CLOSED SESSION FOR THE DISCUSSION OF NEGOTIATIONS, LITIGATION AND PERSONNEL MATTERS ADJOURNMENT NEXT REGULAR SCHEDULED MEETING OF THE MAYOR AND COUNCIL WILL BE HELD ON SEPTEMBER 15, 2011

ORDINANCE NO. 2338 AN ORDINANCE AMENDING CHAPTER X, SECTION lOA. 1 OF THE CODE OF THE BOROUGH OF ROSELLE PARK REGARDING FEES FOR COMMUNITY CENTER BE IT ORDAINED by the Mayor and Council of the Borough of Roselle Park, County of Union, State of New Jersey that Chapter X, Section 10-4.1 of the Borough Code is hereby amended as follows: SECTION 1. 10-4.1 Fees Enumerated Community Center! Activities: Ceral11ics, Aerobics, per class Zumba, per class SECTION 2. If any section or portion of a section of this Code shall be invalid for any reason, such invalidity shall not affect the validity of the remaining sections .or portions of this ordinance. SECTION 3. All ordinances or parts of ordinances, to the extent that they are inconsistent herewith, are hereby repealed. SECTION 4. This amendment to the Code of the Borough of Roselle Park shall become effective upon publication and in accordance with law. RESOLUTION NO. 168-11 WI-iF]{_EAS,the Borough of Roselle Park no longer has use for the attached automobiles therefore,beit RESOLVED,by the Mayor and Council of the Borough of Roselle Park that the Borough Clerk be and is hereby authorized to sell the attached items, as is, at public sale at a date within 60 calendar days. The auction will be advertised in the following media, Union Leader and Star Ledger and Borough of Roselle Park Web Site. 1. Said sale shall be conducted by the Borough Clerk or by any person so designated by her. 2. Saidpr.operty is being sold "as is". 3. All prospective purchasers are put .onnotice to personally inspect the property. 4. Atthe Time of.said sale, the purchaser shall deposit the entire purchase price with the Borough Clerk in cash or certified check made payable to the Borough of Roselle Park. 5. If the purchaser fails to take title and possession with ten (10) days of the date of purchase, the Governing Body of the Borough of Roselle Park may declare the contract of sale to be terminated and may retain all monies paid there under as liquidated damages, and the Borough may resell said property or pursue such other and further legal and equitable remedies as it may have. If the purchaser fails to take title or possession within said ten (10) days, purchaser will be liable for reasonable storage fees. 6. If the title to this property shall prove to be unmarketable, the liability of the Borough shall be limited to the repayment of the amount of any sums paid by said purchaser to the Borough without any further costs, expense, damage, claim against or liability upon the Borough.

RESOLUTION NO. 171-11 Adoption of CY20 11 Municipal Budget

RESOLUTION NO. 172-11 BE IT RESOLVED by the Mayor and Council of the Borough of Roselle Park that the Collector hereby authorizes the Treasurer to issue a check in the amount of $4,038.17 payable to CCTS Capital, LLC for redemption of 2 tax sale certificates for the meeting of September 1, 20 11. (see attached) BE IT FURTHER RESOLVED by the Mayor and Council of the Borough of Roselle Park that the Collector hereby authorizes the Treasurer to issue a check in the amount of$100.00 from the Tax Collectors Premium Account also payable to CCTS Capital, LLC for redemption of tax sale certificate for the meeting of September 1, 2011 (see attached)

and Council ofthe Borough of Roselle Park hereby waiving the permit fees for storm damaged repairs. Repairs will be limited to electrical, plumbing and mechanical only .. Fees which will be waived should be limited to 30 days from the date of the storm on August 28th 2011. BE IT FURTHER RESOLVED the mandatory State of New Jersey DCA fees must still be collected.

RESOLUTION NO. 174-11 WHEREAS, the Board of Chosen Freeholders of the County of Union is aware that Friday, September 16,2011 has been declared "POW/MIA" Remembrance Day" in the County of Union; and WHEREAS, all Americans everywhere owe a special debt of gratitude and responsibility for remembering and honoring those who have given so much to make all of us free and secure in this, our national homeland, and a recognition day is a fitting testament and remembrance for all of us, for the sacrifices of our POW /MIA veterans; and WHEREAS, in honor of this special day, a ceremony will be held in front of the Union County Courthouse, Broad Street, Elizabeth, New Jersey on September 16,2011 at 11:15 a.m.; NOW, THEREFORE, BE ITRESOL VED by the Board of Chosen Freeholders of the County of Union that it hereby declares, Friday, September 16,2011 as: "POW/MIA REMEMBRANCE DA Y" in the County of Union and urges all citizens of the Union County to make a special effort to give thanks and to remember the sacrifices rendered to us by all of these noble sons and daughters of America; and BE IT FURTHER RESOLVED that a certified copy ofthis Resolution be forwarded to all Union County Veterans Posts, Union County Legislators and Union County Mayors.

RESOLUTION NO. 175-11 BE IT RESOLVED by the Mayor and Council of the Borough of Roselle Park that the Mayor and Council have discussed the Best Practice Inventory as prepared by the Chief Financial Officer at the Regular Open Public Meeting of the Governing Body held on September 1, 2011. within the Borough of Park on August 28, 2011 and the Office of the Governor '-''-''_>u.J,'-''-' a State of Emergency in the State of New Jersey on August 27, 2011 by reason of Hurricane Irene with major flooding and power outages, NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Roselle Park that the Mayor and/or the Borough Clerk are authorized pursuant to N.J.S.A. 40A: 11-6 to enter into an emergency agreement with Suburban Disposal for the emergency bulk pick up of flood damaged items in accordance with a quote solicited and submitted in the amount not to exceed $6,000.00 trucking and if necessary reimburse all disposal costs. RESOLUTION NO. 177-11 WHEREAS, the Borough of Roselle Park has requested assistance from the County of Union to perform services as may be required to assist in the recovery from Hurricane Irene; and WHEREAS, The Borough of Roselle Park and the County of Union have agreed to work together in the recovery efforts; WHEREAS, the Parties wish to enter into an agreement defining the responsibilities and expectations of the parties hereto; NOW THEREFORE BE IT RESOLVED that the Mayor and Council hereby authorize the Mayor and Borough Clerk to execute said agreement attached and made a part thereof effective immediately and shall continue until the services requested are completed.
