IN THE MATTER OF: THE CONSTITUTIONAL QUESTION ACT, R.S.B.C. 1986, C. 68 AND IN THE MATTER OF THE CANADIAN CHARTER OF RIGHTS AND FREEDOMS AND IN THE MATTER OF: A REFERENCE BY THE LIEUTENANT GOVERNOR IN COUNCIL SET OUT IN ORDER IN COUNCIL NO. 533 DATED OCTOBER 22, 2009 CONCERNING THE CONSTITUTIONALITY OF S. 293 OF THE CRIMINAL CODE OF CANADA, R.S.C. 1985, C. C-46 AFFIDAVIT I, Witness No. 6, MAKE OATH AND SAY AS FOLLOW: 1. T have personal knowledge of the facts and matters hereinafter deposed to save and except where the same are stated to be made upon information and belief and where so stated I verily believe them to be true. 2. Lam aware of the order of the Chief Justice made September 24, 2010 and I elect to avail myself of the protections authorized by that order. 3. Tam a 41 year old man, bom into the FLDS community of Bountiful, near Creston British Columbia. I left the Bountiful community in 1988 and, since that time, have not been a practicing Mormon. 4. _ [currently reside elsewhere in British Columbia and I hold a senior position in the health care field, T have never lived in a polygamous relationship. I am divorced but I am now in a committed, long term loving relationship. 5. wish to avail myself of the protection of the anonymity order because I wish to protect my family still residing in Bountiful. I also find it difficult and tiresome to be constantly explaining my family history to people who know nothing about it and hold various pre conceived opinions and prejudices. I would prefer to remain anonymous. 6. I was born into a family with a father and many mothers in Bountiful. I grew up in a large home with 35 brothers and sisters, of whom 9 were my full biological siblings. 7. The household was organized with everyone having a place and a role in the family. ‘These roles were not only identified with the adults but the children had important positions within the household, 8. Lattended the Bountiful school. In 1988, I decided to leave the community and strike out on my own. There were many reasons that I left the community but one of the main reasons was that I sought a less ridged lifestyle. I do not like to follow others. I prefer to make my own decisions and I did not want to follow the strict rules of the church. 7 9, Afier leaving the Bountiful community I have kept in regular contact with many of my siblings still living in Bountiful. I also maintain a close relationship with my mother and I see her fairly regularly. 10. Ido respect the privacy of my family and I know that there are some of my brothers and sisters who do not agree with my lifestyle and choices. I respect their views and I do not impose myself on any of them who may be uncomfortable in my presence. 11. Since leaving the community of Bountiful, my views about polygamy have not changed. I was taught that that the marriage covenant was sacred and everlasting. I still believe that to be true. 12. The FLDS is not my choice but I believe that religion is a personal choice. I believe that the only people who have the right to chose what goes on in Bountiful are the individuals who live there, 13, Lchose to leave the community of my own volition and to lead my own life, I have never seen or heard of boys being driven from the Bountiful community.
