Section 40 of the Food Safety Act incorporates a number of enabling powers

for Ministers in relation to the enforcement by local food authorities. This has

resulted in the production, as a joint exercise by the former Ministry of Agri-

culture, Fisheries and Food, Department of Health, Scottish Office and Welsh

Office, of a series of codes of practice, incorporating guidance, predominantly

aimed at ensuring uniformity of interpretation and enforcement of the Act by

local food authorities. Reference should be made to the actual Codes and guid-

ance for further information in specific situations.

The significance of these codes must be appreciated by both enforcement offi-

cers and persons representing operators of food businesses charged with

offences under the Act and regulations made under the Act. Under section 40,

food authorities ‘shall have regard to any relevant provision of any such code’

in their enforcement procedures.

Codes of Practice include:

1.Responsibility for enforcement of the Food Safety Act 1990

2.Legal matters

3.Inspection procedures – general

4.Inspection, detention and seizure of suspect food

5.The use of Improvement Notices

6.Prohibition procedures etc

In these Codes, those parts of a typeface in bold type are classed as the actual

Code detail, whereas that in ordinary type is for guidance only.
