your claim is good for
one year; however, you have a limited amount of benefits to draw in that one-
year period of time.

You cannot file consecutive or back-to-back claims, unless you have worked
since filing your first claim and earned eight times your new calculated weekly
benefit amount.

What is a one-week waiting period?


Under certain circumstances you must serve a one-week non-payable waiting
period for each new unemployment claim or benefit year. To count as a
waiting period week, you must file a weekly claim and be entitled to benefits
for the week. The waiting period will be waived and payment will be made if
you are laid off due to lack of work because the employer terminated business
operations in Kansas, the employer declared bankruptcy or the employer
initiated a layoff subject to the Worker Adjustment and Retraining Notification
(WARN) Act.

If you do not meet any of those three conditions, the waiting week will be paid
after you have filed a weekly claim for benefits for the waiting week period
and for two consecutive weeks immediately following the waiting week.
Failure to file a weekly claim or to meet the eligibility requirements during one
or more of those three weeks will result in the waiting period week not being
paid.

What is a personal identification number (PIN)?


The Internet and phone systems require you to set up a four-digit Personal
Identification Number (PIN). Your four-digit PIN is your electronic signature
and it will help protect you from another person obtaining information about
your claim or filing against your claim.

Select four numbers you will remember. Your PIN can only be numbers: Do
not use numbers in sequence like 1234 or same numbers like 1111 or 2222.
Do not give your PIN to anyone, including your spouse. You are
responsible for any activity on your claim using your PIN. Each
time you use the Internet or phone system to file your weekly claim, you will be
asked for your PIN.

If you forget your PIN or you believe someone else knows your PIN, you
should change your PIN immediately. You may reset your PIN on the Internet
or by calling the Unemployment Contact Center to create a new PIN.

What is a User Name and Password?


When filing online, you must create a unique user name and password so the
computer will be able to recognize you. Make note of your user name and
password. You will need to use it to file your weekly claim for benefits. Your
user name and password must each be at least six characters long. You may
use numbers and letters in your password. It should be something you can
remember and others cannot guess.

If you have used our Web site to apply for unemployment benefits at another
time, you must use the same user name and password you set up when you
completed the application the first time.

What happens after I file a new claim?


After you file your unemployment claim, the department will determine if you
have sufficient wages to qualify for a weekly benefit amount. You will receive
an “Unemployment Insurance Determination” in the mail that lists the wages
we have used to determine whether you have been paid enough to qualify for
a weekly benefit amount and, if so, what that amount will be. The form will
show:
• The beginning date of your claim
• The amount of wages reported by each employer
• Your base period
• Your weekly and total benefit amounts

If you believe wages are listed incorrectly or some of your wages are missing,
contact the Unemployment Contact Center. You will be asked to provide
proof of the correct wages by furnishing check stubs, W-2 statements or other
documents. You must file weekly claims while we investigate the
wages used on your claim.

Even if the “Unemployment Insurance Determination” shows


that you are entitled, this does not mean that you will receive
benefits. It may be necessary for us to determine whether or not you are
entitled to receive unemployment.
• The department will determine if you meet the basic eligibility
requirements for benefits such as being able and available for work.
• The department will determine if your separation from employment will
disqualify you from receiving benefits such as a voluntary quit without
good cause, a discharge for misconduct, a medical separation or
receiving separation pay.

Your employer(s) are notified you have filed an unemployment claim. If


your separation is for other than lack of work, both you and your employer
will be asked to provide separation information. You will receive a letter
approximately seven days after you file your application for unemployment to
inform you of the date and time we will contact you for a phone interview to
obtain separation information. Failure to be available for the phone interview
may result in a denial of benefits.

Can I use wages I earned in another state, the military or the


federal government?
When you file an application for unemployment, report all employers for
whom you have worked in the last 18 months.
• If the employer is out of state, we will request wages from the other
state(s).
• If you have wages from military service, you will be required to provide
a copy of your DD-214, Member 4.
• If you have wages from federal employment, you will be required to
provide a copy of your SF-8 with attachments of an SF-50, W-2 or
check stubs.

Payment of benefits may be delayed until we receive the requested wages.


When we receive the wage information, another Unemployment Insurance
Determination listing these wages will be mailed to you. You must continue
filing your weekly claims for payment while we are waiting for the requested
wage information.

How do I reopen my claim after I stop filing?
Your unemployment claim will become inactive if you fail to file a weekly
claim for payment within 17 days, or if you have exceeded your weekly
benefit amount in earnings. Your claim must be reopened if it becomes
inactive or you will not be able to file weekly claims. Whether filing by
Internet or phone, your reopened claim will begin on Sunday of the week you
file the reopened claim. You can reopen your claim through the Web site at
www.GetKansasBenefits.com or by calling the Unemployment Contact
Center.

Weekly Claim Information

When do I file my first weekly claim for payment?


After filing your unemployment application, you must file weekly claims by
Internet or phone to receive your benefit payment. The calendar week for
unemployment compensation purposes runs from midnight Sunday through
11:59 p.m. the following Saturday. We recommend that you file your weekly
claim for the previous week on Sunday. However, if you are unable to do so,
you may file Monday through Friday (see Weekly Claim Line hours on page
19). Continue filing each week in order to receive your weekly payment. If
there is a state or federal holiday during the week, payments will be delayed.

What information do I need to file a weekly claim for payment


by Internet or phone?
Information you need to file a weekly claim for payment:
• If filing through the Internet – your user name, password and PIN.
• If filing by phone – your Social Security number and PIN.
• Gross wages (before deductions) earned (not received) during the
week being claimed. Report any earnings for the week in which you
worked, not the week in which you receive payment for that work. This
includes any pay received as a Reservist for weekend drill and annual
training participation.
• Gross amount for any vacation or holiday pay earned for the week
being claimed.
• Gross amount of severance pay received for the week being claimed.
• Paper and pencil to write down any information or instructions you may
be given while filing.
There is no toll-free phone number available for filing a weekly claim. We
recommend filing your weekly claim by Internet to avoid long distance charges.

Internet Filing – At www.GetKansasBenefits.com, click on “Filing
a Weekly Claim.” Log in or Create User Name/Password. After you have
answered all of the questions, your answers will be displayed for you to
review. You will be able to click “Back” to change your answer(s) or click
“Submit” to process your weekly claim.

You may be instructed to call the Unemployment Contact Center, or download


a form to provide information regarding your eligibility. If you have questions
about how to use the system, contact the unemployment help desk at the
number provided on the Web page for assistance.

Phone Filing – Call your weekly claim line number found on page 19.

PRESS 2 – To file a weekly claim for payment of benefits. Answer each


question by pressing “1” for “Yes” or “9” for “No.” All of the questions
apply to the specific calendar week you are claiming. If you answer “Yes” to
questions 1, 2, 3, or 4, you will be asked to enter your gross wages for the
week. First enter the number of dollars earned followed by the star (*) key.
Next enter the number of cents earned followed by the (*) key. If you hang
up before the system tells you your unemployment weekly claim has been
accepted, your answers will not be saved and you will have to file your claim
again.

What questions will I be asked when filing a weekly claim?


Giving false information or answering questions for anyone other than you
constitutes fraud and is punishable by law.

Question 1: Did you work, as an employee, anytime Sunday through


Saturday during the week being claimed?
If “yes,” you will be asked to enter the number of hours
worked, as an employee, during the week being claimed.
Question 2: Did you receive holiday pay for the week being claimed?
If “yes,” you will be asked “Were you required to work the
day before or day after the holiday to receive the holiday
pay?”
Question 3: Did you receive any vacation pay for the week being claimed?
If yes, you will be asked if you are temporarily laid off with a
definite date to return to work.
Question 4: Did you receive severance pay for the week being claimed?
Question 5: Did you refuse work during the week being claimed?
Question 6: Did you quit a job or were you fired from a job during the
week being claimed?
If “yes,” you will be asked “Have you already reported
to the Contact Center that you quit or were fired from this
employment?”

Question 7: Did you attend school or enter training during the week being
claimed?
Question 8: Did you receive or change any type of pension, other than
Social Security benefits, during the week being claimed?
Question 9: Did you apply for or receive any workers compensation for
the week being claimed that was for a work-connected injury
or disability?
Question 10: Were you physically able to work four or more days of the
normal work week during the week being claimed?
Question 11: Were you available for work, with no undue restrictions, for
four or more days of the normal workweek during the week
being claimed?
Being available for work with no undue restrictions means
there was nothing which would have prevented you from
accepting work had it been offered to you.
Question 12: Did you look for work, as directed by the Kansas
Unemployment Contact Center or Internet claims system,
during the week being claimed?

How do I get paid?


You must file a weekly claim for payment for each week you want to receive
benefits. Payments will be made if all eligibility requirements have been met.
Your claim becomes inactive if you have not filed a weekly claim for payment
or had any other activity on your claim for 17 calendar days. See “How do I
reopen my claim after I stop filing?” on page 7 for additional information.

If you are determined to be eligible for a benefit payment, you will receive
a Visa debit card by mail from Citi Prepaid Services, a division of Citibank,
N.A. The card will be mailed to you from Citi’s Omaha, NE, card distribution
center and will have the Kansas Department of Labor’s logo on the envelope.
Benefits will be deposited in your Citi debit card account each week you file a
weekly claim and are determined eligible for benefits. The debit card can be
used for retail purchases anywhere Visa is accepted, for cash withdrawals at
an ATM, as cash back through a retail purchase or as a cash withdrawal from
a teller at any Visa-member bank. For more information about ATM locations
and how to access your benefits without incurring a fee, visit our Web site at
www.GetKansasBenefits.com or Citi’s Web site at www.prepaid.citi.
com/kansas.

If you prefer to transfer your benefits directly to your account at a financial


institution, you may arrange for this through Citi when you receive your debit
card. If you used direct deposit for a previous claim, you will have to set up a
transfer of funds through Citi.

When will I be paid?
If there are no issues on your claim, payments normally are sent the next
working day following receipt of your weekly claim. Benefit payment will not
always be deposited in your debit card or bank account on the same day
each week. They may be delayed because of holidays or temporarily held
while an issue is being investigated. You must file your weekly claim while any
investigation is in progress.

What are some reasons payments may be denied?


• You have a medical condition that prevents you from seeking or
accepting work immediately.
• You are not available to seek or accept work immediately.
• You are receiving workers compensation for temporary or permanent
total disability under the Workers Compensation Law of any state.
• You are not a U.S. Citizen or national and do not have legal work
authorization.
• You have placed unreasonable restrictions on the wages, hours, days or
locations of a job you will accept.
• You are not looking for work.
• You did not report for or satisfactorily participate in re-employment
services when told to do so.
• You are involved in a strike or labor dispute.
• You are self-employed.
• You are attending school or training, which prevents you from seeking or
accepting work, unless it meets the requirements for approved training.
• You are on a leave of absence from your job.
• You are a school employee who is unemployed between school years or
terms.
• You have refused suitable work.

How can I find out if my benefit payment has been issued?


You can obtain information concerning the status of your claim anytime
through our Web site at www.GetKansasBenefits.com by selecting
the “Get Claim Status” option, or by selecting option “1” through the phone
weekly claim line. You will be able to get information about:
• The last three weeks you claimed.
• Date and amount of your benefit payment and the amount of benefits
remaining.
• If a benefit payment was not issued, the system may be able to tell you
the reason.
• If the amount of your benefit payment is reduced because of earnings,
pension, child support deduction or any other reason, the system will tell
you the amount of the deduction and the reason for it.

You can obtain information regarding your debit card account through Citi
by calling their toll free number 1-800-582-4910 or through their Web site at
www.prepaid.citi.com/kansas.

How can I get information about my claim not available through


the Internet or phone weekly claim line?
If you have questions which cannot be answered by the Weekly Claim Internet
or phone system, contact the Unemployment Contact Center for assistance. The
local Workforce Centers cannot answer unemployment claim questions. Refer
to Internet and Unemployment Contact Center Address and Phone Numbers on
page 19.

Can anyone obtain information about my unemployment claim?


It is against the law for the agency to give information about your claim
to anyone else, including your spouse, other family members or friends.
Therefore, do not ask others to contact the Unemployment Contact Center for
information you need. If you cannot call, you may contact the Unemployment
Contact Center by mail. Specify what information you need and be sure to
include your Social Security number, name and address, phone number and
your signature.

Eligibility

What is an eligibility review?


An eligibility review is a periodic review of your efforts to find work to ensure
you are meeting the requirements for seeking appropriate work.

All unemployment insurance claimants must provide information concerning


their search for work (eligibility review form) when requested. Failure to
provide this information may result in a denial of benefits which could cause
an overpayment of your unemployment benefits that you would be required
to pay back to the agency. If your eligibility review form is returned late, you
must explain why the form is late.

Members of a placement union or claimants on a temporary layoff are not


required to apply for work. They must be available for assignment to a job or
recall by their employer and must return their eligibility review form to report
their current employment status.

Can I work part time and receive benefits?


You may receive some unemployment benefits for a week in which you work
less than full time and earn less than your weekly benefit amount (WBA). You
must look for and be able and available to work. You must report your gross
wages (wages before deductions) and not your take-home pay. This includes
any wages received as a Reservist for weekend drill and annual training

participation. All wages from employment must be reported during the week
when they were earned, not when you receive them.

You can earn up to 25 percent of your determined WBA without a reduction to


your unemployment benefits. Any earnings over 25 percent of your WBA will
result in a deduction on a dollar-for-dollar basis. If your gross wages equal or
exceed your WBA, the 25 percent allowance will not apply.

EXAMPLE 1: Wages LESS THAN 25 percent of your WBA


$100 (WBA) x 25 percent = $25
Your wages = $10 for the week
$10 is LESS than $25 therefore, no deduction is made.
Your unemployment payment will be issued in the amount of $100.

EXAMPLE 2: Wages MORE THAN 25 percent of your WBA


$100 (WBA) x 25 percent = $25
Your Wages = $60 for the week
$60 is MORE than $25, therefore, $60 - $25 = $35
$100 (WBA) - $35 = $65
Your unemployment payment will be issued in the amount of $65.

What do I do if I go back to work full-time?


If you go back to work full time or have gross earnings (before deductions) that
equal or exceed your weekly benefit amount, you should stop filing weekly
claims and your claim will become inactive.

If you are unemployed again within the same benefit year, or if your hours are
reduced and your gross pay is less than your weekly benefit amount, you may
file a claim application against your remaining balance. You will not have a
one-week waiting period if you already filed for the waiting period week. If
your benefits were exhausted the first time you filed, and your benefit year has
not ended, you will not be eligible for further benefits until the benefit year
ends. At that time, you may file an application to establish a new benefit year.

Will other income reduce my benefits?


Vacation, holiday and severance pay may reduce your unemployment benefits
when paid under certain conditions. If you receive these types of payments
while claiming unemployment benefits, you must report this information when
you file your initial application or weekly claim for payment.

If you are receiving a pension which is based upon earnings from an employer
who is in your base period, then your weekly benefit amount may be reduced.

Examples of pensions that may reduce your benefits:
• Military retirement
• Union pension
• Private employer pension
• Federal civilian pension
• State, county or city pension

If you are receiving a pension, a “Pension” form will be displayed for you
to complete if filing through the Internet, or if filing by phone, you will be
instructed to report the pension to a claims specialist. If your pension reduces
your weekly benefit amount, you will receive a Notice of Determination to
inform you what the reduction is. Social Security benefits will not reduce your
weekly benefit amount.

What happens if I am overpaid?


If you receive benefits you are not entitled to, you are required to repay the
benefits, even if someone else made the mistake that caused the incorrect
payment. When an overpayment is detected, we issue a notice telling you
how the overpayment occurred, the amount overpaid and how to repay the
amount due us. If you believe that the notice is incorrect, you have the right to
appeal.

Contact the Benefit Payment Control Unit (phone number below) to make
arrangements to repay any overpayment. You may be able to repay an
overpayment in a lump sum or by making installment payments. When you
have an overpayment, we must withhold any benefits you are claiming so that
they may be applied to the overpayment. In addition, any state tax refund you
may be due will be intercepted and applied to the overpayment in each year
an overpayment remains.

It is to your advantage to repay overpayments as soon as possible. Kansas


law requires that we collect interest on your overpayment, which over time will
increase the amount you must repay.

Disqualifications
All determinations concerning your eligibility to receive unemployment
insurance are made in accordance with the Kansas Employment Security
Law, K.S.A. 44-706. A copy of the law may be obtained at your local
public library or online at www.kslegislature.org. A written Notice of
Determination will be sent which will explain the reason for any disqualification
on your claim.

1. A claimant is disqualified for voluntary leaving work without good
cause, unless the reason for leaving was for one of the following
exceptions:
• Quit due to illness or injury upon the advice of a licensed and
practicing health care provider.
• Quit temporary work to return to your regular full-time employer.
• Quit to enlist in the armed forces of the United States, but were
rejected or delayed from entry.
• Quit due to working conditions hazardous to your physical, mental or
moral well being.
• Quit due to unwelcome harassment by the employer or another
employee.
• Quit to accept better work.
• Quit because the employer requested that you violate an ordinance
or statue.
• Quit due to a violation of the work agreement.
• Quit due to a personal emergency.
• Quit due to the voluntary or involuntary transfer of your spouse from
one job to another.
• Quit to enter training approved under the Federal Trade Act of 1974.
• Quit due to circumstances resulting from domestic violence.

2. After completing a temporary job assignment, you may be disqualified


if you fail to request an additional assignment on the next workday, if
required by the employment agreement.

3. If you were discharged or fired from your last job for misconduct
connected with the work. “Misconduct” is defined as a violation of a
duty or obligation reasonably owed the employer as a condition of
employment.

4. If you fail to apply for or accept suitable work when offered by the
Workforce Center or another employer. You will be disqualified
beginning with the Sunday of the week in which the refusal occurred.

The disqualification in the first three examples is effective the day after the
separation and continues until you become re-employed and have insured
earnings of at least three times your weekly benefit amount.

“Gross Misconduct” is defined as extreme, willful or wanton misconduct. A


disqualification for gross misconduct begins the day after the separation and
remains in effect until you are re-employed and have insured earnings of at
least eight times your weekly benefit amount. In addition, all wage credits
earned from the employer who discharged you for gross misconduct are
canceled.

Other disqualifications
• If you are claiming or receiving unemployment insurance benefits under
another state or federal law.
• If you receive a back pay award or settlement.
• Employees of educational institutions are disqualified between terms if
they: (1) had a contract for work in a recently completed academic year
or term and (2) have a contract or reasonable assurance of employment
with an educational institution in the same or similar position for the next
academic year or term.
• School bus or other motor vehicle drivers, employed by a private
contractor to transport students and school personnel to or from school-
related activities, are disqualified for benefits, between academic years
or terms if they have a contract or reasonable assurance of employment
with a private contractor for the next academic year or term.
• Employees of governmental entities and certain nonprofit organizations
that provide services to or on behalf of an educational institution are
disqualified for benefits between academic years or terms if they have a
contract or reasonable assurance of employment for the next academic
year or term.
• Professional athletes are disqualified between sports seasons if: (1) they
were employed in the past sports season as a professional athlete and
(2) have a reasonable assurance of being employed as a professional
athlete in the following sports season.
• Students – if you are registered and attending an established school
training facility or other educational institution, or are on vacation
during or between two successive years or terms (i.e. fall, spring
and summer breaks) you are disqualified for benefits unless you are:
(1) working full time while attending school; (2) attending approved
training; or (3) attending evening, weekend or limited daytime classes
and you are otherwise eligible.
• You are disqualified for a period of one year and prosecuted for making
false statements for withholding material information to obtain benefits
not due.

Additional Information

How do I change my address?


Notify the Unemployment Contact Center of any change of address. You
can change your mailing address online, in writing or by calling the Contact
Center. We recommend using the Internet. Online address change information
is located in the area where you complete your weekly claim.

Any mail we send you cannot be forwarded to your new address by the U.S.
Postal Service. If you move after you have stopped claiming benefits, you
must inform us of your change of address to ensure you receive your Form
1099-G for income tax purposes. When requesting a change of address by
mail, be sure to include your name, Social Security number, previous address,
new address and your signature. You must also notify Citi of your change of
address as well so that you are sure to receive any correspondence they may
mail to you regarding your debit card account.

What if I have been ordered to pay child support?


Questions concerning child support deductions should be directed to your
area Department of Social and Rehabilitation Services (SRS) office, not the
Unemployment Contact Center. If you are responsible for court-ordered child
support payments and are behind in your payments, SRS will initiate an order
to take part of your unemployment insurance benefits.

Are my benefits taxable?


• Unemployment insurance is taxable income and is subject to state and
federal income tax.
• If you want to have federal income taxes withheld from your weekly
unemployment benefits, complete the authorization form “Agreement to
Withhold Federal Income Tax from Unemployment Insurance Benefits”
on page 22. Ten percent (10%) of your weekly benefit amount will be
withheld for your federal income tax. No withholding is available for your
state income tax.
• You also can download the withholding form at the Web site www.
GetKansasBenefits.com. Click on the “Documents” link at the top of
the page to access the form.
• In January, IRS Form 1099-G will be mailed to you stating the amount of
unemployment insurance benefits paid to you during the previous year as
reported to the IRS. Note: It is your responsibility to promptly inform the
Unemployment Contact Center of any address change to ensure the 1099-
G is mailed to your correct address.
• The Form 1099-G must report the total amount of benefits paid to you in
the calendar year.
• If you repaid some or all of those benefits in the same calendar year they
were received, you or your tax preparer will need to adjust the amount
that is reportable on your federal income tax return. Refer to your income
tax instructions for guidance on how to do this.

How do I get help finding a job?


To receive job placement assistance, you must register for work. You can
register for work, look for a job or reactivate your registration on the Internet
at www.KANSASWorks.com by selecting the link “Create a Job Seeker
Account” or by visiting a Workforce Center in your area. A list of Kansas
Workforce Centers is found on page 23. A wide array of services and

assistance are available through the Workforce Centers. Free Internet access is
available through many public organizations, such Workforce Centers, public
libraries and some schools.

What important things should I remember?


• The Unemployment Contact Center receives the highest volume of calls
on Monday and Tuesdays. If you have questions, we recommend you
call on Wednesday, Thursday or Friday.
• Promptly report any claim information changes (name, mailing address,
phone number) to the Unemployment Contact Center.
• We can discuss your unemployment claim only with you. Please do not
have a family member or friend call with questions about your claim as
we cannot give them any information.
• Written inquiries regarding your unemployment claim should always
include your Social Security number, name, address, phone number and
your signature.
• You must use the Internet claim site or the Weekly Claim Line to obtain
information concerning payment for a prior week or about your claim
balance.
• You are responsible for your unemployment claim and all your security
information. Do not give your PIN (Personal Identification Number) to
anyone or allow anyone else to file your weekly claims. Doing so may
result in an overpayment of benefits that you will be required to repay.

What are my appeal rights?


If you disagree with your Notice of Determination, you may file an appeal.
Your appeal rights and time limits for filing an appeal are explained on the
Notice of Determination. If you do not file within the stated time limit, you
may lose your right to appeal. Generally, only circumstances beyond your
reasonable control will be considered good cause for late filing. You can
file the appeal by mail or fax to the Office of Appeals, 401 SW Topeka
Boulevard, 2nd Floor, Topeka, KS 66603-3182, fax: (785) 296-4065.

After you request an appeal, you will receive a notice with instructions
that explain what you must do to participate in your appeal hearing. Most
hearings are held by phone call. It is important that you participate in the
hearing since the decision on your claim will be based only on information
given at the hearing. Failure to take part in the hearing may result in a
decision against you. At the hearing you will be given an opportunity to
present facts you believe are important to your case. If witnesses are needed
to help present your case, you must arrange in advance for them to participate
in the hearing.

You must continue to file your weekly claim for payment for
each week you are unemployed. You will not be paid for any
week for which you have not filed a weekly claim for payment,
even if an appeal decision finds you eligible for benefits.

If you are found eligible for benefits, your former employer may disagree and
can file an appeal. An employer’s appeal does not cause your benefits to stop.
It is important that you participate in the hearing on the employer’s appeal
to ensure your evidence is considered. If the employer wins the appeal,
however, unemployment benefits you have been paid will be considered an
overpayment and will require repayment.

What you can do to keep your claim moving:

• Complete and return all information requests promptly. The sooner we


have answers to our questions, the sooner we can make a determination.
• Pay attention to information requests that appear on the “confirmation”
page when you file your claim online. They must be printed, filled out and
returned before we can process your application.
• Watch your mailbox. We may send you requests for additional
information. And if you move, let us know immediately; our mail cannot
be forwarded.
• Send your information to the address or fax number indicated on our
form.
• Print clearly, answer all the questions and explain yourself fully.
• Make sure your name and social security number are on all pages of
correspondence.
• Be available when we schedule your determination phone call. It
might come a little earlier or later in the day because of the length of other
scheduled calls.
• Continue to file weekly claims each week you are unemployed even
while an investigation is underway.
