December 2, 2011 On December 1, 2011, the Attorney General issued guidance concerning Section 30 of the immigration law. This is a public document and is available on the immigration page of the AGO website at http://www.ago.alabama.gov/PageImmigration. It is also attached hereto. This guidance provides that until such time as a governmental entity (state, county or municipal) has a protocol in place to use the SAVE program for verification of citizenship or lawful status in the United States, the governmental entity should not require anyone to demonstrate their U.S. citizenship or lawful status in the United States to enter into any business transaction (including issuing a business license). Many municipalities have already mailed their business license renewal information informing individuals of the need to verify their citizenship or lawful presence. If they provide it to you there is no problem; however, the Alabama League of Municipalities wanted to make sure you were aware of this guidance because if an individual fails to provide you with any verification or documentation, you cannot withhold their license on this basis alone. ALM is of the opinion that individuals still need to declare their citizenship or lawful status under penalty of perjury. This declaration may take the following form but they do not have to provide any further proof or documentation of their citizenship or immigration status. “Under penalty of perjury, I _______________________ (print name), the undersigned do hereby declare that I am a United States Citizen or that I am a lawfully present alien of the United States of America.
