This responds to your August 8, 2006 Freedom of Information Act (FOIA) request to the Department of
Commerce (Commerce). That entity referred 46 pages of documents to the Department of Homeland
Security (DHS) Privacy Office for processing and direct response to you. Those documents were received
in this office on September 18, 2006. You requested documents pertaining to the Security and Prosperity
Partnership of North America and the North American Competitiveness Council.
‘We have enclosed 44 pages of the 46 pages referred to us by Commerce with information withheld
pursuant to Exemptions 2 and 6 of the FOIA, 5 U.S.C. §§ 552 (b)(2) and (b)(6). We are withholding 1
page in its entirety pursuant to Exemption 5 of the FOIA, 5 U.S.C. § 552 (b)(5). Exemption 2 (low)
exempts from disclosure records that are related to infernal matters ofa relatively trivial nature, such as
intemal administrative tracking. Exemption 2 (high) protects information applicable to internal
administrative matters to the extent that disclosure would risk circumvention of an agency regulation or
statute, impede the effectiveness of an agency’s activities, or reveal sensitive information that may put the
security and safety of an agency activity or employee at risk. Exemption 5 protects the integrity of the
deliberative or policy-making processes within the agency by exempting from mandatory disclosure draft
documents, and opinion, conclusions, and recommendations included within inter-ageney or intra-ageney
‘memoranda or letters. Exemption 6 exempts from disclosure records the release of which would cause a
clearly unwarranted invasion of personal privacy.
‘The remaining 1 page is a duplicate. In an effort to conserve resources, we have elected not to include any
duplicate pages with this release.
You have the right to appeal the withholding determination. Should you wish to do so, you must send
your appeal within 60 days of the date of this letter to: Office of the General Counsel, Department of
Homeland Security, Washington, D.C. 20528, following the procedures outlined in Subpart a, Section 5.9,
