NOW, THERf,FORE, on motion of Member, Hon. ARLEIGH JAY C. SITOY, and adopted as on MASS MOTTON by all the Members of this Body present,
duly seconded by the same, be it

RESOLVED to ensct, as it is hereby ENACTED the following:

ORDINANCE NO. 20I2-08

(IOO/O\ REAL DISCOUNT TO AGRICULTURAI, PROPERTY TAX LOT OR FARM OWNf,RS WHO SOLELY, EXCLUSIVELY AND DIRECTLY DEVOTE THEIR PROPERTIES TO ORGANIC FARMING OR ACRICULTURE.

GRANTING

TEN PERCENT

The Sanggntriang Panlalawigan ofCebu, hereby ORDAINS, that:

SECTION 1 PURPOSE. fhe Province of Cebu hereby adopts th state policy No. 10068 otherwise entitled as the "Organic Agriculture Act ol 20l0" by alnrming that the promotion ofotganic agriculture is in lull accord with its development strategies expressed in the present administration's l2-point agenda. As such, the Cebu Provincial Govemment shall actively promote the practice of organic farming down to the grassroots level to build on local agriculture and
enunciated under Section 2 of Republic Act

consequently spur province-wide economic development.

SECTION

2.

DEFINITION. For purposes of this ordinance, the following

terms shall be understood and defined as lbllows:

(a) Organic - shall be understood in its broad sense as good grown without the aid ofman-made or synthetic chemicals; (b) Organic Farming or Organic Agriculture includes all agricultural systems that promote the ecologically sound. socially acceptable, economically viable and technically feasible production of food and libers. Organic agriculture dramatically rduces extmal inputs by refraining from the use of chemical fertilizers, pesticides and phamaceuticals. It also coveN ateas such as, but not limited to, areas devoted to storage, soil fertility management, varietal breeding and selection under chemical and pesticide-iiee conditions, the use of biotechnology and other cultural practices that are consistent with the pri[ciples and policies of R.A. 10068, and enhance productivity without destroying the soil iutd haming farmcrs, consumers and the environment as defrned by the Intemational Federation of Organic Agriculturai Movement

SECTION 3. SCOPE. The incentive offered under this ordinance may only be availed ofby a lot or farm owner who utilize the entire portion ofan agricultural land registered in his/her name solely, exclusively and directly fbr organic agriculture activities. It also colers areas where buildings are construcled as storage for the farm materials. Provided, however, that the lot or farm is duly certified as an organic farm and accredited by certifying body endorsed by the Department of Agriculture Regional Field Unit 7 (DARFU 7). Provided, further, that the land owner or his duly authorized propeny Administrator shall have undergone sufficient training and education in organic farming

and a registered organic farmer as certified by DARFU 7. Providcd, finally, that said owner is, likewise engaged in micro, small or medium enterprises in accordance with the qualifications under Republic Act No.9501, otherwise known as the Magna Carta for Micro. Small and Medium EnterDrises.

SECTION 4. REAL PROPERTY TAX INCENTM. In accordance with Section 192 ofRepub)ic Act No. 7160 or the Local Govemment Code of 1991, thre is
hereby granted a ten percent (1002) discount on the real property tax due on the property ofqualitied lot or farm owncrc who have no record ofany delinquency on the property at the time of payment. The l07o discount, which shall be levied on the properly oflhc owner, shall be granted on a per 1ax declaration basis.

SECTTON 5. APPLICATION FOR TEN PERCENT (IO%) DISCOUNT. Any person who desires to avail of the incentives granted herein shall present to the Office of the Provincial Agriculturist a certification from the Negros Island Island Certification Services (NICERT) or any inspection and cenifying Body thar may be subsequellly accrdited by the Bureau of Agricu]ture and Fisheries Product Standards (BAFPS) of the Department of Agrioulture stating that the land fbr which tho l0% real property tax discount is sought has been devoted to organic l'arming and that the production and processing systems employed are in accordance with the requircmcnts and slandards of the National Organic Agriculture Board (NOAB). After examining the certification, the Office of the Provincial Agriculturist may conduct also its own inspection ofthe property, if deemed necessary. Otherwise, it shall formally inform the Office ofthe Provincial, City or Municipai Assessor that lhe applicant has duly complied with the requirements of this ordinance and, therelbre, eligible lbr lhe real property tax
discount.

SECTION 6. OTHER INCENTIVES. Other incentives for the production, utilization and propagation of organic farm inputs provided for under Section 4 ol Republic Act No. 10068 and Rule 24 of its implementing Rules and Regulations may oc availed ofby qualified lot or fa.m o\rners in addition to the incentivc as provided herein. SECTION 7. CREATION AND COMPOSITION OF CEBU ORGANIC FARMING TECHNICAL COMMITTEE (COFTC). The Cebu organic Farming Technical Conunittee or COFT is hereby created to formulate the rules and guidelinei implementing the provisions ofthis ordinance. Such rules and guidelines, however. shall

All ordinances. executive orders, parts thereof inconsistent with the provisions of memoranda and other local issuances or this ordinance are hereby repealed or modified accordingly.
SECTION REPEALINC CLAUSE. SECTION 9. SEPARABILITY CLAUSE' lfany part, section or provision of
this ordinance shall be held invalid or unconstitutional. no other pan, section or provision thereofshall be affected thereby.

SECTION 10. EFFECTIVITY. This Ordinance shall lake eff'ecl fifteen (15)
