LETTER WRITTEN WITH BLOOD BY A TEACHER Honorable sir, With the ink of my blood, I am writing this letter to you because the J.B.T.s of 2008-10 batch in Himachal Pradesh have been exploited in the camouflage of Teacher Eligibility Test. The cabinet of Himachal Pradesh had announced jobs to these JBT trained Teachers(in August,2011) but its implementation was delayed. Meanwhile N.C.T.E. issued a notification in February,2012 which made T.E.T. mandatory for appointments but these candidates had been announced jobs earlier and exploitation of these unemployed youths by imposing T.E.T. is not fair. It is injustice.They have passed Common Entrance Test for J.B.T. and then successfully completed the J.B.T. course which does not allow anyone to consider them ineligible and unqualified for job. Almost 26000 primary teachers working in Himachal Pradesh have the same qualification.No test of T.E.T. for J.B.T.s has been conducted in Himachal Pradesh yet and here suffering schools and these unemployed candidates are waiting for the jobs. Approximately 985 single teacher schools and 5969 schools having two teachers per school are suffering from lack of staff. Those schools await for these appointments because almost 500 govt. primary schools have been closed due to lack of enrolment which also occurs due to lack of staff. The education of children is in danger because there have been a few appointments in last three years. Quality in primary education will come if teachers are appointed and if they are not appointed, it is impossible to be achieved. T.E.T. is the not the only option for quality education. We are not against T.E.T. but against no appointments. Every J.B.T. to be appointed will pass the T.E.T. within three years of service and the appointments may be done at this condition. When T.E.T. was not conducted in India, wasnt there any quality education here?Please take the example of Keral state. The state has allowed the temporary appointments of the teachers without T.E.T. if the T.E.T. pass teachers are not available in sufficient number and they will claim regular post appointments on passing T.E.T. which means that the conditional temporary appointments of these teachers are possible in H.P. on Keral pattern. The same type of T.E.T. relaxation has been given to inservice, temporary or private school teachers in that state which was done under the new Group C Service Rules ,2012 of Haryana state.it has been mentioned in the R.T.E. Bill provision 23(2) that the state will ensure that the teachers will complete the minimum qualification criteria( like T.E.T.) within five years of thee commencement of the RTE Bill, for which the centre govt. or M.H.R.D. can allow relaxation. Myself request you to interrupt in this issue by using the article 255 of Indian constitution. The lack of staff in schools of HP may be removed and T.E.T. may be conducted in such a manner that the candidates get at least three years time to pass it and hence, the H.P. cabinet decision may also be revered. You are called- The Chanakya of Politics, but your post is above politics and supreme. By writing the letter with my blood , I hope that the JBTs will be appointed in H.P. with the condition to pass the T.E.T. within three years of appointment. Please issue the necessary directions to M.H.R.D., N.C.T.E. and GOVT. OF. H.P. in this matter. All needed documents are attached. Sub:Ref:General Education - Package - Staff Fixation during -2012-13-clarification - reg. (1) G.O.(P) No.l99/ll/G.Edn dated 01.10.11 As per the Government Order referred above it was ordered that the staff fixation in each school during 2010-11 academic year would be applicable to 2011-12 also. However vacancies that arose due to death, resignation, promotion and retirement during 2010-11 were allowed to be filled up. During the academic year 2012-13" staff fixation in each school will be decided based on the strength of students which is to be determined by the process of UID. The process of UID enrolment of students in each school is going on and it will take some more time to complete this process. (2)

In the circumstances it is clarified that the staff fixation for 2010-11 will be made

applicable to 2012-13 also till the process of .UID. enrolment is completed in each school. The staff fixation will be revised in each school as soon as UID based strength is available. It is also clarified that the managers, are permitted to fill up the vacancies arising during 2012-13 due to retirement, promotion, death and resignation on regular basis if the TET qualified teachers, are available for appointment as TET is a mandatory qualification for the post of teacher as per RTE Act. Teachers who have qualified CTET, NET, SET and who have M.Phil or Phd in the respective subject are exempted from acquiring TET. If the TET qualified hartds are not available for appointment, the manager can appoint teachers without TET qualification on daily wages till the TET qualified teachers are available for permanent appointment.

ORDER As per the GO read above, Government have approved the guidelines developed by SCERT to conduct the Teachers Eligibility Test in the state. In modification/exemption to the GO read above, Government are pleased to hereby order the following: 1) The teachers who are appointed against regular vacancies on or before 31.3.2012 are exempted from acquiring K-TET. 2) Claimants under Rule 51 (A) and Rule 51 (B) Chapter XIV A KER as on the date of this GO are exempted from acquiring K-TET. 3) The teachers appointed on daily wages against additional division vacancies during the academic year 2011-2012 will be exempted from acquiring K-TET provided they are found to be otherwise eligible for approval and the vacancies to which they were appointed are properly established on completion of UID based staff fixation. 4) The teachers who are appointed against regular vacancies in 2012-13 will be given approval w.e.f 1.6.2012 if they produce K-TET Pass Certificate. 5) M.Ed holders shall stand exempted from Kerala Teacher Eligibility Test. 6) The word 'State Eligibility Test' in the para(2) of the GO read above shall be corrected and read as 'Kerala Teacher Eligibility Test'. Regarding exemption from T.E.T. in teacher appointment Reference your letter No, 3-I/2012-EE-4 dated

15.04.2012 on the subject cited above. The requisite comments are as under Keeping in view vast experience of teachers working in privately managed Government aided schools, recognized schools and Government schools and to ensure quality education, it has been decided by the Haryana Government that candidates falling in the above mentioned categories arc given relaxation in age to the extent of service rendered by them as a teacher subject to a maximum of five years. Similarly, exemption from passing Haryana Teacher Eligibility Test (HTETJ has been given to the said categories of teachers with a minimum of four years of service on the enforcement of new rules notified on 11-04-2012. Further, it has been provided in the said rules that the said categories of teachers on their appointment shall have to qualify HTET by not later than 1st April. 2015 and in the eventuality of not passing HTET, their appointment shall stand terminated automatically without giving any further notice. It is worth mentioning here that this relaxation/exemption is only one-time measure so as to ensure availability of experienced and quality teachers in implementing and achieving tile objectives of RTE Act, 2009 in right earnest.
