The JCT identifies changes as Variations

- The architect determines PC - The JCT specifies the different methods of valuing change i.e Valuation rules, Schedule 2 quotations and Dayworks Interms of payment, the final date of payment is 14 days after the due date The ca/architect has 7 days after the contractors statement to issue an interim statement and thats when payments become due. The withholding notice is issued 5 days before the final date of payments There are 7 conditions of relavent events There is a specific clause for relevant matters

ICE - Catered towards the Civil engineering industry - In the ICE the Architects Role is replaced by the Engineer / the employers representative on the clients side. - There is no role for the QS The ICE identifies changes as Ordered Alterations Since most of the works in Civils involve deep ground works, the clause in regards to artificial obstruction is considered of great importance in terms of risk. - the Engineer determines PC - The ICE uses the word quotation as a means of valuing change however parties must consider the contract rates. The ice also mention dayworks can only be applied if the employer requests. Ice states the final date of payment is 28 days after delivery of contractors statement. The employers representative has 25 days after the issue of contractors statement to issue and interim certificate and thats when payments become due. The withholding notice is issued 1 day before the final date of payments - There are 5 conditions of relevant events - Loss and expenses / additional payment is incorporated as part of the effects of various clauses

Difference between the ICE Design and Construct and NR9 contract:

1. The contractor is not allowed to subcontract any works or design to another party
without prior consent from the employer. 2. The NR9 limits the contractors liability to his design obligation at 10m. 3. The Contract must provide run off cover for PII insurance for his design 12 years after Substancial completion on an each and every claims made basis. 4. The NR9 requires the contractor to provide a PCG rather then a performance bond. 5. The NR9 excludes pollution and contamination as a physical condition. 6. In terms of EOT the NR9 has ommited one of the events with pollution and contamination and also cancellation and alteration of possession dates.
