INTERNATIONAL CARBON MARKET REGULATION: VIABILITY TO BOOST
RENEWABLE ENERGY USE THROUGH CDM PROGRAMMATIC
Carbon market regulation and its implications to mitigate effectively greenhouse
gases effect have been widely discussed in the context of global climate change. There are many scientific and legal uncertainties related to CDM implementation, specially its effectiveness to help boost renewable energy use and environmental benefits in order to achieve sustainability. During the 11th Conference of the Parties (COP11/MOP-1), the United Nations Framework Convention on Climate Change - UNFCCC presented the Programmatic CDM (or Programme of Activities – POA´s) as an alternative to register activities in a different process of the original CDM. In this context, this paper aims to analyze the new scene of global climate change regulation since the creation of Programmatic CDM and its potential as a viable solution to attain an effective global climate agreement. Challenges and opportunities concerning to Programmatic CDM are discussed in the current international legal system in which Kyoto Protocol is applicable, as well as the contribution of this regulatory instrument for benefices to global climate system and quality of societies life. Under a methodological view, a conceptual analyze related to clean development mechanism requirements will be consider from a historical perspective to discuss basic principles and trades concerning to projects and programmes of activities.
