1 INTRODUCTION

)

1.1 Devon County Council (The Council) has resolved to apply to the Secretary of State for the powers to undertake on-street parking enforcement, as made possible through the provisions of the Traffic Management Act 2004. This document also represents the Council's application for bus lane enforcement powers under the provisions of the Transport Act 2000.

1.2 The specific area for which the powers are requested is the area of the County of Devon, including the trunk roads that are the responsibility of the Highways Agency, excluding the roads that are the responsibility of Torbay Council and Plymouth City Council who are Unitary Authorities, as shown in the map in Appendix C. The area includes all District, Borough and City Council off-street car parking places.

1.3 The commencement date will be 5th May 2008.

1.4 The County Council and each of the constituent second tier authorities have agreed that an application should be made seeking the powers as set out in this Application. Copies of the resolutions from the County Council, Exeter City Council, the Borough and District CounCils are included in the formal application appended. (Appendix D).

1.5 Devon County Council, ("The Council"), following discussions with Exeter City, the Borough and District Councils ("The Districts") has carried out all of the necessary steps required to enable proper and successful implementation of the new powers. Specifically:

The Council has an Agency Agreement with each of the Districts for enforcement of on-street parking restrictions and moving offences. Each District has agreed to work with the Council and deliver the onstreet restrictions enforcement on its behalf, in conjunction with the Districts off-street enforcement.

The Council has completed an extensive review of its traffic regulation orders (TROs), involving checking the signs and lines on-site, and incorporating these into a geographic information system (GIS). An extensive programme of amendment and consolidation of TROs is now complete. The Districts have checked and confirmed that their offstreet parking orders are also enforceable.

The Districts have procedures to ensure successful implementation of a parking service. including:

• the employment of civil enforcement officers,

• the processing of penalty notices,

• the management of representations and appeals,

• the issuing of parking permits.

• the management of the necessary systems .. interfaces and databases.

The Council has informed the National Parking Adjudication Service that

Devon County Council and the Districts will wish to join the service, and that appeal hearings will be required as a consequence of the commencement of enforcement. The NPAS have confirmed their willingness to act in this role.

2 CONSULTATION

2.1 In preparing this application, The Council has consulted widely with other organisations including:

2.2 Results of these consultations are summarised at Appendix B, and attached as a result of the receipt of responses from these organisations.

3 DETAILS OF APPLICATION

3.1 Extent of Civil Enforcement Area I Special Enforcement Area

3.1.1 The CEA I SEA will" cover the whole of the area administered by the County Council as the highway authority and all off-street car parking places administered by the Districts as the car parking authorities.

3.1.2 The trunk road network including slip roads will be included in the CEA I SEA. This includes the roads set out in the table below that are the responsibility of the Highways Agency and has been agreed with them, see response to consultation letter in Appendix B:

3.1.5 The Council has agreed with the Ministry of Defence not to include roads' owned by them, where military by-laws limiting parking exist within the areas.

4 PARKING REVIEW

4.1 The County Council has undertaken a full review of the traffic regulation orders in Devon to which this Application relates.

4.2 Broadly:

4.2.1. Each existing TRO item within each Schedule has been checked for its accuracy as represented by the signs and lines on the ground;

4.2..2. Each has been checked by virtue of being entered onto a geographic information system;

4.2.3. Errors and general wear and tear issues have been addressed to ensure aU Orders are enforceable.

4.2.4. Orders have been checked and altered to ensure they conform to the requirements of ePE legislation.

4.3 This work has been completed in preparation for the commencement of the powers. Consolidated Orders and amendment orders will be made accessible to the National Parking Adjudication Service. A letter of conformation will be submitted at least six weeks prior to the commencement of powers date, suitably endorsed and signed by the Director of Environment, Economy and Culture.

5 PARKING POLICY

5.1 Devon County Council has developed an Enforcement strategy, which contains a set of Parking Policies. These are derived primarily from the Local Transport Plan

and the objectives for the County Councils' Strategic Plan. The overriding strategy and subsequent policies are contained in Appendix E to this Application.

5.2 The policy statements are consistent with the policies of the Districts who have been widely consulted during the development and submission of the Local Transport Plan (L TP) on which the policies are largely based.

5.3 The County is supported by the Districts in its application of CPE powers. The Districts and County will work closely to achieve an appropriate service for all parking enforcement.

5.4 As well as the underlying strategic policies taken from the L TP, in Devon we have also developed a set of basic principles that specifically relate to CPE, these were approved by the County Executive and include the following;-

• CPE will be designed to improve the day to day management of traffic and enable the appropriate turnover of on-street car parking to support the Devon Congestion Strategy, access to local. businesses and the Network Management Duty imposed by the Traffic Management Act.

• It will not involve an aggressive enforcement regime aimed at maximising income.

• CPE will be used to provide adequate enforcement of residents parking schemes within the available resources.

• There will be a transparent use of CPE resources so that the public can access Devon' parking policies and see what level of enforcement will be provided with the available resources.

• The potential of new technology will be maximised for CPE in Devon to monitor the network and for enforcement activity, to ensure an appropriate and efficient service.

6 PENALTY CHARGE LEVEL

6.1 It is proposed to introduce the £70 I £50 differential Penalty Charge throughout the whole of the County Council area. The Charge Level will apply to all infringements of all on-street parking places and waiting restrictions within the legislation.' The Charge Level will be discounted by 50% for payment within a minimum of 14 days, and will be incremented by 50% on issue of a Charge Certificate. Following rejection of an initial objection or, under certain circumstances, of a formal representation, the Districts will offer a further 14 days for the payment of a Penalty Charge Notice at the discounted rate.

6.2 The Council is also applying for the powers to use clamping, removal, storage and disposal of vehicles and will use the charges set in regulations, or as subsequently modified by Government, should such regulations be introduced. At the commencement of powers the Council does not propose to utilise the powers to clamP""vehicles, but does intend to utilise the power to remove vehicles that are parked causing an obstruction to the highway that results in a negative impact on the expeditious movement of vehicles. Additionally the Council will be applying for all future powers to enforce moving offences when regulations are introduced under the Traffic Management Act and this application is also for bus lane enforcement powers under the provisions of the Transport Act 2000.

7 PARKING OPERATIONS

7.1 PCN Processing

7.1.1 The work of the administration of the parking function in relation to PCN processlnq, will be undertaken by a ticket unit(s) run by the Districts, or by one of its agents on its behalf. The Districts will be responsible for the receipt of postal payments, for the processing of Notices and Charge Certificates, and for dealing with first stage correspondence in response to the issue of penalty charge notices. The Districts will also deal with subsequent stages of correspondence relating to penalty charge notices, Including handling representations, dealing with cases called for by the adjudicator, dealing with cases which the Authority wishes to pursue to the county court. and any subsequent action. For any PCN issued on-street. the Districts will consult with the Council prior to processing a case to the National Parking Adjudication Service.

7.1.2 The ticket unit(s) will use interfaces to external organisations including

the DVLA, the County Court and the National Parking Adjudication Serv.ice.

7.1.3 It will be possible for members of the public to pay for their PCNs in person at any of the District Offices, and through the use of debit or credit cards on the telephone, the web, or by post. Payments will be accepted by cheque in the case of postal payments, and by cash, cheque, credit (where possible) or debit card for personal payments .. The ticket wnit(s) will accept the telephone and postal payments for PCNs.

7.2 Clamping

7.2.1 The Council does not intend to introduce the use of clamping at the outset of the implementation, believing that it is unnecessary at present and does not comply with its policy of non aggressive enforcement. However, this application includes a request for the powers to introduce clamping so that at some time in the future, should it be deemed necessary. a decision may be taken to introduce the use of clamping by the County Council.

7.2.2 Should such a decision be made, it is confirmed that the service provisions as described and required within Guidance will be fully met, in order to provide a service which is sensitive to public needs, and responsive to the requirements of those who have been clamped.

7.3 Vehicle Removals

7.3.1 As with clamping, the Council believes that at this staqe, there is no need to undertake the removal of parked vehicles in permitted parking areas where the parking charge has expired. However. this application includes a request for the power to be able to remove vehicles, as deemed necessary, that are parked on a restricted part of the highway or causing an obstruction to the network.

7.3.2 The County Council confirms that the service provision will meet the stipulations laid out in Guidance as to the needs of the driver in all respects,

and a vehicle will only be removed when it is parked in a dangerous or obstructive manner to a safe and un-obstructive place on the highway. The Council will not be using these powers to remove a vehicle to a compound at

, the commencement of operations, as it Is believed that the quantity of removals required under these criteria will be relatively small and would not justify a dedicated compound.

7.4 PCN Enforcement

7.4.1 A service will be established by the Districts, by use of in-house employees, to cover the enforcement of yellow lines, permitted parking places and other "CEA I SEA" contraventions.

7.4.2 The Districts will deploy 36 Civil Enforcement Officers (CEOs) Monday to Sunday, 7.30am - 6.30pm. Additionally, to cover other restrictions such as residents' parking areas, enforcement will take place outside of the core hours as deemed necessary by the Council.

7.4.3 PCNs will be issued using computerised hand-held ticket issuing devices which will be of an approved design. There will also be back-up manual systems available. Standard contravention codes will be used when issuing peNs.

7.4.4 CEO uniforms will be worn in accordance with regulations. The design of the uniform will be in accordance with the stipulations of "The Civil Enforcement Officers (Wearing of Uniforms) (England) Regulations 2008.

7.4.5 The CEO wilt carry a personal photo-identity card which will have an individual number for each officer, but will not identify them by name. CEOs will also carry personal voice radios I mobile phones to maintain a constant contact with their base in order to request assistance when needed.

7.5 Alteration of Pay and Display Equipment

7.5.1 The Council and Districts are responsible for payment equipment maintenance and for changing Pay and Display equipment to use the term "penalty" and not "excess", and to remove the use of the term "Initial" in the context of the charges. This will be completed before the start of new operations, or if this is not practicable, within six months of the commencement date.

7.6 IT Provision

7 .6.1 The Districts will be making provision for the processing of parking tickets, and related aspects by utilising a ticket unit within their area, w.ith several of the Districts resolving to work together on this provision. The new IT system will be installed for operational use well in advance of the commencement. of local authority enforcement.

7 .. 6.2 The IT system will be developed to handle PCN processing, to deal with Permit Management, and to have a link to a geographic information system to assist in the management of parking. The system will have the

facUities to interface to DVLA and the TEC (Traffic Enforcement Centre), and will exploit the advantages of image processing for correspondence management. The system will also have a front end internet access for member of the public to be able to view details and evidence of a PCN that has been issued to them. It will allow internet payment of the peN at the appropriate rate.

7.7 Exemptions and Dlspensatlon Notices

7.7.1 The following vehicle types/individuals from the following groups will be exempt from ePE regulations/will be issued with dispensation notices as appropriate:

Vehicles being used or appropriated for use by Crown or visiting armed forces, or in the public service which are not required to be registered under the provisions of the Vehicle Excise and Registration Act 1994, the Visiting Forces Act 1952 and the Vehicle EXcise and Registration Act 1994 as appropriate.

Fire service vehicles Ambulances

Police vehicles Removal vehicles

Diplomatic registered vehicles

Members of the medical profession including carers Blue Badge holders

Local or Water Authority vehicles being used in pursuance of statutory duties Post Office Vehicles

These vehicles will be exempt from restrictions as described in the Traffic Regulation Consolidated Order, For any other vehicle requiring dispensation a temporary notice or permit will be lssued.

7.7.2 A database holding records of dispensation allocation will be held and

GEOs will be briefed on the vehicles that have dispensation on a regular basis.

7.8 Pavement Parking

7.8.1 Exeter City Council has introduced a local Act banning the parking of

vehicles on pavements and verges and this will be enforced by the GEOs in Exeter.

7.8.2 Further investigation will be made into the appropriateness of

restricting pavement parking in other areas of the GEA.

8 PUBLICITY

8.1 The County Council and the Potrce Authority will be coordinating a joint communications programme, to explain to the public the transition of powers.

8.2 A publicity programme is being prepared using press, leaflets and local radio.

Opportunities to meet interest groups in person are also being taken when requested. The aim will be to advise and prepare motorists of the forthcoming changes, to offer advice on where and how to park legally, and to encourage the use of other modes of transport, in accordance with the County Council transport objectives.

8.3 The opportunity will also be taken to define for the public the Councils' policies for parking, including our enforcement priorities.

9 DOCUMENTATION

9.1 The Council has overseen the design and production of all of the necessary forms, notices, letters, etc. Such documentation has taken note of Guidance, standards set in the Code of Practice for Parking Enforcement (COPPE) and by the TCfL When in due course, NPAS develop their own electronic procedures, the Council will comply with their documentation standards.

9.2 The PCN, Notice to Owner and Charge Certificate has been based on existing guidance in regulations for CPE, with only minor modifications for local identification.

9.3 All documentation will be ready for use for the commencement date.

10 TRAINING

10.1 Training to recognised standards for CEOs and administrative staff has been carried out by specialists in this field. Within the service, all existing and new CEOs will work towards NVQ I City and Guilds assessment and certification as appropriate.

10.2 All CEOs have beentrained, and will conduct themselves in accordance with policy and guidance which will be set out in a handbook issued as part of their training. This policy and guidance will also be made available to the public so that they are also aware of the level of discretion that a CEO may apply when issuing a ticket. It will be made clear that CEOs are there to offer help and advice on where to legally park and the issuing of a PCN will be the last resort, but once it is issued the CEO cannot remove it.

11 DVLA AND TEC ACCESS

11.1 The Districts ticket units are responsible for obtaining DVLA data for processing the PCNs. The IT systems will interface to the TEC for the registration of appropriate cases at the County Court. Both of these organisations have been consulted as part of this application.

12 BAILIFF SERVICES

12.1 For cases which remain unpaid after the registration of debt at the County Court, and for which there are no outstanding items of correspondence, representations, or appeal to the adjudicator, the Council will consider the issue of warrant registration proceedings and the appointment of bailiffs to recover the debt.

13 REPRESENTATIONS

13.1 The consideration of representations against a Notice to Owner will be conducted by the District's ticketing unit staff. The sending of letters of acceptancelrejection will be undertaken by them. This win take no longer than fourteen days from receipt.

13.2 Representations will only be received by post and dealt with by post at the initial stage. As technology develops and the internet access front end notice processing programme allows, correspondence for an lnformai representation will be administered by email.

13.3 The Districts will have discretion over which appeals will be progressed for offstreet PCNs issued and the Council will have final discretion over appeals for the on-street PCNs. Each District will consult the Council prior to submitting an appeal case to the National Parking Adjudication Service resulting from on-street enforcement.

14 ADJUDICATI.ON

14.1 The Council and Districts have identified their intentions to the National Parking Apjudication Service, and win use this service.

14.2 Where the appellant wishes to have a personal hearing, adjudicator sessions will be heard locally within the appropriate District or at another convenient hearing centre, at the request of the appellant. The County Council has consulted with NPAS on this issue, and win take the NPAS advice regarding the availability of local hearing centres.

14.3 Access to an adjudicator will be arranged through the defined NPAS procedures.

14.4 The Parking IT system will enable the evidence required for adjudication to be assembled for transfer from the ticketing units to the Adjudication Service. The Adjudicator will be supplied with the necessary data in accordance with the guidance laid down, and specified in relevant procedures,

15 SPECIAL CATEGORY DRIVERS

15.1 The review of on-street parking provision includes provislon for those with special needs such as disabled drivers. The parking policies and operational instructions for CEOs include the special policies to be applied in the cases of disabled drivers, diplomats, and exempt vehicles. In this respect, the recommendations of the Guidance have been adopted.

16 SIGNING AND PLATING

16.1 All parking regulations have been signed in accordance with OfT regulations and guidance. A review of signing policy of yellow lines has taken place in conjunction with the review process described earlier. The implementation of any

changes will be completed by the relevant commencement date.

17 FINANCIAL ASSESSMENT

17.1 An assessment of income and expenditure has been made and a summary is attached as Appendix A. It is projected that future operations may achieve a slight surplus. but only after an initial period of deficit while the initial investment is recovered. The aim is to achieve a cost neutral service which will be monitored closely.

17.2 The revenue projection from peNs is based upon the following assumptions:

• A CEO will issue on average 6 peNs per shift.

• 70% of these peNs being paid;

• 75% being paid at the discounted level;

• 5% being paid at the surcharge level;

• 20% being paid at the full rate;

17.3 In accordance with Guidance, the Council will report annually to the Secretary of State on the financial results of civil parking enforcement, and any action which the Council will take in respect of any deficit or surplus on the on-street parking account. 18 CUSTOMER CARE

18.1 The County places great emphasis on customer care. The Council is continually reviewing policies aimed' at improving customer care and public understanding.

These policies will be embodied in our operational procedures. For example:

A high standard for replying to correspondence will be set and will be maintained in line with The Councils Performance Indicators;

Warning notices will be issued for certain offences; for example. a motorist displaying a resident's permit which has recently expired;

All staff will undergo comprehensive training to achieve recognised standards of competence.

The Council has recently set up a Customer Service Centre to handle enquiries from the public which makes it easier for them to contact the council through one Single number. As part of the CPE process the Customer Service Centre will be utilised to ensure the public has easy access to the parking services around the county.

Each District will also ensure good access for public contact with their parking service.

Thank you, for your email dated 11th September .2007 in reference to the above.

The proposals set out in your letter seem satisfactory to the Traffic Enforcement Centre (TEC). Please provide the TEC with a copy of your appJlcatlonsent to the Department for Transport. Please find enclosed a copy of the TEG Code of Practice, which sets out the procedures to be followed by Local Authorities when registering charges with the Court.

Also enclosed are a short questionnaire, TEG procedural flowchart and the most recant TEC newsletter.

The prefix code, which has been allocated is DV before commencing issue with the TEG, you will need to carry out the following actions:

1. Complete the short questionnaire enclosed.

2. Submit test data at least 6 weeks prior to going live via disk or electronic transfer.

3. Decide how registrati.on fees will be paid either by cheque, postal order or BACS.

4. The following TEC forms would need to be approved by the court: }> Order for Recovery (PE2)

}> Statutory Declaration (PE3) }> Warrant of Execution (PE9)

CIVIL PARKING ENFORCEMENT & ADJUDICATION

Thank you for your email of 12th March 2007. I am setting out below the adjudication arranqements as they apply to parking enforcement under the Road T ridflc Act 1991, which at this stage are. not likely to be .ch anged significantly under the Traffic Management Act 2004. However it is anticipated that the regulations made under this Act conceming civil parking enforcement will be laid before parliament during the summer of 2007 and therefore, until that time, weare unable to confirm final arrangements.

I note your intended start date is 1 April 2008· and, in this respect, you will probably wish to seek guidance from the Department for Transport regarding your application.

I can confirm when the council takes up civil parking enforcement under the Traffic Management Act 2004, that adjudication will be available to Devon County Council via the National Parking Adjudication Service.

The regulations will require adjudicators to be appointed jOintly with the eXisting 1991 Act authorities and those joining under the 2004 Act. By signing to become a party to the NPASJC agreement on the.CivU Enforcement Area commencement 'date the County Council will have the benefit of these jointly appointed adjudicators.

In order for the council to use the NPAS adjudication service it will be necessary for their solicitor to be given authority to enter into an Agreement under Section 101 of the local Government Act 1972, established by the existing authorities who make up the NPAS Joint Committee.

Please find enclosed a copy of the current NPASJC Agreement tor the council's information. The wording of this agreement will reviewed in the light of the implementation of the regulations under the Traffic Management Act 2004.

It will also be necessary for the council to fonnally nominate a RepresentaUve (Councillor, depending on the style of the council's executive arrangements) to serve on the Joint Committee. It is recommended that they also nominate a sUbstitute Representative. Because of the size of the [oint committee the representative need not be an executive member. Joint Committee meetings are scheduled for January and June each year with other ad-hoc meetings as necessary.

The cost sharing I charging arrangements for the service are reviewed by the joint committee on an annual basis and have been fixed for the year commencing 1"1 April 2007 as follows:

Fees are paid by the enforcing council quarterly in advance, based on an agreed number of PCNs they estimate will be issued and then revised regularly once the actual number is available, there is no joining fee.

I am enclosing some guidance notes for the identification of hearing venues. We will revie"", the requirements for a local hearing venue and liaise with you in this respect.

NPAS aims to be a user-focused tribunal and I am taking this opportunity to include some information about initiatives that we are taking to improve accessibility for appellants which, at the same time; are complementary to

the effectiveness of the appeals process.

NPAS holds a one day Council Induction Day at our offices in Manchester and we will liaise with the council prior to commencement regarding the date for this induction. Prior to that once we have a clearer idea of the timetable for implementing the new regulations, we will make contact with you.

In the mean time I can confirm that when the council takes up civil parking enforcement powers under the 2004 Traffic Management Act that adjudication will be available via the National Parking AdjudicatIon Service, and this letter should serve the purposes of the application to DfT for the 2004 Act powers.

The Executive considered the report of the Director of Environment, Economy & Culture (EEC/07/306/HQ) on the County Council's proposed assumption of powers to take on the civil enforcement of parking under the Traffic Management Act 2004 (TMA 2004) in accordance with the Executive's previous decisions and the draft scheme submitted to the Secretary of State in April 2007. The report outlined the proposals for delivery of the service and sought authority to mak.e a formal application to the Secretary of State.

The Director reported that the parking enforcement scheme would be delivered by working in partnership with District Councils and Exeter City Council. On-street and offstreet parking enforcement would be combined by delegating powers to each District to enforce the on-street restrictions in their area.

Members noted that District Councils had initiall'y indicated their preference to work together in groupings to aid efficiency, flexibility and consistency of delivery of the service which would form the basis of further development of the scheme.

• the opportunities for improyoo direction and oversight of the enforcement effort and for better integration between on- and off-street parking provision were to be welcomed;

• it was to be reg retted that this was the second instance in recent months where the Police had advised tha Council of their relinquishment of a traditional role and paSSing the responsibility on to local authorities:

• the Departm.ent for Transport's arrangements for managing the transition to Civil Parking Enforcement could leave a one-month hiatus between the old and new arrangements and therefore the Executive should urge the Devon & Cornwall Constabulary to maintain its enforcement efforts so far as possible untit the new system is operating;

• it is regrettable that the DfT's requirements for bringing District Council off-street enforcement into the same regime at this time haQ militated against the establishment of a single, countywide IT system for the Civil Parking Enforcement service;

• in view of the element of uncertainty over the period during which the new system would not be paying its way and how large the accumulated shortfall may prove to be (the dates for the remittance of penalty income to be agreed with Districts will clearly have a bearing on this)0he Executive should determine whether any shortfall would be made good from reserves or at the expense of other programmes within the Environment, Economy & Culture Directorate;

• Civil Enforcement Officers would lack the present powers of Traffic Wardens to deal with cases of obstruction;jhis would limit their effectiveness in, for example, dealing with problems around schools during drop-off and pick-up periods unless the Police are also willing to allocate resources to the problem;

• it is not clear how the Civil Enforcement Officers would be given the collective or individual mobility necessary to achieve the desired geographical coverage and what capital costs might be entailed;

• it would be important to determine as soon as possible what training and guidance Enforcement Officers would receive in dealing with conflict and what back-up systems there will be to ensure their safety and support

It was MOVED by Councillor Rogers, SECONDED by Councillor Greenslade and

RESOLVED

(a) that an application be made to the Secretary of State for Transport for the necessary powers to enforce parking restrictions in Devon;

(b) that authority to apply to the Secretary of State for Transport be delegated to the Director of Environment, Economy and Culture;

(c) that civil enforcement be delivered by delegating powers to the City and District Councils and Service Level Agreements be negotiated with the City Council and each District Councilor any joint partnership of Districts;

(d) that authority to negotiate and agree Service Level Agreements with the City and District Councils be delegated to the Director of Environment, Economy and Culture and Director of Finance, IT & Trading;

(e) that the County Council join the National Parking Adjudication Service Joint Committee and the Executive Member for the Environment be appointed to represent the Council on that Committee;

(f) that consideration be given to inclusion within the County Council capital programme of resources to establish and equip the Clvll Parking Enforcement Service and to provision within the ravenue budget of funds to cover the start up and ongoing project management;

(g) that a consolidated Traffic Regulation Order for the whole of the Civil Enforcement Area (Devon) be advertised and, If there are no objections, the Order be made and seated;

(h) that since Civil Enforcement Officers would lack the present powers of Traffic Wardens to deal with cases of obstruction and as thrs would limit their effectiveness in, for example. dealing with problems around schools dropping-off and picking-up periods, the Executive strongly requests the Police to allocate resources to this type of problem;

(i) that accordingly a meeting be held wlth senior officers of the Devon and Comwall Constabulary and Members of the Police Authority;

(j) that reports be requested from HATOCs in 12 months time on the operation oflhe Civil Parking Enforcement scheme and that those reports be brought to this Executive as the basis of any review of progress.

The report of the Head of Administration and Parking Services was submitted informing Members of the proposed introduction ofa Civil Parking Enforcement scheme for Devon from May 2008 and seeking in principle support from Executive for this Council to enter into appropriate partnership arrangements with the County Council and other Districts to deliver the scheme effectively. The Devon and Cornwall Constabulary had announced their intention to withdraw from on-street parking enforcement, via the traffic warden service, with effect from 1 April 2008.

He recorded his concern that Devon County Council had not progressed lthe initiative with more haste in view of the significant work that was involved in .introducing an integrated scheme covering both on and off-street parking enforcement. He was particularly concerned about the difficulty of reviewing and 'advertising traffic orders within the required timescale and expressed his view that the Police and County Council had significantly under-resourced the project.

The Director Economy and Development reported that he shared concerns about the challenging timetable for the project but looked forward to a position whereby the Council controlled on and off-street parking He acknowledged that it would be important to ensure that staff affected were trained for and comfortable with their new roles.

.Members were aware that the position of Exeter as a potential unitary authority would be an important factor in these discussions since it was obviously desirable to put in place arrangements that would continue to meet the City's needs after April 2009. They welcomed the potential for an integrated self-financing service under the control of the City Council and believed that this would be welcomed by the public. Concerns were expressed about the low priority currently given to .enforcement by the Police at present. One member commented that he had found

the local beat officer to be helpful in responding to enforcement problems. t-

(1) the proposed introduction of Civil Parking Enforcement be noted and the County Council's application to the Department for Transport be supported subject to further discussion and agreement on the financial and operational details of implementation; and

(2) any decisions about Civil Parking Enforcement that are required to meet the Department for Transport timescale be delegated to the Director Economy & Development, in consultation with the Leader and Portfolio Holder for Sustainable Development and Transport.

Members considered the correspondence between Devon County Council and the Chief Executive in respect of Civil Parking Enforcement. The current positi.on was that parking enforcement in Devon was carried out by Traffic Wardens employed by the police. The Councils were now advised that this service was to be withdrawn. The Department of Transport was currently implementing new regulations which would introduce Civil Parking Enforcement as part of the Traffic Management Act 2004 to come into force in April 2008.

RESOLVED that delegated authority be given to the Chief Executive, in consultation with the Portfolio Holder - Economy, to conclude a district based service level agreement In respect of on-street enforcement powers under the Traffic Management Act 2004, subject to there being no additional cost to the District Council of entering into such an agreement.

partnership of South Hams, West Devon and Teignbridge to war!< with Devon County Council to manage Civil Parking Enforcement (CPE) In the South Devon and Dartrnoorarea, as soon as was possible after the withdrawal date. The proposals were seen to be a positive opportunity to work on a two tiered partnership approach for a standardised parking service through shared services. In addition, the proposals offered an opportunity to ensure that authorities at district level would have a future role in helping to manage parking services within local communities throughout the South Devon and Dartmoor area.

During discussion, the following points were raised:-

(a) It was noted that West Devon and Teignbridge had already, in principle, agreed to the proposals. In addition, a report was to be considered at Devon County Council in November 2007;

(b) Some Members expressed their alarm at the short timescale proposed. In response, officers advised that there were indications that the Police may move the suggested withdrawal to a later date but that an update report would be presented back to the Executive in due course;

(c) In supporting the proposals, a Member considered the partnership arrangement as an example of an improved working relationship between Devon County Council and the district councils;

(d) In acknowledging that this was an in principle agreement, some Members stated a number of associated concerns with the presented report which included:

- the gap in timescale, with the changes not realistically being completed by May 2008;

- the lack of financial information and a lack of recoqnition as to where the IT capital and

increased staffing costs were likely to derive from.

Whilst accepting these concerns, officers advised that the decriminalisation of the operation was a national decision, which resulted in the Police having no future role in the process. The District Councils were working together with Devon County Council to find a solution. Members felt it was a high risk strategy to opt out of the partnership and would be to the financial detriment of both the Council and its residents; .

(e) The comment was made that to increase the local management of the operation should be welcomed, Furthermore, it was noted that income generated from the scheme would be able to be utilised by the Council, as system operators.

RESOLVED

That an approach to Civil Parking Enforcement in partnership with West Devon and Teignbridge District Councils and Devon County Council be proceeded with,

in principle, subject to further details on any outstanding matters and the financial arrangements.

CIVILIANISED PARKING ENFORCEMENT: A PARTNERSHIP APPROACH

The Corporate Director (NP) presented a report which had been circulated separately to the agenda and which outlined proposals to work with South Hams and Teignbridge District Council together with Devon County Council to manage civilianised parking enforcement when the Police officialJy withdrew traffic warden services on' 1 April 2008, If all Councils involved agreed to the proposals, an application would need to be made to the Department of Transport in November 2007. Further work would be required on the detail of the partnership before implementation.

It was moved by Councillor J McInnes, seconded by Councillor R Pike and upon the motion being submitted to the Meeting was declared to be CARRIED and "RESOLVED that Council proceed, in principle, with the outlined approach to civilianised parking enforcement in partnership with South Hams and Teignbridge District Councils and Devon County Council subject to further details on any outstanding matters and the financial arrangements being brought before, and agreed by, the Environment & Comm unity Committee".

80. CIVIL PARKING ENFORCEMENT (CPE)

The Car Parks Manager advised the Committee that a previous CPE application to the Department for Transport by Devon County Council had been rejected due to lack. of expressed interest at a district level. There is now a requirement by the Traffic Management Act 2004 for a joint application between DeC and the Devon districts.

It was noted that the Police are officially withdrawing traffic warden services with effect from 31 March 2008. The CPE will apply to on and off street operations.

The Committee sought assurances regarding finances and acknowledged the need to move forward in partnership with a more cohesive way of working towards local solutions to protect the quality of life for residents.

Resolved: That approval be given in principle to the submission of an application to the Department for Transport for the implementation of CPE in Torridge subject to a full understanding of the financial and operational effed on service provision, and to pursue partnership working with our neighbouring authorities.

The Executive considered a report by the Transportation and Market Manager (previously Circulated) regarding the Proposed Civil Parking Enforcement.

DECISIONS

(a) That it be agreed in principle that the Council work with Devon County Council on the following basis:

(i) We reserve the right to withdraw if the cost/benefit analysis is not satisfactory or the terms ot the service agreement)s not realistic; and

(ii) The submission of the existing off-street car parks into the scheme does not prejudice or limit the Council's plans for the re-development of those car Executive: 10 December 2007 9 parks at Seven Brethren Bank, Queen Street and Multi-Storey at Barnstaple and Central Car Park at

South Molton; and

(iii) The submission of the existing off-street car parks into the scheme does not prejudice or limit the ability of the Council to Include them in any future development plans and to deal with them treely as owner;

(b) that a letter be sent to Devon County Council to advise that the proposed date of May was too short a timescale and that avenues should be explored to keep the responsibility of enforcement with Devon and Cornwall Pollee until such time as Devon County Council was in a posnlon to provide the service.

REASONS FOR DECISION

(a) To enable Devon County Council to proceed with their application whilst serving the right to withdraw trom the agreement if the costs were not borne by the COU!lty Council.

(b) To preserve existing and future development options.

Consideration was given to a report • ~ Minute 49 [32kbl[SubscribeJ of the Head of Customer Services indicating that on-street parking enforcement would change from the Police to Devon County Council (DCC) from May 2008.

The Head of CUstomer Services indicated that DCC was undertaking preparatory work for the change and would be applying for powers from the Department of Transport (DoT), probably in November 01. The DoT was looking for evidence that each District Council, in two tier areas, would be signing up for the service. In Mid Devon the major impact would be that the role of the District Officers in enforcing the Council's off-street car parks would be merged within the role of the new on-street enforcement service. A meeting would take with representatives of the DoT in early October to discuss the implications.

RESOLVED that

(a) the Council supports joint working with other Devon Authorities to provide for on-street enforcement from May 2008; and

(b) a further report be submitted to the Executive when castings are available. (Proposed by the Chairman)

Wider Traffic Management and Local Tran.sport Agenda

Devon's strategy, included in the L TP and Congestion Management Strategies in the Four Priority Areas is to manage traffic on three levels:

• Strategically, by the management of demand and modal shift.

• Tactically. by better planning of foreseeable activities on the highway

• Operationally. by responding in real, time to causes of congestion. This will be the core role for the HOCC and the ePE service.

Parking Strategy

The strategy should ensure that a clear message is sent to the public. Where traffic regulation is required the regulations can be split into 2 groups: those that prohibit an activity and those that permit. Each regulation should consider the following:

A. Prohibited Parking to be used for:

• Managing Congestion on Key Strategic Route

o Waiting !Ioading Prohibitions to keep routes free for movement • Improving Road Safety

o Providing inter visibility

o Promoting Safety Outside Schools • Ensuring Access to Highway Network

o Preventing blocking of accesses

• Improvement to Amenity

o Preventing parking on footways

o Preventing damage to verge or open space

o Protecting historic buildings I structures

o Promoting community markets

B. Permitted Parking to be. used for:

• Managing Congestion I Demand Management Tools

o Physical Restraint by limiting spaces

o Fiscal restraint by on-street charging

o Time restraint by imposing time restrictions

o Restraint by Vehicle Type or Class ( including by permit)

• Managing Accessibility

o Provision of disabled bays

o Provisions for shop-mobility

o Provision of bays for car clubs I community car schemes

o Provision of Bus and Taxi Bays

o Provision of parking for cycle and motorcycle on street

• Balancing Kerb-space Demand

o Provision for shopping I commercial

o Provision for loading

o Zoned pricing I duration

o Residents Parking

The parking strategy will need to co-ordinate with the off-street charging regime and strategies of the District Councils, to ensure that vehicles are encouraged to park off street, rather than occupy on-street spaces.

1. Preamble

The primary function of the highway is for the movement of traffic. There is not a right to park on the highway or to use a particular parking space on a section of the highway where . parking is permitted. However, parking is allowed where this does not impinge on the movement of traffic or where it does not create safety hazard, or obstruct access to property or for emergency vehicfes, or cause damage to the fabric of the highway.

Residents parking schemes provide formal parking arrangements and can be a useful tool in appropriate circumstances for managing demand for parking.

Residents' Parking schemes can provide improved access to parking for residents who do not have alternative off-street parking.

Residents' parking schemes are desi.gned to give relief to residential areas from all day commuter parking.

The principles for residents' parking schemes in Devon are:

(i) The area covered by the scheme should normally tie sufficiently large to

accommodate the anticipated demand, within the eligibility rules, from residents for permits.

(ii) It should be clear that displaced parking would or could be accommodated. (For example in off-street car parks or by a modal shift to park and ride or by car sharing journey savings).

(iii) Schemes should provide a mix of residents' only spaces and limited waiting

spaces, including pay and display where appropriate, for short-term visitors.

(Iv) The costs listed below should be covered by the charge for the permit together with any other income generated by related on-street parking schemes or from third party costs. The costs are:

• scheme administration,

• traffic order costs,

• scheme implementation costs,

• maintenance of the scheme,

• enforcement of the scheme.

(v) A scheme does not provide a space outside the permit holders' house and does

not guarantee a parking space.

2. Policy

2.1 Residents Parking Schemes.

(i)

Where appropriate, residents' parking schemes shall be introduced as part of a joint on-street/off-street authority Traffic and Parking Strategy,

(ii) In the absence of a joint Traffic and Parking Strategy, Residents' Parking schemes may be developed in appropriate circumstances as part of a community parking management plan that considers the needs of aU users and delivers the objectives of the Devon Local Transport Plan. Such schemes would therefore need to:

• Support one of the Congestion Action Plans for Exeter, Newton Abbot, Barnstaple and Totnes,

• Support a Park and Ride Scheme which provides a sustainable public transport alternatives to car travel to a town,

(iii) Residents' P.arking schemes shall not be introduced in towns and villages where there is a problem due to high residential car ownership and high visitor numbers and where there is no alternative for visitors that would be displaced by a Residents' Parking scheme.

2.2 General Assessment Criteria.

(i) The operation of Residents Parking schemes within a community must be substantially self financing as far as the County Council is concerned, by receipts from the issue of permits and allied on-street pay and display schemes.

(ii) The majority of residents should not have privately available off-street parking either within the curtilage of, or close to, their property. As a guide, 75% of the properties in a Residents' Park.ing Zone should have no alternative off-street" parking. Also, sufficient off-street public parking (free or at a reasonable annual price) should not be available within the immediate vicinity.

(iii) The level of demand for residential parking assessed through appropriate surveys can be met within the area being considered.

(iv) Parking spaces must not be introduced that would compromise road safety or obstruct the flow of traffic.

(v) Specific parking spaces are not allocated for parking within a zone.

(vi) Permits are issued annually, all applications being vetted to check for evidence of residence, car ownership and limitations on permit availability.

(vii) Valid permit holders can park without charge in pay and display spaces if included in the particular scheme.

2.3 Eligibility for Permits

(i) Residents within the zone at the time of scheme implementation shall be eligible for permits. The eligibility for permits is restricted to those qualifying residents on the date of implementation of the scheme. The residents of any subsequent new development or redevelopment within the area covered by the zone are not automatically eligible for permits.

(ii) Provision may be made in some schemes far residents permits to be issued with a driver'S and company's name rather than individual vehicle details, where the resident is obliged to use anyone of several different company vehicles.

(iii) Second homeowners shall be treated as permanent residents.

(vii) Businesses which require on-street parking for essential business purposes and not just to provide convenient commuter parking for employees of the business shall be eligible for business permits

Residential visitor permits shall be available to all residents in the zone. Such permits shall be issued in a book of 30 day permits and shall be limited to two issues per year.

Essential visitor permits shall be available to all residents who provide evidence of a need for regular visitor support to care for an ailing or disabled resident in the-zone.

Social workers, occupational therapists and voluntary workers delivering essential services to residents within the zone shall be allowed to park in a

Residents Parking Zone whilst performing home visits. They will be required to display Information in their vehicle that will enable traffic wardens to check that they are parking to enable them to carry out their essential social service duties.

(viii) A Registered Charity shall be treated as a business, but permits shall be supplied at a reduced fee.

2.4 Rationing of Permits:

(i) The number of Residential Permits shall be limited to a maximum of 2 per residential address, which is an address that is registered with the Post Office and City I District and therefore is paying Council Tax.

(ii) A limit of 1 permit per residential address may be appropriate in some schemes to provide a better match between the availability of permits and the on-street supply of parking places.

(iii) The number of Business permits shall be limited to a maximum of 3 per business.

2.5 Cost of Permits

(i) Annual Residential Permits shall be issued at a fee of £12.

(il) Annual Business Permits shall be issued at a fee of £25 for the first permit, £75 for the second permit and £150 for the third permit.

(iii) Annual Business Permits for Registered Charities shall be issued at a flat rate fee of £12.

(iv) Residential visitor permits for a book of 30 permits shall be issued at a cost of £12 for both the first and second issue.

(v) Social workers, occupational therapists and voluntary workers delivering essential services to residents within the zone will be allowed to park free of charge within the zone whilst performing home visits.

(vi) Annual Essential Visitor permits shall be issued at no charge.

(vii) Replacement of lost or damaged permits, new permits issued part way through a period (e.g. new residents) or residents changing vehicles shall be charged at the full annual rate for the particular class of permit.

(viii) Applications for permits are made available over the internet, with a discount of 20%.

(ix) Permit costs shall be reviewed annually and revised as appropriate to cover scheme administration costs.

2.6 Enforcement

(ii)

Adequate enforcement is of paramount importance and schemes require a specification for enforcement to be set down.

An appropriate proportion of the funds derived from Residents Parking scheme permit charges and allied Pay and Display charges shall be used to finance enforcement of schemes.

Policy

On street parking bays for the disabled (blue badge holders) will be provided where it can be demonstrated there is a real need, because of parking being at a premium, at:

(I) Private residence/work place

Provided:

• The applicant Is the blue badge holder and normally the driver of the vehIcle for which the bay is

required.

• There is no off-street parking available at or near the residence.

• The applicant's General Practitioner confirms the applicant's serious lack of mobility

• The police support the need for the provision.

• If it is a work place application, that confirmation is obtained that the employer has no off-street parking provision available.

• The bay would not be in a "Where not to park" location as listed in sedion 1 D of 'The Blue Badge Scheme" advisory leaflet, published by the OfT and given to all blue' badge holders.

• There should be no more than 2 disabled spaces provided 10 every 1 Dam of carriageway.

(Ii) Shops and/or post offices and other public buildings.

Provided:

• It can be demonstrated that there is a need for disabled bays because of the general waiting/loading restrictions in the area preventing the normal blue badge holder concessions.

• There is a need to limit the waiting time for the disabled to allow a 'frequent turnover of bays.

Preamble

Generally vehicles legitimately displaying a blue badge are provided on street parking concessions not available to non-blue badge holders. Therefore there is a Ifmited need for dedicated blue badge holders' parking spaces. The advice/procedures to be followed are set out in DTA 03/05.

ON-STREET PAY AND DISPLAY

1 . Scheme Planning

(i)

On-street Pay and Display Parking schemes are introduced to manage traffic demand, reduce the volume of traffic seeking a parking space and thus congestion. The schemes provide belter management of parking spaces and ensure a frequent turnover of parked vehicles thereby assisting the business community through the availability of parking spaces for customers and short-term business use.

(il)

The schemes need to be part of the overall traffic and parking strategy for an area. Consultations are held with the District Council and the Police, also the proposals may be formulated through a Community Travel Plan.

(iii)

Charges for Pay and Display parking schemes need to be set slightly above the equivalent off-street parking charges - for the area in question. This will encourage the use of off-street car parks.

(iv)

The maximum permitted stay is limited. for example. to one hour in central locations and two hours in outer zones.

(v)

Schemes can operate for different time periods depending on the particular circumstances e.g. continually or during the working day only. This decision would be made as part of the strategic planning for the scheme taking account of the local Parking Strategy or Community Travel Plan.

(vi)

Schemes can allow use by holders of residents' parking permits both free of charge and for unlimited time to tie in with the arrangements for residents' parking in the area.

(vii) Motorcycles are exempt from any charges.

(viii) Orders for the schemes are made under The Road Traffic Regulation Act 1984 through the County Solicitors.

2. Operational Considerations

(i) The schemes are enforced by Traffic Wardens and arranqernents need to be made with the police to set the level of enforcement and any particular times for enforcement.

(ii) The EATS Traffic Section will provide information on pay and display machines generally they should be solar powered machines in support of the DCC Agenda 21 objectives.

I confirm that I have no objections to the County Council making the necessary application to the Secretary of State for Transport for powers to enforce on street parking.

I anticipate your application will' describe the County Council's proposal to work with Teignbridge, West Devon and South Hams District Councils to form the South Devon and Dartmoor Region by delegating on-street parking enforcement powers to the District Councils.

I remain keen to promote the shared service approach to this project. I am also conscious that the timeframe for commencing delivery of the service is short and there is a clear need to make rapid progress with the financial assessment and Service Level Agreement considerations. To that end I understand a joint meeting has been arranged with RTA Consultants in the next week or so.

After debating, it was confirmed that as follows:

This Order is made in exercise of the powers conferred by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(a).

Devon County Council has applied to the Secretary of State for an order to be made under these powers with respect to part of its area.

The Secretary of State has consulted the chief officer of the Devon and Cornwall Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.

Accordingly, the Secretary of State for Transport(b) makes this Order:

Citation and commencement

1. This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Devon) Designation Order 2008 and shall come into force on 5th May 2008.

2.-{ 1) The Secretary of State designates the area described in paragraph (2) as(a) a civil enforcement area for parking contraventions; and

(b) a special enforcement area.

(2) The designated area is the County of Devon except for all roads (other than highways) situated on land owned by the Secretary of State for Defence.

ENFORCEMENT POWERS UNDER PART 6 OF THE TMA ACT 2004

Issue

1. Signing the order at Annex B.

• The order will designate the County of Devon as a Civil Enforcement Area and Special Enforcement Area (CEAlSEA).

This application for civil parking enforcement (CPE) powers is in line with our policy of encouraging local authorities to take on these powers. Enclosed is the Statutory Instruments' Explanatory Memorandum at Annex C. Devon County Council have not requested for the powers to enforce bus lanes as part of their application. They are likely to request such powers at a later stage.

Timing

2. URGENT

The commencement date for the order is 5th May 2008. As we need to lay the order at least 21 days before the commencement date and to allow for printing, the order needs to be signed by 8th April 2008. If we do not meet that target, Devon County Council may be faced with substantial PR and financial penalties due to the resultant disparity with their pre-enforcement publicity and contractual arrangements for the new enforcement regime. There might be a reasonable case for DfT to meet any such costs.

Recommendation

1 That you approve and sign the order at Annex. B.

2 Indicate that you are content with the Memorandum at Annex C

3 Write to the Leaders of Devon County Council and all of its district councils, and to the local MPs in the areas informing them of the making of the order. Draft letters are attached.

Background

4. The Road Traffic Act (RTA) 1991 established arrangements for the decriminalisation of most non-endorsable parking offences in London. The 1991 Act provided for similar arrangements to be introduced in other areas on application to the Secretary of State. Part 6 of the Traffic Management Act which came into force on 31st March 2008 replaces Part II and Schedule 3 of the RTA 1.991 and some local legislation covering London only. To date, approximately 200 local authorities outside London have CPE powers. Over 50 councils are in the process of applying for such powers under the new parking regime in the Traffic Management Act 2004 and we expect other authorities to apply in the future.

5. This application covers all of the districts within the County of Devon. Responsibility for the enforcement of most non-endorsable parking contraventions will now fall to the local authority rather than the police.

6. The application follows guidance contained in the Department's new Operational Guidance to Local Authorities - Parking Policy and Enforcement which was published on Tuesday 25th March 2008. Details of the scope of the order for the County of Devon, the financial case, the Council's immobilisation and removal policy, the adjudication arrangements and the consultation undertaken by the Council are contained in Annex A.

7. Devon & Cornwall Constabulary support this application by the County of Devon for CPE powers.

8. Devon County Council will become a member of the Joint Committee of local authorities running the Traffic and Parking Tribunal (TPT) (formerly National Parking Adjudication Service (NPAS» which was set up by local authorities in England {outside London) and Wales, to determine appeals against Penalty Charge Notices. The Administrative Justice Tribunal Council (AJTC) (formerly Council on Tribunals) has been consulted and is satisfied with the adjudication arrangements.

Annex A

Scope of the Order

1. Under the terms of the Order, Devon County Council will have responsibility for both on-street and off-street parking enforcement within their entire CEAlSEA area.

Civil Enforcement Area and Special Enforcement Area (CE.AlSEA)

2. The CEAlSEA will cover the entire county administered by Devon County Council except for all roads (other than highways) situated on land owned by the Secretary of State for Defence.

Review of Existing Parking Regulations

3. There have been difficulties in a number of local authorities with CPE powers where it has become apparent that the traffic signs and road markings to enforce parking restrictions have not been in accordance with national standards. We used to ask local authorities at an ear1y stage in the process of applying for CPE powers to review their Traffic Regulation Orders to determine if all restrictions were still relevant or whether new ones were needed. We have changed this procedure and now inform all local authorities that we will not seek the Minister's and Parliament's approval to grant CPE powers until the authority has given us a written undertaking that all relevant TROs, traffic signs and road markings have been reviewed, are in line with OfT regulations and are .in a good state of repair by the commencement date. The Council have confirmed in writing that a complete review of the existing TROs, traffic signs and road markings have been conducted and, conform to the regulations and are consistent with one another. We have received satisfactory confirmation from the Council.

Penalty Charge Level

4. The Council will adhere to the penalty charge levels increased by the Secretary of State in May 2001. They will use the penalty charge level of £60, reduced to £30 if paid within 14 days.

Clamping and Vehicle Removals

5. The Council has applied for immobilisation and removal powers but does not intend to use these powers from the outset of the CPE operation' believing it" is' ~an unnecessary measure at this stage. However. the Council will only use the powers if it considers it necessary in the future.

Adjudication

6. Devon County Council will become a member of the Joint Committee of local authorities running the Traffic and Parking Tribunal (TPT). Local authorities in England and Wales have set up the TPT to determine appeals against Penalty Charge Notices.

Financial Assessment

7. The Council. has carried out an assessment of the financial implications of taking responsibility for enforcing parking contraventions. They estimate that t~~11 scheme will operate with a deficit of approximately £85,000 in the first year of operation.

I have chased the Council on this again and they've promised to get back to me by lunch time today. I reckon it's ok but will let you know as soon as possible.

Meanwhile, I've sent the second version of the 51 to Cornwall requesting comments by c.o.p today. I will follow up with a phone call now.

Both Concils are working towards the CPE implementation on 5 May and athe Police is happy to transfer responsibility of parking enforcement to the Councils as of 5 May 2008.

I am assuming that Devon County Gouncil have no further comments in relation to the draft SI since we have excluded the roads owned by the MoD?

Presumably everyone is content with the local authorities enforcing parking contraventions from 5th May 2008 (subject to the roads owned by the MoD), and ruling out police involvement from that date.

I will have the draft 81 third lawyer checked tomorrow and will send the 81 for Ministerial Signature this Friday.

DEVON COUNTY COUNCIL - APPLICAT.ION FOR CIVIL PARKING ENFORCEMENT (CPE) POWERS

As you are aware, Devon County Council have applied to the Secretary of State for Transport for the powers to take over the enforcement of parking offences from the police as of Monday 5th May 2008.

One of the issues that have to be addressed in the drafting of the designation Order for CPE powers, is how to deal with roads over military land within the County of Devon. We understand that the MoD and orr have liaised over this point previously with respect to the Decriminalised Parking Enforcement powers for Kennet and North Wiltshire District Councils. We are currently liaising with Council officials on this matter because such roads may be subject to military byelaws concerning parking which are enforced independently by MoD. Therefore such roads will not be included within the area designated for CPE.

The purpose of writing to you is to notify you of the way which we are proposing to define in the text of the Statutory Instrument all the roads within the county that need to be excluded.

The formulation used in Paragraph 1 of the Schedule of the Civil Enforcement of Parking Contraventions (County of Devon) Designation Order 2008 (which designates all the districts in Devon for CPE purposes) Is to include the entire area other than "all roads (other than highways) over land owned by the Ministry of Defence ". A copy of the draft SI is attached for your reference. An equivalent formulation was previously used in the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Wiltshire) (Districts of Kennet and North Wiltshire) Order 2006 and the MoD Estates Office for Salisbury was content with this.

The approach will therefore exclude any unadopted roads on the MoD's estate whilst including any adopted roads passing through it.

In order to meet the Council's timetable for introducing CPE, the Order must be forwarded for ministerial signature this week. If you do have any comments therefore I should be grateful if you could let us know by 'no later than close of business on Tuesday 1 st April 2008 or before if possible.

This Order is made in exercise of the powers conferred by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(a).

Devon County Council has applied to the Secretary of State for an order to be made under these powers with respect to part of its area.

The Secretary of State has consulted with the chief officer of the Devon and Cornwall Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 10(4) of Schedule 10.

Accordingly, the Secretary of State for Transport(b) makes this Order:

Citation and commencement

1. This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Devon) (Designation) Order 2008, and will come into force on 5th May 2008.

Designation of civil enforcement area and special enforcement area

2. The Secretary of State designates the area described in the Schedule to this Order as: (a) a civil enforcement area for parking contraventions; and

With respect to military roads for Devon, I would suggest that we \~

exclude these in the Order as this has been done in The Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Surrey Heath) Order 2006. Schedule 1 of that Order describes the military roads to be excluded.

On this basis, could you please ask the council for a list of the names of the military roads as well as the locations.

This application for civil parking enforcement (CPE) powers is in line with our policy of encouraging local authorities to take on these powers. Enclosed is the Statutory Instruments' Explanatory Memorandum at Annex C. Devon County Council have not requested for the powers to enforce bus lanes as part of their application. They are likely to request such powers at a later stage.

2. The commencement date for the order is 5th May 2008. We need to lay the order at least 21 days before the commencement date and to allow for printing, the order needs to be signed by XXX. If we do not meet that target, Devon County Council may be faced with SUbstantial PR and financial penalties due to the resultant disparity with their pre-enforcement publicity and contractual arrangements for the new enforcement regime. There might be a reasonable case for DtT to meet any such costs.

Recommendation

1 That you approve and sign the order at Annex B.

2 Indicate that you are content with the Memorandum at Annex C

3 Write to the Leaders of Devon County Council and all of its district councils ,and to the local MPs in the areas informing them of the making of the order. Draft letters are attached.

6. The 'appltcation follows 'guidance contained in the Department's new Operational

Guidance to Local Authorities - Parking Policy and Enforcement which was published on, Tuesday 25th March 200B. Details of the scope of the order for the County of Devon, the financial case, the Council'simmobilisation and removal policy. the adjudication arrangements and the consultation undertaken by the Council are contained in Annex A.

7. Devon & Cornwall Constabulary support this application by the County of Devon for CPE powers.

B. Devon County Council will become a member of the Joint Committee of local authorities running the Traffic and Parking Tribunal (TPT) (formerly National Parking Adjudication Service (NPAS» which was set up by local authorities in England (outside London) and Wales, to determine appeals against Penalty Charge Notices. The Administrative Justice Tribunal Council (AJTC) (formerly Council on Tribunals) has been consulted and is satisfied with the adjudication arrangements.

Annex A

Scope of the Order

1. Under the terms of the Order, Devon County Council will have responsibility for both on-street and off-street parking enforcement within their entire CENSEA area.

2. The CEAlSEA will cover the entire county administered by Devon County Council excluding that part of the district described in Article 3 of the Order.

Review of Existing Parking .Regulations

3. There have been difficulties in a number of local authorities with CPE powers where it has become apparent that the traffic signs and road markings to enforce parking restrictions have not been in accordance with national standards. We used to ask local authorities at an early stage in the process of applying for CPE powers to review their Traffic Regulation Orders to determine if all restrictions were still relevant or whether new ones were needed. We have changed this procedure and now inform all local authorities that we will not seek the Minister's and Parliament's approval to grant CPE powers until the authority has given us a written undertaking that all relevant TROs, traffic signs and road markings have been reviewed, are in line with OfT regulations and are in a good state of repair by the commencement date. The Council have confirmed in writing that a complete review of the existing TROs, traffic signs and road markings have been conducted and, conform to the regulations and are consistent with one another. We have received satisfactory confirmation from the Council.

Penalty Charge Level

4. The Council will adhere to the penalty charge levels increased by the Secretary of State in May 2001. They will use the penalty charge level of £60, reduced to £30 if paid within 14 days.

Clamping and Vehicle R.emovals

5. The Council has applied for immobilisation and removal powers but does not intend to use these powers from the outset of the CPE operation believing it is an unnecessary measure at this stage. However, the Council will only use the powers if it considers it necessary in the future.

Adjudication

6. Devon County Council will become a member of the Joint Committee of local authorities running the Traffic and Parking Tribunal (TPT). Local authorities in England and Wales have set up TPT to determine appeals against Penalty Charge Notices.

Financial Assessment

7. The Council has carried out an assessment of the financial implications of taking responsibility for enforcing parking contraventions; They estimate that the CPE scheme will operate with a (DEFICIT/SURPLUS) XX of £XX in the first year of operation.

As you are aware, Devon County Council have applied to the Secretary of State for Transport for the powers to take over the enforcement of parking offenc~s from t~E! pq)~e

One of the issues that have to be addressed in the drafting of the designation Order for CPE powers, is how to deal with roads over military land within the North and East of Devon and Exeter. We are currently liaising with Council officials on this matter and are aware that such roads are subject to byelaws concerning parking which are enforced independently by MoD. Therefore such roads wil'l not be included within the area designated for CPE.

While we have no problems with this in principle, we are uncertain about how best to define in the text of the Statutory I nstrument all the roads within the county that need to be excluded and whether it would be best to make reference to an appropriate map.

The formulation eventually used in Article XX of the Road Traffic England - The Civil Enforcement of Parking Contraventions (County of Devon) Designation Order 2008 (which designates all the districts in Devon for CPE purposes) is to include the entire

districts other than " , ..", A copy ofthe SI is attached for your reference.

I should be grateful if you could confirm that the MoD is content with this general approach to the exclusion of military roads from civil parking enforcement. The effect of this wording can be explained by reference to three maps which I enclose for your reference.

l.f you have any issues with us taking this approach to the exclusion of military mads, we are happy to consider amending Devon County Council's Order.
