REQUEST FOR INVESTIGATION AND INJUNCTION

TODAYS DATE Attorney General Kamala Harris Office of the Attorney General of California 1300 "I" Street Sacramento, CA 95814-2919 Phone: (916) 445-955 Fax: (916) 323-5341 It is imperative you file an injunction to halt all foreclosures or evictions involving New Century Mortgage Corporation and Home123 Corporation, its subsidiary. Both of these companies were California Corporations and were under cease and desist orders since mid-2007 and finally banned by the California Corporations Commissioner from doing any further business in October of 2007. Keep in mind that these companies originated home loans across the USA to hundreds of thousands of homeowners and they were one of the world s largest subprime lenders and heavily involved in providing mortgage pools worth billions and billions of dollars to the likes of Morgan Stanley, JPMorgan Chase, Countrywide, Bank of America, Goldman Sachs, Wells Fargo etc. These companies have been under Federal Grand Jury Investigation since prior to filing for Chapter 11 bankruptcy protection in Delaware under New Century TRS Holdings, Inc.. Case 07-10416 KJC. The injunction should cover the time it should take for your office to conduct an in-depth investigation into the following: 1. Procure the notary journals of all their notary-employees. Upon information and belief these are some of the notary-employees, all California notaries: Andres Rojas, Erika Reyes, Alejandro Mercado, Michelle Flores, AzinRahmanpanah& Marisa Carrasco. One homeowner, Anita Carr, has discovered that these notaries were instructed by their supervisors at New Century Mortgage and Home123 Corporation to disregard California notary laws and property recording laws and to NOT do a line item entry in their respective notary journals for each document notarized. This effectively invalidates any documents they notarized including any assignments of deeds or mortgages recorded at county recorders offices across the USA. These are illegal acts. These acts also have clouded titles to any piece of property involved with loan originations by these companies for unsuspecting homeowners. Ms. Carr has provided your office with scanned images of Andres Rojas notary journal and his emails whereby he states that all the notaries employed by these companies were doing notarizations the exact same way.

2. Investigate the continued signing of promissory notes and assignments by one Stephen L. Nagy, a former VP at New Century Mortgage, Home123 Corporation and New Century Capital Corporation. Mr. Nagy left these companies in Dec. of 2007, yet he continues to sign his name to relevant property and mortgage related documents. It is now 2011. 3. Investigate the myriad of different types of signatures of Stephen L. Nagy. 4. Investigate for forgeries of Stephen L. Nagy on assignments of deeds and promissory notes. 5. Investigate whether these companies were involved in civil and/or criminal RICO in conjunction with any of the banking and securities entities who purchased mortgage loan pools from them

You may be aware that many institutional investors and private investors are now suing the likes of Morgan Stanley, JPMorgan Chase, Wells Fargo, Bank of America etc., who purchased defective mortgage pools from New Century Mortgage Corporation, Home123 Corporation and/or New Century Capital Corporation. These mortgage pools were developed into REMIC securities trusts. It is believed there is also tax evasion occurring at the national and state level due to the defective mortgage pools. I urge you to immediately place an injunction and moratorium on all foreclosures and evictions where home loans were originated by New Century Mortgage Corporation and Home123 Corporation until your investigation is completed.
