Request #2: Mt. Pleasant’s FOIA Policy. Request #3: Its procedures and guidelines implementing MCL 15.243(3). To respond to Request #1, the City must review the email messages to ensure that information exempt under the FOIA is separated from nonexempt information and properly redacted. Your name and address is needed to respond to your FOIA request. Without such information the City is unable to determine whether you are an individual or entity that meets the definition ofa “person” under the FOIA. Additionally, the City is unable to determine whether specific exemptions under the FOIA apply to your requests. For example, if you are a party to civil litigation involving the City, certain public records may be withheld from you under the FOIA. Furthermore, an address is necessary to allow the City to provide you with an invoice for the fees associated with responding to your FOIA requests. In accordance with the FOIA and the City’s FOIA policy, we estimate that the cost associated with responding to your FOIA requests will be $139.10 calculated as $30.91 per hour for 4.5 hours of search, examination, review and the deletion and separation of exempt from nonexempt information from 430 email messages. One-half of the total cost, or $69.55, is required to be paid in advance. This is an estimate City officials prepared based on our assumptions of the time needed for this very deliberate process. Actual experience may prove it takes less time than expected. Your actual costs may, therefore, be less. If City officials lear the process will be less time consuming than estimated, the required escrow may also be reduced.
